WHATCOM COUNTY COUNCIL
Minutes
September 18, 1980
The meeting was called to order at 7:30 p.m. with Van Zanten, Roehl,
Donnellan and McIntyre present for roll. Motion was made to excuse Council-
man Johnson who was attending an unscheduled State Jail Commission meeting.
Motion carried. Hansey and Muenscher arrived shortly after roll was taken.
The minutes of the previous meeting were approved with the addition
of a paragraph concerning tabling one of the Referendum 37 resolutions
which had been omitted in the final draft of the minutes.
HEARINGS
The order of the hearings was changed, holding the hearing on the
Lummi Island ferry dock last, following the road vacation hearings.
Hearing was opened on the vacation of alley between Valencia and Wo-
jurn at Byron Street by John and Beverly Martin. Joseph Dunne, attorney
for the petitioners, testified giving a background of the case. Mrs.
Burton spoke as an adjoining land owner opposed to the vacation. Various
aspects of the road vacation were discussed. Hearing was closed. The
Planning Committee will further look into this at their September 25 meeting.
Councilman McIntyre urged the Planning Committee to consider the problem
of legally platted lots that are not useable for building under current
regulations.
Hearing was held on the vacation of a portion of Bay Street by G.
A. Carter. No testimony was given and the hearing was closed. Roehl moved
to accept Mr. Carter's request to withdraw his original petition for vacation
of Bay Streetlwhich had been granted. Motion passed. Planning Committee
recommended the granting of;the yacation per Mr: Carter's second petition
with the Fair Market Value of the land established at.the engineer's rec-
ommendation of $6975 less $165 (the amount of the petition fee G. A. Carter
had had to pay twice). Roehl's motion to so grant the petition carried.
No testimony was given at the hearing on the ordinance amending Ordin-
ance No. 80 -26 regarding a change in the weight restrictions on the Old
Lummi Island Ferry Slip #503. Hearing was closed. Donnellan moved for
passage_. Public Works Committee had reviewed the change several weeks

ago, and recommended "do pass." The ordinance was enacted by unanimous vote.
EXECUTIVE ITEMS
Louws presented two budget transfers. Both were approved in motions
by Hansey. Finance had reviewed them and recommended approval. The first
was a transfer of $61,721.00 in the County Road Fund and the second was
transferring $47,004.00 in various categories in the Nor -Bell Nursing
Home Fund.
The Executive stated he would have the preliminary budget for 1981
to the Council on the October 9 meeting.
FINAL CONSIDERATION OF ORDINANCES AND RESOLUTIONS
Finance Committee recommended '.'do pass as amended" on the ordinance
authorizing a supplemental budget for the Juvenile Court /Probation Depart-
ment within the Current Expense Fund for 1980, which was introduced on
8/21. Hansey moved passage, and moved to amend by-inserting on line 23,
line item 527 -30 -30 Rentals in the amount of $448.00, changing the total;
to $10,914.00. Motion to amend carried, and the ordinance passed by a 5 -1
(McIntyre) vote.
Hansey moved passage of the ordinance of the Council of Whatcom
County, Washington, amending Ordinance No. 80 -59 providing for the issuance
and sale of bonds of Road Improvement District No. 4 in the principal sum`
of $76,031.43. A similar ordinance, an emergency ordinance, had been passed
at the last Council meeting. This would take over after the emergency
ordinance expires. The ordinance was ordered by unanimous vote,
Roehl moved the passage of an ordinance authorizing the transfer of
funds from the Point Roberts Flood Control Zone District Construction fund
to the Point Roberts Flood Control Zone District Bond Redemption fund.
The Construction has been completed and the fund can be closed. Finance
recommended "do pass." Motion passed by unanimous vote.
Finance recommended "do pass" on•the ordinance authorizing a sup-
plemental budget for the Juvenile Court Probation Budget in the Current
Expense Fund (introduced on 9/4). Hansey's motion for passage carried
unanimously.
Finance recommended "do pass as amended "the ordinance authorizing
a supplemental budget for the Sheriff's Department 1980 budget. Hansey

