HomeMy WebLinkAboutCounty Council for October 23 1980`YHATCOM COUNTY COUNCIL Minutes October 23, 1980 The meeting was called to order at 7:35. All members were present. The minutes of the previous meeting were approved with a corrected page three. EXECUTIVE ITEMS Hansey presented the Executive item, a transfer in the Public Works Fund of $11,937.59. Finance recommended approval of the transfer, and Hansey's motion to authorize it passed. FINAL CONSIDERATION OF ORDINANCES AND RESOLUTIONS Hansey moved for adoption, an ordinance amending ordinance 80 -60 providing for the creation and maintenance of a Road Improvement Guar- anty Fund, authorizing tax levies to maintain such fund, and providing for payment into and drawing warrants against such fund to conform with R.C.W. 36.88.220, and to delete reference to the Tax Levy. Finance rec- ommended "do pass" and the motion carried by a unanimous vote. Hansey moved for passage of a resolution regarding settlement of Tort Claims. He moved to amend by striking "of Finance Committee" on line 26. Motion to amend carried. There was discussion centering on the amount of power the resolution would give the chair. Johnson moved to table the resolution to the next meeting. Motion carried. OPEN SESSION No one addressed the Council from the audience. Councilman Hansey addressed the public concerning the Open Session, and the lack of citi- zen participation during that portion of Council meetings. OTHER BUSINESS Susan Miller, Director of Cooperative Education at Whatcom Commun- ity College, addressed the Council on the Community College and Western's programs for student internship in county departments. There was con- sensus among Council to support such a program. The Chair was directed to work with the Executive in forming a written endorsement of the It minutes of Council meeting October 23, 1980 page two concept of this program, and present it to the Council at the November 6 meeting for approval. Bill Trimm presented the Long Range Plan update. The Cherry Point/ Ferndale sub area plan is complete,and in the hands of the Planning Com- mission for review and approval. The staff is working on the Lake Whatcom sub area now. It is about 80% complete.. The Zoning Ordinance, title 20 in the Whatcom County Code was presented. Public Hearing will be held by. the Planning Commission on November The new subdivision regulations were presented to Council, as completed by Kramer, Chin & Mayo, consulting engineers. Hearing will be held on November 18 by the Planning Commission on the new re�g iat�ns . The �processss for solid waste disposalAwas outlined to the.Council in a memo from the Director of Public Works. A solid waste plan should be pre- sented to Council for adoption in the near future. Hansey moved to approve the amendment to the Crop -Land Lease with Rhe Farms, Inc. The original lease was dated May 27, 1976. The amendment woii�d reduce the amount of the lease for one year to give compensation for land taken for the central road district facility. Finance recommended "do pass" on the amendment. Motion carried. Roehl moved to change the second meeting of vember to November 24, the change necessary due to the November 19-21 W4�CfTconvention. Motion passed. Applications for Open Space from Raymond & Patricia Loughlin, and Norman & Zorka McDonald were received and will be forwarded to the Planning Commission for initial action. An appeal to the Council on a Hearing Examiner decision by Bill Clement was received. The procedures for the appeal were outlined. The Council will review the appeal on the record when all the written documentation is received. INTRODUCTION OF ORDINANCES AND RESOLUTIONS Donnellan moved to add four ordinances and two resolutions to the agenda following the printed items. Motion carried. Johnson introduced the ordinance relating to the control of dogs and other animals, providing for the establishment of dog control zones and repealing all other ordinances in conflict therewith. It will have no minutes of Council meeting October 23, 1980 oage three committee consideration, as Public Safety proposed the ordinances, and will have public hearing on December 4. Hansey introduced an ordinance levying tax on bingo, raffles, social card games, punch boards & pull tabs; exempting charitable and non - profit organizations; designating revenue for Law Enforcement; authorizing collec- tion by State Gambling Commission; and repealing ordinances and resolutions in conflict herewith. It was referred to Finance, and will have public hearing on November 10 at 8:00 p.m. Donnellan introduced an ordinance regarding the reduction of speed limits for the school zone on West Smith Road just west of Northwest Drive, and referred it to Public Safety. Public Hearing will be set for December 4. Johnson introduced an ordinance regarding the matter of placing stop signs in the Plat of Woodhaven. It was sent to Public Safety. It will also have public hearing December 4. Hansey introduced a. resolution adopting Personnel Recommendations of T)onworth, Taylor and Company, and moved for its passage. McIntyre objected to its placing hourly road workers on a salary rate. Motion carried on a majority vote. Roehl introduced a resolution regarding the matter of adoption of Whatcom County's 1981 Annual Construction Program. Public Works will reivew the resolution. It will have Public Hearing November 6. Hansey introduced and moved for passage an emergency ordinance estab- lishing a reasonable fee for copies of the budget, supporting tables, and budget message as provided for in the Whatcom County Home Rule Charter, Article 6 Section 6.50. Finance had proposed the ordinance, and recommended "do pass ". The ordinance was enacted on a unanimous vote. Hansey introduced the next four items, and they were referred to Finance: (1) Ordinance authorizing a supplemental budget for the Election Re- serve Fund, 1980 (2) Ordinance authorizing a supplemental budget for the Emergency Services Fund in 1980 (3) Ordinance authorizing a supplemental budget for the Northwest Washington Fair Fund, 1980 (4) Resolution in the matter of establishing Whatcom County Ferry Rates. Public hearing for this resolution was set for November 10 at 7:00 p.m. Roehl introduced and moved for passage a resolution in the matter of endorsing General Revenue Sharing. He moved to amend by striking "lame duck" minutes of Council meeting October 23, 1980 page four from line 6. Motion to amend passed, and the resolution passed by majority vote. REPORT OF COMMITTEES Donnellan stated he would provide a copy of the Ferndale gambling ordinance to support the idea that a minimum fee should be charged to non- profit organizations sponsoring gambling. The chair mentioned the public hearing on October 27 regarding the proposed 1981 budget. Meeting adjourned at 9:25.
