WHATCOM COUNTY COUNCIL
COMMITTEE OF THE WHOLE
May 1, 1989
Hansev_ called the meeting to order; same attendance as that listed
above.
EVALUATION OF QUALIFICATIONS /INTERVIEW OF EXECUTIVE'S NOMINEE FOR HEALTH
OFFICER [May be conducted In Executive Session as provided for under RCW
42.30.110 (g)]
ROEHL MOVED THAT THE COUNCIL GO INTO EXECUTIVE SESSION TO CONDUCT THE
INTERVIEW OF DR. FRANK JAMES
Burton asked for clarification of the basis for going Into Executive
session; Hansey asked the Clerk to read aloud the Information from the Open
Public Meetings Act (RCW 42.30) similar to that which follows:
RCW 42.30.110 (g) allows Council to conduct the interview in
Executive Session, but "discussion by a governing body of
salaries, wages, and other conditions of employment to be
generally applied within the agency shall occur In a meeting open
to the public. When a governing body elects to take final action
hiring, setting the salary of an Individual ... that action shall
be taken In a meeting open to the public."
Warner said he would vote against the motion because the resume and
qualifications of James had been made public, and there Is no reason to
discuss anything privately. It would be a poor decision to start the reign of
the new health officer with an executive session; and it Is better to err on
the side of "slopping something" Into the public realm than to needlessly go
into executive session, he said. Jackson agreed.
Burton disagreed, as did Vanderpol. Both said the interview should be
conducted in executive session out of respect for the one being interviewed.
Motion to go Into executive session carried (Jackson, Warner opposed).
The public was asked to leave the room and the meeting went into
executive session, with the understanding It would adjourn by 3 p.m. (when
Finance and Personnel Committee meeting scheduled to begin).
The meeting adjourned at 3 p.m.