moved the passage-of the ordinance, and moved to amend by adding to line

item 521- 21- 11 -18, Deputy Investgator the amount of $9,000.00 and change
the total to $10,412.53. This item had been entered incorrectly when the
1980 budget ordinance was typed. Hansey also moved to amend by adding
the language: "WHEREAS, a clerical error in the printed 1980 budget shows
a salary level to be $9,000.00 less than it was and is approved by Council."
Both amendments passed, and the Ordinance, as amended, passed by unanimous
vote.
Hansey moved to enact the ordinance authorizing a supplemental budget
for the Jail's 1980 budget. Finance recommended "do pass." Motion passed
unanimously.
Ordinance regarding a supplemental budget request for Nor -Bell Nursing
Home had a recommendation from Finance of "do pass." Hansey's motion
for passage carried on a unanimous vote.
OPEN SESSION
No one from the audience testified.
OTHER BUSINESS
No action was necessary on the Fire Marshal contract for 1980, as
the Council had already considered the contract during -the 1980 budget
proceedings. The amount of the contract is as provided for in the 1980
budget adopted by the Council in November, 1979.
Finance Committee had looked at the Nor -Bell contract change as sub-
mitted by the Personnel Department. There were two changes suggested to
the contract - one, due to DSHS ruling, would allow for only a 7% raise
for the entire year of.1980, rather than -an additional 327o July 1 raise
that was provided in the original contract. The other change was in the
term of the contract, making it good only through December 31, 1980, rather
� than to July 1, 1981. Council voted to approve the changes, as per Hansey's
motion.
Roehl moved to approve the custodial agreement for the Van Zandt
Community Hall. Finance had reviewed it and recommended to approve it.
Motion carried.
Communications were received as follows:
1) from the Whatcom County Library regarding the proposed annexa-
tion into the Rural Library District of the City of Ferndale;

2) petition regarding the Interim Zoning Map in the Home Road area,
received and forwarded to the Planning Commission for initial
action.
3) from Sheriff Mount concerning the Keg Ordinance; received and
sent to Public Safety.
INTRODUCTION OF ORDINANCES AND RESOLUTIONS
Roehl moved to add to the agenda an ordinance amending the garbage
fees and a resolution regarding Water District 17 to be the first two items
under this section. Motion passed.
Roehl introduced an ordinance amending Whatcom County Code 3.08.025
regarding the garbage disposal fees. Amendment shall only affect the Maple
Falls Landfill Site and Glacier Compactor Site. It was sent to Public Works
Committee.
Roehl introduced and moved the passage of a resolution in the matter
of submitting to the voters a proposal to create Whatcom County Water Dist-
rict No. 17, with the Council finding this to be for the public's conven-
ience. Pete Visser, attorney, spoke on its hehalf. Motion carried.
Hansey introduced and moved the passage of an emergency ordinance to'
authorize a supplemental budget to the Soldiers' Relief Fund for the year
1980. Finance had reviewed it and recommended "do pass." More relief has
been provided from this account than in previous years, and it would be
without funds by the end of September. Motion passed unanimously.
Hansey introduced the next five ordinances and they were referred
to Finance for consideration:
1) Ordinance authorizing a.supplemental budget for the Assigned
Counsel budget for 1980
2) Ordinance authorizing a supplemental budget for the Equipment
Rental and Revolving Fund for 1980
3) Ordinance authorizing the adoption of a supplemental budget for
the Ferry Maintenance Fund for 1980
4) Ordinance authorizing a supplemental budget for the River Im-
provement Fund for 1980,
5) Ordinance authorizing a supplement to the 1980 Medical Examiner
Budget
Item #7 on the printed agenda was withdrawn having been incorporated
into the earlier supplemental budget for the Sheriff's Department handled
under Final Consideration.

Muenscherintroduced an ordinance authorizing a supplemental budget
for the Solid Waste Fund for 1980. It was referred to Finance and Public
Works
Hansey introduced an ordinance authorizing a supplemental budget for
the Soldiers Relief fund for the year 1980. I.t was sent to Finance. Council
requested that representatives of.the Veterans be present at the next
Council. meeting to explain. the increase in their expenditures.
Roehl introduced and moved for passage, a resolution in the matter
of submitting to the voters a proposal to annex the City of Ferndale into
the Whatcom County Library District. Motion carried.
COMMITTEE REPORTS
Planning reported on the reasons for the delay in the CBI application
as presented by Mike Nicholson at Planning's September 11 meeting, and
asked for response from Council members on direction for the County to take
on the possibility of the County going into the water and sewer business
in the urban fringe areas of the county. This will be further discussed
at their September 25 meeting.
