HomeMy WebLinkAboutCounty Council for April 17 1980' r I WHATCOM COUNTY COUNCIL Minutes of meeting April 17, 1980 The meeting was called to order by Roehl,acting as temporary chair, at 7:34 p.m. with all present but -Van Zanten who is on vacation, and John- son who was called out of town to attend an unscheduled State Jail Commis- sion meeting. Muenscher nominated Hansey to serve as presiding officer for this meeting. His motion carried unanimously. The minutes of the previous meeting were approved as presented. HEARINGS Hearing was held on the resolution which Roehl reintroduced as an ordinance, authorizing the imposition of weight restrictions on bridges within Whatcom County pursuant to R.C.W. 46.44.080. No testimony was given, and the hearing was closed. Final consideration of"the ordinance vill be on May 8. The chair opened the floor for testimony on the resolution regarding authorizing and filing of the Whatcom County application for the H.U.D. Small Cities Block Grant Program. No testimony was given. Hearing was closed. Nat Dickinson, Grants Coordinator, gave a background of the application. Roehl introduced the resolution with Finance Committee's recommendation of "do pass" and the resolution was passed by a unanimous vote. EXECUTIVE ITEMS Louws presented to the Council the name of Jan Leonardo for confirm- ation as the Emergency Services Director. Roehl moved to confirm, and his motion carried. Donnellan stated he would like a procedure established on this type of confirmation. There were two liquor license applications, both confirmed by Roehl's motions. The first was a special occasion license for the'Northwest Concert Association and the second was a new application by Price Brothers for a class EF license. Two budget transfers were presented to Council for authorization. Finance Committee had reviewed them and. had recommended approval. One, in the CETA II budget, Employment Security to Assigned Counsel in the amount of $7,711 was approved by Roehl.'s motio The second in the Pub minutes of Council meeting z April 17, 1980 page two lic Works Budget, transfers of $192,000 and $224,000 in the Federal Aid - Secondary and Federal Aid - Bridges categories was also approved by Roehl's motion. A bid award was presented for confirmation. The bid was for a 24' x S2' mobile home for the Sheriff's Department in Point Roberts. The bid was submitted by Danny's Mobile Home Sales in the amount of $1.9,899.50. This money had been budgeted through F.S.R. Finance; had reviewed the bid and recommended approval. Roehl's motion to so authorize carried. OTHER BUSINESS Cal Mathews and Peggy Ball gave a history and present status report on the Mental Health /Drug Abuse Department. Bill Trimm, Assistant Planning Director, gave a progress report on the updating of the County Comprehensive Plan, where they are now in the process, and projected completion dates of evaluating various subareas. He made point that they hope to have the Zoning Ordinance and the updated Compre- hensive Plan ready for adoption at about the same time. Roehl mentioned that he had met with the Planning Commission, and that lie would like to set up a meeting with the Planning Department, Council Planning Committee, and the Planning Commission to discuss various matters. May 15 is the proposed date for that meeting. The petition for Water District 17 has been reviewed by the Planning Committee. Their recommendation, which was incorporated into motion by Roehl, was to approve the formation of the Water District subject to the Technical Committee and Boundary Review Board's recommendations. His motion carried. After B.R.B. review, this matter will come before Council again to authorize the submission of the proposition to the electors residing within the boundaries of the proposed water district for.approval of the district and levying of taxes. The Executive was authorized to sign the contract for the Humane Society subject to the State Examiner's approval of Section IV B on page 2. The agreement was approved unanimously with that condition as per Roehl's motion. The Planning Committee had reviewed the Planning Commission recom- mendation on the ordinance amending the Whatcom County Comprehensive Plan Map from Potential Suburban to Rural and to amend the Interim Zoning Map from General Protection to Rural one acre, Rural two acre and Forestry Zone p; minutes of Council meeting April 17, 1980 page three in the vicinity of the South Bay area of the Lake i^lhatcom subarea. Their recommendation was to hold further public hearing on May 13 at the Glenhaven Community Club at 7:00 p.m. Roehl's motion to hold such hearing passed unanimously. The entire Coiinci.l is urged to be present at that meeting. FINAL CONSIDERATION OF ORDINANCE Hansey spoke as the chairman of the Ad -Hoc Committee in presenting the ordinance amending ordinance 79 -31 concerning initiatives, Mini- initia- tives, Referenda and Recalls (the title was changed from "Referendums" to "Referenda "). Public Hearing was declared open by the Chair, and Fred Larson spoke asking for clarifiction. Hearing was closed. Roehl moved to pass the ordinance with the change in the title. Motion carried unan- imously. INTRODUCTION OF ORDINANCES AND RESOLUTIONS Three items were added to this section by motion. Roehl introduced an ordinance providing for a supplemental budget to the Alcoholism Fund for 1980 and referred it to Finance. Donnellan introduced the ordinance regarding the demolition of the Lynden Town Hall, which is Whatcom County Property and assigned it to Public Works for review. McIntyre introduced the ordinance regarding the matter of placing stop signs on certain County Roads and sent it to Public Safety. Roehl moved the passage of the resolution in the matter of adding an exempt employee position within the Department of Public Works to be entitled "Building Superintendent." Finance had reviewed it and had no problems with it. The resolution was passed by unanimous vote of Council. Roehl introduced the Water District 10 Comprehensive Plan amendments as follows: resolution approving Water District No. 10's amendment td,the.Compre- hensive--Plan of the District, Resolution No. 253 dated August 8, 1979 resolution approving Water District No. 10's Resolution No. 272 dated February 27, 1980 amendment of the Comprehensive Plan for the Water District resolution approving amendment to Water District No. 10's Comprehensive. Plan, Resolution No 273 dated February 27, 1980 resolution approving Water District No. 10's Resolution No. 276, .dated March 19, 1980 amendment to the Comprehensive Plan of Water District No. 10 Y minutes of Council meeting f April 17, 1980 page four All received final passage by unanimous vote. They had been reviewed by the Planning Committee which had recommended "do pass" subject to various conditions which were incorporated into the resolutions. The titles of the resolutions were changed to include the water district's resolution numbers. The ordinance regarding the matter of placing a stop sign in the plat of Mallards Landing was introduced by McIntyre and sent to Public Safety. McIntyre introduced the ordinance restricting the speed limit on Hoff Road and Douglas Avenue, and it was referred to Public Safety. No council member introduced the resolution regarding removing a District Court Employee from the Exempt Employees' list. It will be returned to the Executive. OPEN SESSION Al Couch, manager of Water District 10 addressed the Council, protesting the conditions imposed on the District in one of the resolutions. He also spoke on several other areas of his concern. A letter was received from the City of Ferndale asking for the forma. on of a committee to discuss planning and sewer matters-'in the Ferndale area. A Committee of the Whole meeting was scheduled for April 22 at 4:30 p.m. with the Public Works Director to discuss this matter. Further meetings to be held before May 8 are to be with Harper -Owes, the consulting firm, and with the City of Ferndale. Finance Committee is cancelled for April 22. Roehl mentioned the WSAC and WACO meeting agenda for April 18, meeting being held at the Holiday Inn in Bellingham, and urged Council members to attend. Also discussed was the current status of the Lakeside Condominium appeal. Phil Serka has suggested an Executive Session to.give the Council a background in the case. Wednesday, April 23 at 7:00 p.m. is scheduled for D.O.B. and State Department of Energy respresentatives to be present in the Council Chambers to discuss and answer various energy matters and Questions.
