Minutes of meeting
August 21, 1980
The Council meeting of August 21, 1980 was called to order at 7:30 p.m.
All members were present for roll with the exceptions of Hansey and McIntyre
who arrived shortly after roll was taken.
The minutes of the previous meeting were approved as presented.
HEARING
Hearing was declared open on the ordinance in the matter of a franchise
for the City of Sumas, to install, operate and maintain water distribution
lines along a certain road in Wbatcom County, Washington. No testimony
was given. Hearing was closed. Donnellan moved to table the ordinance to
the next meeting due to incorrect wording in Section 22 in relation to the
requirements of the Charter, Section 9.30. Motion carried.
EXECUTIVE ITEMS
The Executive.presented five names for confirmation of appointment to
Boards as follows: Richard Jacobson and Pete Bulthuis to Developmental Dis-
abilities; and Clarence Edwards, Jon Wolfe and Robert Peach to Mental Health.
Johnson's motions to confirm these appointments carried.
Louws mentioned that an extension of the liquor license transfer appli-
cation of Birch Bay Marina & Grocery for 30 days had been granted, so Council
could make the decision in two weeks if they need more time to investigate
the application.
OTHER BUSINESS
Bill Trimm gave the long range plan update, mentioning that the final
Cherry Point Plan had been distributed to the Council. Public Hearing on
it is to be on 9/30/80 at 1:3.0 p.m. Planning staff is completing work on
the Zoning Ordinances to go with the Cherry Point Plan. He stated that the
Lake Whatcom Sub area is two weeks behind the projected time schedule, and
also noted that the draft on the subdivision regulations was received, will
be reviewed, and then returned to the consultant for final draft. When
;he Planning Department receives that, they will form an ad hoc committee
from the community, and requested a Council member to be on the committee.
That ad hoc committee will make final .recommendations.

Homey moved to approve the labor contract agreement between Whatcom
County Nor -Bell Nursing Home and Washington State Council of County and
City Employees. Finance Committee had reviewed the contract and recommended
"do pass." Hansey's motion passed. McIntyre object to a clause in the
contract, and recommended that the Committee of the Whole hold a meeting
establishing guidelines for labor contracts. The Chair said this item would
be added to the Monday night Committee of the Whole meeting's agenda.
Communications and Petitions were received as follows:
a) status of the Nor -Bell Sewer project. Received were memos, from
the Grants Office and from the Executive for information. Nat
Dickinson was present to answer questions from the Council.
b) WACO memo concerning dues for 1981 was received.
C) Boundary Review Board request for nominations to that Board from
the Special Purpose Districts received. As the nomination has
already been made and sent to the Governor for confirmation,
letters are to be sent to the B.R.B. informing of the status of
the appointment, and to the Governor requesting confirmation.
d) request to withdraw application for vacation of Bay Stret from
G. A. Carter was received and sent to Planning
e) petition for vacation of portion of Bay Street by G. A. Carter was
received and sent to Planning
f) request to alter Plat Lines in Bakervi.ew Addition by Albert Wei -
voda, received and sent to Planning
g) petition for vacation of alley between Valencia and Woburn at By-
ron Street by John and Beverly Martin, received and sent to Planning
The application for liquor license transfer to Birch Bay Marina and
Grocery continued from August 7 was moved by Roehl to postpone for 'two more
weeks. Motion carried.
OPEN SESSION
No one addressed the Council
FINAL CONSIDERATION OF ORDINANCES AND RESOLUTIONS
In the matter of the Ordinance to revise the 1980 budget, Hansey moved
to accept the substitute ordinance as proposed by the Finance Committee,
authorizing a revision in the 1980 Current Expense Fund. Motion carried.
He moved to amend in three separate motions adding one position for layoff
in Grants Management, two positions for layoff in the Building Maintenance
Fund, and two positions for layoff in the Parks Department. All three mc.,..
tions passed. The amended ordinance passed on a 4 to 3 vote, Roehl, Hansey,

Muenscher and Van 2anten for, Donnellan, Johnson and McIntyre voting against.
Hansey moved the passage of an ordinance amending Ordinance No. 79 -25
relating to the establishment of Public Official Bonds in amounts and forms
for all Elected County Officials and designated Employees, pursuant to Home
Rule Charter Section 9.50. Finance Committee recommended "do pass" and the
ordinance passed on unanimous vote of Council.
Hansey moved the passage of an ordinance authorizing a supplemental
budget for the Motor Pool Fund Budget of 1.980. Finance Committee recommended
"do pass ", and Hansey's motion passed by unanimous vote.
Finance recommended "do pass as amended" an ordinance of the Council
of Whatcom County, Washington, creating a Road Improvement District No. 4
in the principal sum of :76,031.43 and for the sale thereof. Hansey moved
passage, and moved to amend by changing the time of 7:00 p.m on page 6 and
in the attachment to the ordinance to 7:30 p.m. Motion to amend carried,
and the ordinance as amended passed by a unanimous vote.
Hansey moved the passage of an ordinance of the Council of Whatcom
County, Washington, providing for the creation and maintenance of a Road
Improvement Guaranty Fund, authorizing tax levies to maintain such fund;
and providing for payment into and drawing of warrants against such fund.
Finance recommended "do pass" and Hansey's motion carried unanimously.
INTRODtiCTION OF ORDINANCES-AND RESOLUTIONS
Roehl moved to add two resolutions to this section. Motion carried.
Hansey introduced the ordinance authorizing a supplemental budget for
the Juvenile Court Probaton Department within the Current Expense Fund for
1980. It was referred to Finance.
Roehl introduced and moved passage of an emergency ordinance decreasing
the allowable load limit on the Old Lummi Island Ferry Slip #503. It re-
ceived final passage by unanimous vote.
Roehl introduced an ordinance amending Ordinance No. 80 -26 regarding
a change in the weight restrictions on the Old Lu.mmi Island Ferry Slip #503.
It will have public hearing on September 18, but no committee consideration.
Hansey introduced and moved the passage of a resolution in the matter
-)f releasing contingency funds for WACO and WSAC, 1980 Current Expense Fund,
Non- Departmental Budget. Motion carried.

of a temporary loan from the Current Expense Fund to the Federal Shared
Revenue Fund. His motion carried.
COMMITTEE REPORTS
The Chair announced a Committee of the Whole meeting set for Monday,
August 25 at 7:00 p.m. Items on the agenda to include Referendum 37 pro-
posals, an executive session to discuss ontract guidelines and
discussion of the jail facility.
Council was informed by the Chair that Don Hansey is the Council rep-
resentative on the Jail Planning Committee set up by Executive Louws.
Roehl announced a Planning Committee meeting on 8/28 to discuss with
the Planning Department the final printed document on the Cherry Point /Fern-
dal.e Sub Area Comprehensive Plan.
Roehl brought up the memo from the Mayor of Bellingham concerning the
City's proposal to make the County responsible for administering Court pro-
ceedings and fi.nes that the City has been taking care of in the past. Roehl
urged the County Council to get involved in contacting City Council members
requesting that they hold off on any action in this regard until the new
,jail is built.
