MINUTES OF MEETING
November 15, 1979
The Whatcom County Council meeting of November 15, 1979 was called
to order at 7:37 p.m. C. J. Johnson was absent. All other members were
present for roll.
The minutes of the previous meeting were approved as presented.
OTHER BUSINESS
Vote was taken on the appointment to the Third District Council
Position B. The vote was a stalemate with Hansey and Muenscher voting
for Donel.lan, McIntyre,Roehl, and Van Zanten voting for Graham. It
takes a vote of four in favor of a candidate to appoint a new member.
It was moved to defer further voting to Monday, November 26. Motion carried.
Hansey moved to postpone consideration of the labor contracts to the
November 29 meeting on the grounds that the Finance Committee has more
questions to be answered on "'hem,. Motion passed.
Reconsideration of the vacation of an alley in Block 2, Town of
Deming was necessary because it was found that the petitioner must
pay the assessed land value, per WCC 7 40.070. In action at the October
18 meeting, the Council had approved the vacation without the cost
of the land. By majority vote, the vacation was granted as originally
presented, including the $965.00 land fee.
Communications and petitions were formally received. They were
the vacation petition of: White's Park Addition to Drayton - Williams
Addition to Blaine, Western portion of Bay Street, and alley in Block
8, Plat of Maple Leaf Park addition to Blaine. Hearing date will be
set for these petitions.
The application for open space from Sheila Vander Wielen was re-
ceived and sent to the Planning Department.
Hansey moved to approve the Dance License applications by Lawrence
R. O'Brine, Jr. and Orville Henly in accordance with Sheriff's recom-
mendation. Motion passed unanimously.
EXECUTIVE ITEMS
John Louws asked the Council to confirm the appointment of Warren
Bursick to the position of Whatcom County Hearing Examiner. The appoint-
ment was confirmed by unanimous vote.

Other items he presented to the Council were of advising of the
vacancy on the Board of Health created by Thompson's resignation, and
of upcoming vacancies on the same board due to Muenscher's and Roehl's
expiring terms. At the end of the year, there will be two openings
on the Planning Commission, Dist. 2 and Dist. 3. There also will be
appointments coming up at the end of the year on the Alcoholism, Appeals,
Mental Health and Rural Library Boards.
Louws requested confirmation of bid award for two dump box mounted
spreaders in the amount of $12,383.28 of Sahlberg Equipment Co, Inc.
Funds will come out of the 1980 budget. Motion by Hansey to award the
bid as submitted passed.
FINAL HEARING & CONSIDERATION OF ORDINANCES & RESOLUTIONS
McIntyre moved the introduction of the ordinance granting a 25
year water and wastewater Franchise on certain county roads to Puget
Power. Hearing was held, and Bill Grace from Puget Power spoke on its
behalf. The ordinance was referred to Public Works.
Public hearing was declared open on the resolution in the matter
of establishing Whatcom County Ferry Rates. Don Murray from Public Works
spoke for it. Dave Dickinson submitted a letter from Colleen Dickinson
to the Council against certain sections in the resolution. Kathy
Luke requested the letter to be read and then spoke against some sections,
primarily that which would require children under 12 to be accompanied
by an adult or legal guardian. Hearing was closed. Amendments to the
resolution were proposed as follows. McIntyre moved on page 4 line 13,
to strike "approximately ", and on line 14 add "in 1980" after "operation."
Motion lost. Roehl moved on page 4 line 5, strike "not to exceed 50a,"
and on page 2, line 28 & 29, strike "Parent" and "guardian" and insert
"responsible adult." Both passed. With Public Works recommendation
of "do pass as amended," Hansey's motion to adopt passed unanimously.
The revised ordinance regarding the regulation of the sale of kegs
or other containers of seven gallons or more of malt liquor was moved for
passage by Muenscher,with a Public Safety "do pass as revised" recommendation.
Hansey moved to amend on page 1, by striking line 24 entirely, and
through the word "purchaser" on line 25. Motion passed. Hansey's
amendment to make a new Section 3: "upon adoption of a like ordinance

in the cities of Bellingham, Ferndale, and Blaine," was defeated.
Sheriff Mount spoke for the ordinance. It was defeated by a three
in favor (Van Zanten, Muenscher, and Roehl) to two against (Hansey
and McIntyre) vote. Hansey moved to reconsider the ordinance on
December 6, and refer this ordinance back to Public Safety. The
motion passed.
A five minute recess was called.
Hearing was called for on the ordinance regarding changing a
stop sign to a yield sign on Nest Alain Road. No testimony was given.
Muenscher, with Public Safety and Engineering recommendation of "do
pass" moved to adopt the ordinance. His motion carried by unanimous vote.
Muenscher made a motion to approve the ordinance implementing
the Whatcom County Comprehensive Plan by amending Whatcom County Interim
Zoning mans to reflect a change from General Protection District to
Agriculture District in those areas designated Agriculture on the What-
com County Comprehensive Plan Map. Mike Nicholson, Planning Director
gave the background details and chronology of handling of the proposed
change. John VanderHage of the Planning Commission also spoke on it,
relating the Commission's findings in the matter. The change would
involve approximately 35,000 acres in four areas being changed. The
ordinance and accompanying Findings of Fact passed by a 4 -vote majority.
Hansey abstained on advice of attorney, as there might be some question
on the grounds of appearance of fairness...
The ordinance providing a supplemental budget for the County Auditor's
1979 budget had Finance "do pass" recommendation and Hansey moved to
adopt it. His motion passed unanimously.
Finance recommended "do''pass" 6n-'the otdinance providing a supple -
Mental budget for the Law Library 1979 budget'. Hansey -moved to pass
the ordinance, which carried unanimously.
Finance recommended approval of the ordinance for a supplemental
budget for the County Personnel Department 1979 budget. Hansey's
motion to adopt this ordinance carried unanimosuly.
The resolution establishing a central Road District at G -3 site
was not reported out of committee.

The resolution in the matter of adopting the Whatcom County 1980
Annual Construction Program was approved unanimously with Public Works
recommended "do pass," after amendments to the attachment to the reso-
lution for work in each district were adopted as per Engineer request.
INTRODUCTION OF ORDINANCES $ RESOLUTIONS
The ordinance regarding the adoption of the Levy for the year
of 1980 was introduced by Hansey and referred to Finance.
The ordinance regarding placing "No Parking" on Lindbergh Aveneue
was introduced by Roehl and sent to Public Safety.
The next four items were introduced by Muenscher and referred to
Finance. They were the ordinance amending the Whatcom County Shoreline
Management Program adopted May 27, 1979, amended June 25, 1978, modify-
ing by amending Chapter 8 Section 8.3, subsection B2, the ordinance
amending Whatcom County SEPA Ordinance adopted May 30, 1979 amending
Section la(B)(1) and Section 22, the ordinance amending Chapter 8 of
the Whatcom County Code entitled "Whatcom County Subdivision Regulations,"
adopted December 9, 1971 and amendments thereto, and the ordinance amend-
ing Chapter 2.24 Whatcom County Code and the Whatcom County Interim
Zoning Ordinance.
Hansey introduced the ordinance for the consolidation of the three
Whatcom County Road Districts and establishing one county -wide road
district, and referred it to Public Works.
The resolution approving Whatcom District No. 12, January 19,
1978, amendment to their Comprehensive Plan was introduced by Muenscher
and referred to Planning. Larry McIntyre gave a report of the Public
Works Committee held prior to the Council meeting.
Meeting was adjourned at 10:30. The next Council meeting will
be on Monday, November 26, 1979.
