October 9, 1990
The meeting was called to order at 6:40 p.m. by Chairman Don Hansey.

1. Briefing by Chief Civil Deputy Prosecutor regarding the Olivine Corporation's appeal
of a Hearing Examiner's decision
IMHOF MOVED TO HAVE THIS MEETING IN OPEN SESSION.
Motion carried unanimously.
Randy Watts, Chief Civil Deputy Prosecutor briefed the council on the legal aspects
of this appeal.
There was discussion between Jackson and Watts regarding the fact that the Solid
Waste Comprehensive Plan was not in place when this conditional use permit was applied
for.
Watts recommended the Council uphold the Hearing Examiner's decision and suggest
to the applicant to submit a new application.
Vander Yacht asked the difference between the law and fact. Watts stated the
County Council can substitute its judgment on law but not on fact.
Warner asked if the determination of the Hearing Examiner is a question of law or
fact. Watts said it is a question of law.
The meeting was adjourned at 7 p.m.
