HomeMy WebLinkAboutCounty Council for December 4 1980WHATCOM COUNTY COUNCIL Minutes December 4, 1980 The meeting was called to order at 7:37 with all members present for roll with the exception of Muenscher. Motion was made and passed to excuse him, as he had come in, but had to leave due to the weather conditions. HEARINGS Hearing was opened on the ordinance relating to dog and animal control and providing for the establishment of dog control zones. Tim Lucy,of and on behalf of, the Humane Society testified in' favor of the ordinance, as did:.J. P. Daim of the Sudden Valley Community Association. The hearing was continued to the December 18 meeting. Hearing was opened on the vacation of Morgan Street. Harlan Jackson of the Bellingham School District testified in favor of the vacation, citing he environmental..checklist and a previous deeding of land to Whatcom County by the School District as evidence. He requested the vacation be granted without requiring compensation. He also stated the run -off problem was being addressed in the plans. Puget Power had sent a letter requesting reser- vation of their easement. Jackson said this would be no problem. Dale MCA.tee, a resident in the Geneva area testified in favor of the vacation. The hearing was continued to December 18, and the matter was referred back to Planning for further review. Hearings were held on the next five items, with no testimony being given. Hansey moved the passage of an ordinance in the matter of the adoption of a budget regarding CETA funds. Finance,recommended. "do,pass ". The mo- tion carried by a unanimous vote. Johnson reported the-Public Safety Committee'xecommended "do pass" on the ordinance regarding the reduction of speed limits for the school zone on Pest Smith Road just west of Northwest Drive, and moved for passage. His mothn passed by a unanimous vote. Public Safety recommended "do pass" to the ordinance regarding the mat - .,er of placing stop signs in the Plat:of Woodhaven. Johnson moved to pass the Ordinance, and the motion carried on a unanimous vote. Johnson moved the passage of an ordinance restricting the speed limit Minutes of Council meeting December 4, 1980 page 2 on Nest Laurel Road, which had a recommendation from Public Safety of "do pass '. Motion passed by unanimous vote. Hansey moved to declare the county -owned property (unused computer equipment) surplus, and to authorize the Executive to proceed with the sale. Motion passed by a majority vote. EXECUTItiE ITEMS Executive Louws presented an over -limit transfer for Council approval in the amount of $304,000 in the Road Fund. Hansey moved to approve., with a recommendation from Finance to that effect. Motion carried. Louws presented a bid for Council confirmation - Wilder Construction, Inc. bid in the amount of $255,862.71 for the reconstruction of Britton Road. Finance and Public Works recommended approval. Motion by Hansey to authorize the bid passed by a majority vote. Roehl abstained on the grounds of having a professional. conflict. Hansey.brought up the fact that a portion of the bid ($5392) is an agreement with Water District 7, and is 100% reimbursable from the District. Also .presented for Council approval was a bid for quarry rock for dik,_.g (to be picked up',at the base'.of thb h -ill) . ' . The low bidder was Columbia Cement with a bid of $2.75 per ton for the 1981 year. Hansey moved to authorize the bid. Finance and Public Works recommended approval. Motion carried. OPEN SESSION No one from the audience testified. Hansey asked that Bob Hinton's name be placed on the 12/18 agenda in this section, as Hinton had been un- able to attend this meeting and speak during this section.. FINAL CONSIDERATION OF ORDINANCES AND RESOLUTIONS Roehl moved to defer consideration of the Ordinance implementing a vehicle and traffic code to the 12/18 meeting. Motion carried. Hansey moved to substitute an ordinance in the matter of a revised budget for the Developmental Disabilities Fund for 1980 submitted by the Finance Committee. Motion carried. He moved passage of the substitute ordinance. Motion carried unanimously, with Johnson absent for the vote. Minutes of Council meeting December 4, 1980 page 3 _Finance had reviewed the following six ordinances,and recommended "do pass" on all. Hansey moved each for passage, with.voting as .follows: 1) authorizing a supplemental budget for the County Supply Fund, 1980; passed by unanimous vote 2) authorizing ,a supplemental budget for the Board of Equalization Budget; passed by unanimous vote 3) authorizing a supplemental budget for the District Court 1980 budget; defeated by 2 -4 (Roeh & Van Zanten voting for) vote. Request made by Hansey to reconsider on 12/18. Johnson made point that the State should be responsible to pay its mandated increases, rather than counties be liable for them. 4) authorizing a supplemental budget for the Township Hall budget; passed unanimously. 