Present: Absent: Bob Imhof Dennis Vander Yacht 1. REPORT TO THE PUBLIC SERVICES COMMITTEE IN RESPONSE TO A PETITION RECEIVED BY THE COUNCIL ON JUNE 12 AND FORWARDED TO THE ADMINISTRATION FOR REVIEW (AB90- 204) Vanderpol said Engineering suggested the speed limit remain at 35 mph. Imhof said both Engineering and the Sheriff have suggested this stay at 35 mph. IMHOF MOVED TO RECOMMEND TO COUNCIL THE SPEED LIMIT REMAIN AT 35. Motion carried unanimously. 2. ORDINANCE AMENDING WCC CHAPTER 17, "FLOOD DAMAGE PREVENTION," TO INCORPORATE NEW FEDERAL FLOOD MAPS AS REQUIRED BY THE NATIONAL FLOOD INSURANCE PROGRAM (AB90 -316) IMHOF MOVED THIS ITEM BE RECOMMENDED FOR APPROVAL TO COUNCIL. Motion carried unanimously. 3. ORDINANCE ESTABLISHING SERVICE LEVELS FOR SOLID WASTE AND RESIDENTIAL RECYCLING COLLECTION IN UNINCORPORATED AREAS AND NON - RESIDENTIAL RECYCLING IN ALL AREAS OF WHATCOM COUNTY (AB90 -306) Liz Thomas, Preston, Thorgrimson, said the haulers will have a voice in designating test routes. There was discussion between Pat Dunn, Emily Jackson, and Bob Jurica on the validity of the testing being done. Thomas discussed whether successive cans will be the same as the first can. There is confusion whether the county has the right to set rate. Recycling may have frequency changes to make it more cost effective. If collection is not mandatory, the haulers say recycling pickups will be very expensive. Dunn said they will apply for the rate Whatcom County has asked for but there is some suggestion they may net get it; there may have to be flexibility in pickup. Bob Fenley, Pomona Grange, stated he had great concerns about the Council action. The granges oppose mandatory pickup and are in favor of Olivine getting a permit as a transfer station. Bob Jurica said this ordinance can stand alone although it would work well with the solid waste ordinance. He outlined the service levels for solid waste and residential recycling ordinance. Pat Dunn discussed areas in data collection. In 1989 Counties were allowed to write service ordinances; now haulers must let counties know of any proposed rate increases and do extensive reporting. Imhof said a number of people have asked what the rates might be and he feels uncomfortable about passing through something without a price tag. Dunn said that he would be sharing the information before it went through. He said they are proposing getting councils involved in the process. Vanderpol said his constituents want to know numbers as well. TION. IMHOF MOVED TO SEND THIS TO COUNCIL WITHOUTARECOMMENDA- Motion carried unanimously. 4. ORDINANCE CREATING A SOLID WASTE COLLECTION DISTRICT (AB90 -3) Vanderpol amended the ordinance by deleting section 3 and replacing it with (handout) Vanderpol stated he had some amendments: On page 85 of the packet, section 3, solid waste-l' collection district ... be added every place in the ordinance that solid waste collection appears. Motion to amend carried unanimously. Vanderpol made the following amendment: Delete section 3 entirely, and replace it with the following: A. [same] B. Any person who wishes an exemption from the provision or application of this ordinance may file an affidavit with the Solid Waste Manager which states substantively as follows: Public Service & Solid Waste Minutes, 11- 06 -90, Page 2 recycling and solid waste collection because environmentally sound way. This affidavit is subject to verification designee. C. {Use previous "D ".] I am disposing of my solid waste in an by the Solid Waste Manager or his /her Vander Yacht concurs with change in language to add "recycling and" but does not agree with the amendment on exemptions. He said he is opposed to mandatory collection and finds this a smokescreen. There was discussion between Vanderpol and Vander Yacht about this issue. Jackson asked if someone would be checking on an annual basis. She agrees with Vander Yacht that this is watering down the ordinance. Vanderpol said he thinks some people do look after their garbage appropriately and does not see this as a smokescreen. Imhof said he will vote to approve this as it is better than the last one even though he is against exemptions. Jurica said he can envision a broad difference about an environmental disposal of garbage so it will be a difficult task. TION. Motion carried 2 -0 with Vander Yacht against. Thomas said the change adding recycling is included in the name but not throughout. IMHOF MOVED TO SEND THIS TO COUNCIL WITHOUT RECOMMENDA- Motion carried unanimously. 5. NEW APPLICATION FOR A BCEF LIQUOR LICENSE BY KENNY JAKE DIXON AND SHELLEY ALBERTA DIXON FOR THE WORKSHOP (KING COHO ENTERPRISES) AT 7863 BIRCH BAY DRIVE, BLAINE (AB90 -346) IMHOF MOVED TO RECOMMEND APPROVAL TO COUNCIL. Motion carried unanimously. 6. NEW APPLICATION FOR AN EF LIQUOR LICENSE BY AUDRA MAE PANGBURN FOR THE CUSTER COUNTRY STORE, 2910 MAIN STREET, CUSTER (AB90 -347) IMHOF MOVED TO RECOMMEND APPROVAL TO COUNCIL. Motion carried unanimously. 7. APPOINTMENT TO SEWAGE APPEALS BOARD (AB90 -335) Public Service & Solid Waste Minutes, 11- 06 -90, Page 3 7. APPOINTMENT TO SEWAGE APPEALS BOARD (AB90 -335) IMHOF MOVED GERALD KRAFT BE APPOINTED TO THE APPEALS BOARD. Motion carried unanimously. 8. APPOINTMENTS TO CEMETERY DISTRICT 3 COMMISSION (AB9u- 336) IMHOF MOVED TO APPOINT RICK SHAW AND FAYE JACOBS. Motion carried unanimously.
