PUBLIC SERVICES AND SOLID WASTE COMMITTEE
THURSDAY, FEBRUARY 15, 1990
6 P.M.
The meeting was opened at 6 p.m. by Bob Imhof with Vander
Yacht present. Others present were: Jack Weiss, Pat Wheat, Liz
Thomas, Brad Bennett, Penny Johnson - Marlowe, Jim Marlowe, Bonnie
Meyer, Chuck Meyer, Bruce Sherman, Sheila McElhinney, John Davis,
Bill Sygitowicz, Marge Laidlaw, Rolf Beckhusen and Paul Rushing.
2. FORMATION OF ACADEMY ROAD R.I.D.; DETERMINE IF BALLOTS
IN FAVOR OF THE FORMATION ARE SUFFICIENT, AND IF SO, SET
A HEARING (AB90 -39)
Henken explained the procedure that could be followed: a
property appraisal paid for by the proponents which would be
refunded if the project goes ahead; Council could choose to go
ahead without an appraisal.; or reject the project without an
appraisal.

Beckhusen spoke about Henken's letter; he believes that he has
proof that he can kill the proposal. He said that Anderson had
obtained assurance from the Engineering department that he did not
have to sign. Beckhusen discussed Meyer and Marlowe's ballot
saying they had not waived their rights to protest. They did waive
their rights to an LID under an law that has been repealed.
Neither parcel abuts the road. They did not waive their rights as
far as an RID is concerned. He gave an opinion from Bill Follis
saying there would be no appreciable benefits to the property
owners to the extend of recovering costs. He says we need to
verify the results before going forward to the other steps.

Read a letter from all the people west of the area in question.
They ask that the Council deny this RID. The proposed road
eastward would encourage more development as owners would be forced
to develop to pay their assessment. Demands would then be made for
a water and sewage system because of the steep hillsides and the
danger to the watershed. Approval of this RID would change forever
the face of this beautiful area but denial would allow the
piecemeal development that is going on at present.
Henken said that the Anderson /Ray property has a waiver on the face
of the short plat document. The ten year waiver is up on the Meyer
and Marlowe property in April.

Asked why this was taken up at this time since it was dropped some
years ago? Henken said an owner had asked that it be reopened.
When you go into Council, how will the other members know what
points the attorney brought forward at this meeting? Vander Yacht
said he would recommend having the points investigated and having
it brought forward at a later date.
1. ORDINANCE PROVIDING FOR THE LEVY OF A SOLID WASTE
DISPOSAL TAX (ALSO SCHEDULED FOR FINANCE 2/12) (AB90-
34)
Elizabeth Thomas gave a brief overview of the disposal tax
that is being proposed. The haulers would collect the tax from the
customers and this would be turned over to the County. Bennett
said they had calculated that it would yield around $1 million per
year; this would be sufficient to fund the project for the next
several years. This will replace the revenue formerly collected
at the Landfill to cover the Solid Waste operation.
3. PRELIMINARY DISCUSSION OF HARKSELL AND ENTERPRISE ROAD
PROBLEM - MRS. GAIL BELL REPORTS THAT EIGHT ACCIDENTS
HAVE OCCURRED IN HER FRONT YARD (NO STAFF REPORT
REQUESTED) (AB90- )
Henken said that there have been eight accidents since 1983
and the drivers have been cited for driver - error. He said it was
on Harksell and North Enterprise. Vander Yacht said he would like
this complaint investigated and have it come back to us at a later
time.
4. DISCUSSION OF BOUNDARIES FOR GUN CONTROL ZONE IN
GALBRAITH AREA (ORDINANCE ADOPTED 2/1, REFERRED TO
COMMITTEE FOR REVIEW OF BOUNDARIES) (AB90 -11)
Imhof said that Taylor had stated that the present boundaries
conform to the requests of the citizens but he has also had
residents request that the fines be increased to $100 to $500
rather than $10 to $100. He suggested asking Randy Watts, Chief
Civil Deputy Prosecutor, about this.
Henken said he would recommend running the line right up to
the City along the easterly pipeline. This whole area is in
transition. Henken said he thinks everything west of the pipeline
should be included in this control zone. Henken said he does not
feel high powered rifles should be in the area at all.
