Minutes of meeting
September 4, 1980
The meeting was called to order at 7:35 p.m. All members were present
for roll with the exception of Johnson.
The minutes of the previous meeting were approved as presented.
SPECIAL ORDER OF BUSINESS
Roehl introduced and moved for passage an ordinance of the Council
of Whatcom County, Washington, amending Ordinance No. 80 -59 providing for
the issuance and sale of bonds of Road Improvement- Bistrict No. 4 in the
principal sum of $76,031.43 and declaring an emergency. This ordinance
provides for semi - annual interest payments to the purchaser of the bonds.
The ordinance passed on a unanimous vote.
Roehl introduced an ordinance of the Council of Whatcom County, Wash-
ington, amending Ordinance No. 80 -59 providing for the issuance and sale
of bonds of Road Improvement District No. 4 in the principal sum of $76,031:43.,
It will have final consideration at the September 18 meeting.
There were two bids for the R.I.D. No. 4 bonds - one by Wilton and
Martha Jefferson at an interest rate of 8% and one by Edgar W. Schliep
at 7.957o. The Tresurer recommended Mr. Schliep's bid. Hansey moved to
accept the bid of Edgar Schliep at 7.95% annual interest rate. Motion
carried.
HEARINGS
Hearings were held on the five items in this section, with no test-
imony given by the public on any of the matters.
McIntyre moved for passage, an ordinance regarding the matter of re-
moving stop signs from: (1) Blaine Road, (2) So. Church Road, and (3)
Sunrise Road. Public Safety had recommended "do pass ", and the ordinance
was enacted by a unanimous vote.
Public Safety held in committee the ordinance restricting the speed
Limit on the Enterprise Road, in accordance with the Engineer's.recom -
inendat ion .

McIntyre moved the passage of an ordinance in the matter of placing
a stop sign on Morrison Avenue, which had a recommendation from Public
Safety of "do pass." The ordinance passed on a unanimous vote of Council.
The resolution regarding a change of road name from Douglas Avenue
to Hoff Road had a recommendation from Public Safety of "do pass." McIntyre's
motion for passage carried.
Finance recommended "do pass" on the ordinance authorizing the adoption
of a budget for the County Road Improvement District No. 4 Fund for 1980..
Roehl's motion to enact this ordinance passed by a unanimous vote.
OPEN SESSION
Elmer Smith, representing the Federation of the Blind in Whatcom
County addressed the Council asking for Council sponsorship of the Fed-
eration's proposal for Referendum 37 money. He had read into the record
a letter from the State Blind Commission in favor of the Federation of
the Blind's proposal.
OTHER BUSINESS
The motion, as deferred from August 21, concerning liquor license
transfer to the Birch Bay Marina, was moved by Roehl for denial of the
transfer. Motion passed (the County will recommend denial of the transfer).
Communication from Fire District 8 requesting the continuance of
the Fire Marshal Services with the Bellingham Fire Department was received.
The letter also suggested a three year contract be considered.
FINAL CONSIDERATION OF ORDINANCES AND RESOLUTIONS
Donnellan moved passage of an ordinance in the matter of a franchise
for the City of Sumas, to install, operate and maintain water distribution
lines along a certain road in Whatcom County, Washington. He moved to amend
by substituting a new section 20, as follows: "This franchise is subject
to the power of eminent domain, and Whatcom County reserves for itself the
right at any time upon thirty (30) days' written notice to the grantee
or for the people acting for themselves through initiative or referendum
`o so change, amend, modify, repeal or amplify any of the provisions or
conditions herein enumerated in the interest of the public, and this fran-
chise may be terminated at any time if the grantee's lines and facilities
are not operated or maintained in accordance with such state statute, order

or regulation." The amendment and the amended ordinance passed by unanimous
vote.
Hansey moved for -the passage of an ordinance authorizing a supplemental
budget for the Juvenile Court Probation Department within the Current
Expense Fund for 1980. Finance recommended "do pass as amended ", and
Hansey moved an amendment of adding an additional line item of $448.00 -
Rentals. Muenscher noted that there was already a category for that amount
with the Rental title, but a different line item number, and wondered if
the recommended amendment were in error. After considering his point,
Roehl moved to return this ordinance to Finance to clarify the matter.
Motion carried.
EXECUTIVE ITEMS
The budget transfers were removed from the agenda.
There were two board appointments. Hansey moved to confirm the
appointment of Dr. Del Walker to the Parks Board to serve until June 30,
1983. Motion passed.
Roehl moved to confirm the appointment of Kathleen Bolster to the
Alcoholism Board, to serve until December 31, 1982. Motion carried.
INTRODUCTION OF ORDINANCES AND RESOLUTIONS
Hansey moved to add a Resolution regarding the location of the Road
District Shop to the agenda. Motion carried.
Hansey introduced the six following ordinances and referred them to
Finance:

McIntyre introduced an ordinance regarding the matter of placing stop
signs in the Plat of Brownsville, and referred it to Public Safety.
Resolution regarding Whatcom County sponsorship of projects to use
State Referendum 37 funds were introduced and adopted as follows:
(1) proposed by National Federation of the Blind of Whatcom County
to purchase equipment, introduced by Hansey
(2) proposed by Whatcom Association of Training Centers to remodel
a building in Lynden, introduced by Roehl
(3) proposed by Whatcom Association of Training Centers to remodel
a building in Bellingham,. introduced by Roehl
(4) proposed by Sun Community Services to acquire and remodel a
facility, introduced by Muenscher
(5) proposed by the Workshop to construct a building, introduced by
Donnellan
It was noted that these resolutions are only preliminary sponsorship
indicating no priority order, nor asking for a set dollar amount. The
final amount will be established after the State reviews the proposals.
On a motion by Hansey, the Resolution regarding Whatcom County spon-
-orship of a project proposed by Catholic Community Services to use State
Referendum 37 funds to construct a building was tabled. This action was
taken in response to a letter from Earl Dangelmeir, the Executive Director,
to the County Council requesting the resolution be tabled at this time.
REPORT OF COMMITTEES
The Chair congratulated Councilman Muenscher on his appointment to
the NACo Land Use and Growth Management Policy Steering Committee.
Finance reported on the 7:OO.p.m. Tuesday, September 2 meeting con-
cerning the Executive Session on the Personnel Department reclassification
study.
Planning Committee will meet September 11.
Roehl moved to change the meeting schedule in October to the second
and fourth Thursday, October 9 and 23. Motion carried.
