April 19, 1990
The meeting was called to order at 6:30 in the Point Roberts
Community Center by Council Chairman Don Hansey.

Warner read a message from Emily Jackson explaining she was
at an Association of Counties meeting and could not attend.
Hansey introduced Carl Batchelor of the Planning Department. He
stated the public hearing will be from 6:30 to 8:30 p.m. and this
is the final opportunity for the public to give testimony. The
written record will be open until 5 p.m. April 27, 1990 at the
Council office.
Patricia Bogdanski, Bell's Point, Point Roberts: She was
concerned about the border traffic into Point Roberts at present
and urged the Council to limit development that would increase the
traffic.
Jim Plaster, Lummi resource and protection committee: Thanked
the Planning Department for rezoning Lily Point but is concerned
that developers want to build on burial grounds. If there is
building on Madronna Point there will be serious consequences; he
asked the Council to deny any .such permit.
Marie Burns, 2055 APA Road: She stated she hopes the Council
passes a further moratorium on gas station construction in Point
Roberts.
Shelley Gitlitz, 444 Moose Trail: She is concerned that parks
including Lily Point and the Heron Rookery are being zoned R10A in
the proposed plan. She also mentioned the border line -ups and the
possibilibity of a gas fire.
Bob Anderson, Land Use Consultant: Represents a group of
property owners. He distributed maps to the Council members. He
discussed multi family zoning designations, sewage systems, the
need to resolve urban reserve issue and transfer rights.
Paul Ferry, Heron Preservation Committee /Environmental
Coalition: Read a letter from Stafford Smith giving suggestions
on plan changes. This letter is on file in the Council office.

Phil Serka, 400 Commercial: He represents Gulfview
Development that is planning to build a golf course and
condominiums, and Welsh Developments, Inc. who are proposing to
develop 132 acres at Lily Point. He recommended some zoning
changes from RR -1 to UR -4 which would allow a reasonable return on
this property.
Evelyn Roth, 51 Bayview Drive, Maple Beach Protection
Association: Discussed zoning, transportation costs, escalating
real estate costs, and septic tanks. She stated Bayview Drive
should be closed to vehicular traffic in the summer and have speed
bumps installed.
Lola Samuelson Loreen, 260 Tyee Drive: Grateful to Council
for dealing with gas station problems and hopes for help again to
keep it from getting worse. Urged Council to establish better
forest protection laws to protect the beauty of Point Roberts. She
has a vision for a school and a retirement home on Point Roberts.
Rim Magnusson, representing Magnusson family: This would
adversely affect our family's property. She said if the property
is to be down zoned there should be financial compensation.
Claudette Upton, 610 South Beach: Planning staff tried to
establish a balance between residents and wildlife but the Planning
Commission, by gutting the staff recommendation, made a mockery of
the plan. There is awareness at the state level of the need to
preserve sensitive areas. Maintaining the heron rookery requires
the forests be preserved.
Rim Hunter, Children's Festival: Organizes a children's
festival; many come to Point Robert. If this plan goes into effect
there will not be the opportunity here for the children to roam in
a rural setting.
Larry Crosetti, 769 Claire Lane: He is a licensed
professional engineer and endorses the intent plan as it refers to
Lily Point. Cliffs have changed as opposed to the information
given to the Planning Commission. Scientist have said there would
be an large earthquake in this area; even a relatively small one
(4.0) in December caused a landslide.
Dennis Campbell: Represents the Hislop Estates and stated the
change in zoning is incompatible with surrounding area. He said
that cluster development on this property would not have to suffer
much tree loss at all.
Will Roehl, 1303 Commercial: Represents John and Gary Bonsein
who own 3 acres at Gulf and Tyee Drive. This property has been
zoned as commercial property but the new plan would designate this
as rural with a one unit per ten acre density allowance. This is
surrounded by commercial; he presented a petition with over 80

signatures of people around this area favoring the commercial
zoning.
David Konnert, Tsawwassen Nature Park Society: Stated that
once a forest is gone, it is gone forever. He applauds the
planning department's policies. Recommends forested area have no
more than one dwelling for 10 acres.
Ruby White, The plan will make Point Roberts a playground
for non - residents. She stated the Planning Department seemed to
favor residential over commercial uses regarding road district
assessment.
Shelly Damewood, 1721 Benson Road: Should provide a community
that will attract more permanent residents. She suggested cluster
development. The community has become divided on this issue.
Point Roberts has suffered for many years because quality
commercial development has been restricted due to water issues.
Dan Brett, 386 Tyee Drive: Concerned as his 7 acres on Tyee
Road is omitted from commercial zoning. He and his wife bought in
1989 and thought they could open a small business. He said he
doubts anyone would build a house across from a large service
station (a potential bomb). Urged the Council to return this to
commercial.
Sid Wallace, 528 South Beach Road: He discussed growth rates
in Point Roberts, septic systems and border crossing issues. He
complained about the Planning Department.
Stephanie Ross, Point Roberts attorney: Submitted two letter
from Department of Community Development regarding the
archaeological site and burial area in Point Roberts. This is the
heritage of the state; there are laws in place to protect burial
sites, she stated.
Hank Peltier, Point Roberts: Complained that the Planning
Department stated there were problems with sewage disposal; said
there was not contamination with properly installed septic systems.
Amos Heacock, 1534 Gulf Road: Complained that he was not
informed as he was in Alaska that his property was not zoned
commercial; he got back too late to appeal. Thanked the Council
for coming to Point Roberts.
Written submissions were accepted at the hearing from Susan
Jones, Martin Keeley, Frederic Culbert, Gillian Anderson and Don
Esterbrook and are on file in AB90 -73.
