Muenscher who arrived immediately after roll was taken. The minutes of the previous meeting were approved as presented. HEARINGS Hearing was held on the ordinance regarding the matter of placing stop signs on Agate Heights Road and Black Mountain Road. No testimony was given., and the hearing was closed. Public Safety recommended "do pass ". Johnson moved for passage of the ordinance, and his motion carried. unanimously. No testimony was given at the hearing concerning the ordinance regarding; the matter of placing a stop sign in the Plat of Mal lards Land .i.ng. [Iear -ino was closed. Johnson reported that Public: Safety had reviewed t:he ordinance and reecommended "do pass," and he so moved. His 1.10t: ion carried by i- inanimo<< "ote. . The ordinance restricting the speed limit on the Hoff Road and Dou-(;la,,, Avenue had public hearing, at which no testimony was g:i.ven. The hear.in wa> closed. Public Safety recommended "do pass ". No testimony was given, and. the hearing was closed. Finance had reviewed the one bid submitted by Alan and Kathleen Brost in the amount of $250.00 per month plus utilities. Hansey moved to accept the bid. Motion passed. 1:XECUTIVE ITEMS The first item was a budget transfer in the CE'TA II budget. in the amount of $7337. Finance had reviewed and recommended approval, and Hansey's motion to approve the transfer passed. Louws presented a bid for authorization by Council. for two tractors for t:he Public 1,'orks Department. The bid was submitted by harmers' Equipment m r'opany in the amount of 439,507.12 total after trade -i.ns and tax. fi Tian ce ecommended approval, and IIansoy's motion to approve carried. a Minutes of Council meeting May 8, 1980 ` page two The Fiscal Status report as of April 30, 1980 as required by the Home Rule Charter was presented to Council, by the Executive. OTHER BUSINESS The vacation of the dead -end portion of East Pole Road petitioned for by Lorenzo Perez et al, was returned to the Council by the Planning Committee. The petitioner had asked to withdraw his petition previously, after the pub- lic hearing had been held, but now withdrew that request and asked for con- sideration of that vacation. Planning Committee had reviewed it at their last meeting, and recommended approval with three conditions: (1) that ease- ments to adjoining property owners be given, (2) that utility easements be given, and. (3) that the Fair Market Value of the property be paid. itoehl moved that the Fair Market. Value be established at $1356.00, rather than the $2712 that the Engineer had recommended., a.nd that the vacation be gran.tred with the three conditions. His motion carried., and the vacation was unan- imously ordered with the three conditions. The Nor -Bell. sewer decision was not taken up as the report from Harpe Owes, the consulting :firm in the matter, and the .recommendations from the Public Works Department had not been received. Don.nellan moved to send the matter to the Public Works Committee in conjunction with the Planning Com-- mittee, and have Paul Rushing present at that meeting to close out the con- tract with Harper -Owes, and solve the problems to the satisfact-ion of the Department of Ecology. His motion carried. Finance had reviewed the only bid submitted for the Official County printing from the period of July 1, 1980 through June 30, 1981, and recom- mended that the contract be awarded to the Bellingham Herald with twelve copies of the paper furnished. Hansey's motion to so award the contract passed unanimously. Four Open Space applications had been reviewed by the Planning Committee, i.,ith recommendations from the Planning Commission. The Commission had rec- ommended approval of one by Ray Young and one by Margot Evers, anal. had rec- ommended denial of another by Margot Evers and one by Paulus Vander lt'ielen. Roehl moved to return the Vander Wle_len application to the Planning Commission., for further review with added information from the Planning staff, and thc_ motion carried. Ray Young's application was granted per Roehl's motion, sub - iect to the conditions set forth by the Planning Commission. Mike Nicholson, Planning Director, answered questions on the Open Space. procedures. The request for modification to ?Major Development Permit MOP 1-76 by Myles Donnelly was received and sent to Planning. The application for preliminary plat approval to replat a portion of Tweed Twenty Division S and Tweed Twenty Division 6 to be known as Tweed Twenty Division 7 was received and sent to Planning. Communications were received from the Delta Grange opposing the lifting of the Rural Library Levy lid and Tire Protection District 15 concerning road conditions at Gooseberry Point. FINAL CONSIDERATION OF ORDINANCES AND RESOLUTIONS r The ordinance authorizing the imposition of weight restrictions on bridges within What:com County pursuant to R.C.W. 46.44.080 had "do pass" rec- ommendati.dn from Public Works. Public Hearing had been held on .April 17. Donnellan moved for its adoption, and his motion passed. llansey moved to pass the ordinance providing supplemental budget to the Alcoholism Fund for 1980. Finance recommended "do pass" and the ordinanc:_ was enacted by unanimous vote. INTRODUCTION OF ORDINANCES AND REiSOLUTIONS Hansey introduced the next ten ordinances and Yeferred them to Finance as follows: 1. Ordinance authorizing the i.ncreasc in the Advance Travel lxpense /Revolvi Fund 2. Ordinance authorizing a supplemental budget for the Blue Canyon Constru,: tion Fund for 1980 3. Ordinance authorizing the adoption of a supplemental budget for the Ferry Maintenance Fund for 1980 4. Ordinance authorizing the adoption of a revised budget for the County Road fund for 1980 S. Ordinance authorizing a supplemental budget for the County Grants Man - agement 1980 budget 6. Ordinance authorizing a supplemental budget for the Prosecuting Attorney' 1980 budget. Ordinance authorizing a supplemental budget for the County Jail 1980 budget 8. Ordinance providing for a supplemental budget for the Whatcom County Sheriff's Department 1980 budget 9. Ordinance authorizi -ng, a supplemental budget for the Whatcom County Treasurer's 1980 budget 10. Ordinance establishing the refund for permit. fees: Adding now sections to W.C.C. 2.24.740 Johnson introduced the ordinance regarding the matter of placing a stop sign on Melcher Avenue and the ordinance retarding the matter o(' placing stop signs on Ash Avenue, and they were sent. to Public Safety for review. Hansey introduced the resolution in the matter of approving a bid re- ceived for work to be dome on the Gooseberry Point: Ferry Landing., and it was sent to Finance. Donnellan introduced the resolution in the matter of declaring the "Lynden Township Hall," as surplus property and setting a Public hearing date for it, and it. was approved by a unanimous vote. Hansen introduced. the resolution in the matter of cancellation of war- rants over one year old, and it passed by a unan.i.mous vote.~ COMMITTEE REPORTS Roehl reminded the Council of the Planning Commission, Plan.n.ing Depar,.- ment and Planning Conlivi.t.tee Meeting scat. for May 1S «t 7:00. A hearing is scheduled for 'Tuesday, May 1.3, 7:00 p.m. at t'ne Gtenhaven Community Clubhouse on the South Bay area rezon.e. An Executive Session with representatives of the Park Department re- garding the sale of Portage Island will be on Wednesday i41ay 21. There is a meeting on May 20 at 1:30 at the Port Administration Office to discuss the Cherry Point shipping terminal facility. Donnellan complimented the Planning Department on the well.planned and executed Planning Conference held in April in Bellingham. The meeting adjourned at 9,00.
