PUBLIC SERVICE AND SOLID WASTE COMMITTEE
March 13, 1990
The meeting was called to order at 6:04 p.m. by Committee
Chairman Marvin Vanderpol with Dennis Vander Yacht and Bob Imhof
present.
1. REQUEST FOR APPROVAL OF THE FINAL REVISED COMPREHENSIVE
SOLID WASTE MANAGEMENT PLAN FOR WHATCOM COUNTY (AB90 -90)
Van Zanten explained this issue.
IMHOF MOVED TO RECOMMEND APPROVAL TO THE COUNCIL.
Carried unanimously.
2. ACADEMY ROAD R.I.D. (AB90 -39)
Henken, County Engineer, displayed a map showing the owners
in favor and the ones who had signed a "no protest" agreement as
well as those who did not respond.
Vanderpol asked how the yes votes were weighted. Henkin
explained the procedure saying it depended on how each property was
zoned as there is different zoning on each side of the road.
Henkin said the length of repayment for this road improvement
district would probably be ten years.
Rolf Beckhusen, Attorney for several owners on Academy Road: The
matter was tabled before for significant study, but this is merely
bringing it back in a similar form. He represents the people who
are against the project; it will be a sizeable assessment for the
owners. He questioned the "no protest" owners as some had signed
almost ten years ago. Beckhusen mentioned that the area would
eventually want sewer and water if there was development; this
again would impact the folks who do not want or need it. Trillium
owns some property in that area; when they develop their property
would be a more appropriate time to do a major plan. Beckhusen
mentioned the letter from MAI Appraiser, Follis saying this area
would not support this kind of assessment. He said the "people's
will" is that this not go through.
Pat Wheat, Owner in favor of the road being built: Wheat had
estimates done by Dibble Engineering and they are significantly
less than the County has brought forward. He said that if the
speed limit were limited to 25 mph, and a lesser coating applied,
the cost of the road would be brought down even further. He said
that some of the owners were against it because of the financial
considerations; if the costs were less, they may have voted for
the project. Wheat mentioned he had spoken to new people who were
in the process of buying when this was before us and they were not
contacted. He asked Jurica why it wasn't sent forward to Council
in 1986. Jurica said it was pretty well split and there wasn't
enough commitment at that time.

Reese representing the Abbotts, said this is going to happen
eventually and now would be cheaper than in the future.
Bruce Sherman said he is worried about the long term effects on the
watershed. Vander Yacht asked Sherman what it would take for him
to support a road in the area. Sherman said a smaller road more
in tune with what was in there; he would also want a comprehensive
plan showing the results on the watershed. His assessment is as
much as if he subdivided; he can't and others can.
Wheat said there is no problem getting water on his property.
Imhof said Wheat has not applied for a permit to build on his
property; Henkin said he could apply for a trail permit and put one
house on his acreage.
Marlowe said he would rather wait and let large developers pay
for a road.
Imhof said he thinks there is a lot of dissention on this
issue yet. Vanderpol said that technically the votes are there for
the yes people; but would not be if the "no protest" people were
allowed to vote. He then asked what is equitable? Vanderpol would
like to see the proposers of the road get together and figure out
what would be an equitable arrangement. The people who will not
be subdividing should not pay at the same rate as those who do plan
to subdivide. Wheat said he would agree to a gravel road.
Vanderpol said the County does have to work within the road
requirements.
IMHOF MOVED TO DENY THE ACADEMY ROAD R.I.D.
Motion carried 2 -1. Vanderpol did say he would look favorably
on bringing this forward if there was some more equitable division
of costs.