5) authorizing a supplemental budget for the Mental Health Fund, 1980; defeated by 3 -3 vote (Van Zanten, Hansey, Johnson voting for) vote. Roehl requested to reconsider on 12/18. 6) authorizing a supplemental budget for the Whatcom County Jail budgel passed by 4 -2 vote (McIntyre, Hawley) vote The resolution regarding settlement of Tort Claims was taken from the table, with the amendment on the floor of striking "Chairman of Council" and inserting "the County Council" on line 25. The amendment was defeated. Hawley moved to amend by placing a period after "Executive" on line 25, and striking line 26 entirely. This would leave the Executive responsibe for handling claims over $5,000 in conjunction with the Prosecuting Attorney's office. Motion passed. The amended resolution passed by unanimous vote._ Public Safety had re- reviewed the resolution regarding a change of road name from A.P.A. Road to Fernwood Road in Point.Roberts, taking into consideration the second petition received opposing the name change. The Committee recommended "do not pass." Johnson's motion,for' passage was de- feated by unanimous vote. OTHER BUSINESS The appeals of Hearing Examiner decisions on the C.U. 31 -77 (Rite -Way Construction; Planning Department / apellant), S.V. 6 -80 (Roger Ufkes; Build- ings & Code / apellant), and S.V. 7 -80 (Mr. & Mrs. Reasoner; Buildings & Code/ apellant) were received. The appeal procedure was outlined. Johnson moved to change the January meeting schedule to the second and fourth Thursdays, January 8 and 22. Motion carried. Nomination's for the two upcoming Planning Commission vacancies were opened. A letter from Harry Skinner expressing interest in being nominated was received. Johnson nominated Peggy Hinton and Louise Greer for reappoint- s i Minutes of Council meeting December 4, page 4 ment to the Commission. McIntyre nominated Harry Skinner. The nominations will remain open through the December 18 meeting. INTRODUCTION OF ORDINANCES AND RESOLUTIONS An ordinance increasing the Larry E. Mount revolving fund was added to the agenda on Roehl's motion. The Ordinance adopting the Whatcom County Code as published by Book Publishing Company was introduced by Roehl. It was not sent to a committee for review. Ordinance were introduced and referred to Finance as follows: 1) authorizing a supplemental budget for the Boundary Review Board 1980 budget; Hansey introduced 2) authorizing a supplemental budget and transfer withing said budget for the Bureau of Buildings & Code Administration, Current Expense Fund for 1980; Roehl introduced 3) authorizing a supplemental budget for the County Clerk's 1980 budget; Hansey introduced 4) authorizing a supplemental budget for the Non- Departmental budget, ambulance section, 1980; Roehl introduced 5) establishing the Whatcom County Senior Services Department and removing responsibility for providing services to Senior Citizeiā€ž from the Whatcom County Park Board; Hansey introduced 6) authorizing a supplemental budget for the State Examiner's 1980 budget; Roehl introduced 7) authorizing a supplemental budget for the Superior Court 1980 bud - get; Hansey introduced 8) authorizing a supplemental budget for the Treasurer's 1980 budget; Hansey introduced 9) authorizing a supplemental and transfer for the Building Maintenance budget for the year 1980; Roehl introduced Roehl introduced tyre resolution in the matter of the formation of Whatcom County Water District #E17 and it was referred.to Planning. Hansey introduced the resolution in the matter of transfers affecting the 1980 budget. It was referred to Finance. An ordinance increasing the amount of the Larry E. Mount revolving fund was introduced by f'Lansey and will go to Finance for review. COMMITTEE REPORTS Planning will meet 12/11 at 7:00 p.m. Hawley was appointed to fill Donnellan's positions on the Planning and Public Works committees by motion of Roehl. Meeting adjourned at 9:44 p.m.
