HomeMy WebLinkAboutCounty Council for December 20 1979i MiATCOM COUNTY COUNCIL Minutes of meeting December 20, 1979 The Whatcom County Council meeting of December 20, 1979, was called to order at 7:30 p.m. with all members present but Jon Donellan, who was excused by motion. The minutes of the previous meet.i.ng were approved as corrected. EXECUTIVE ITEMS The Executive requested the Council to approve a transfer in the Local Public Works fund in the amount of $30,824.72. Hansey moved to ap- prove the request. His motion passed unanimously. The agreement with Book Publishing Company regarding the codification of Ordinances request by the Prosecuting Attorney's office was placed on the January 10, 1980 agenda. It will be considered by Finance prior to that meeting. Louws made note of the declaration of a state of emergency in Whatcom 'County due to the recent flooding. The resigation of Nolan Servos as the Charman to the Whatcom County Agriculture Extension Office was accepted. Hansey moved to confirm the appointment of Greg Fenske to fill the position. His motion carried. HEARINGS Hearing on the vacation of a portion of White's Park addition to Drayton, William addition to Blaine, and Cleveland addition was held over until the January 24 meeting due to publication of incorrect legal descrip- tion. At the hearing for the vacation of all of Bay Street in Birch Bay Park Plat petitioned for by Gordon Carter, Mr. Carter spoke for the vacation agreeing with the terms for vacation. Roehl moved to grant the vacation with recommendations as stated by the Engineering Department. His motion passed. Hearing was held on the vacation of alley in Block 8, plat of Maple Leaf Park Addition. No testimony was given. Roehl's motion to approve the vacation passed unanimously. No public testimony was given at the hearing on the ordinance regarding placing "No Parking" restriction on Lindbergh Avenue. Johnson moved to pass the ordinance. His motion passed unanimously. minutes of Council meeting December 20, 1979 page two OTHER BUSINESS Muenscher moved to approve the Preliminary Plat of George Visser to expand a mobile home park subject to conditions as out in the Findings of Fact as recommended by the Hearing Examiner. This motion carried by unanimous vote. Planning Commission position appointments pending were announced. Terms of John VanderHage and Al Hickinbotham expire January 1, 1980. The Planning Committee was requested to bring nominations to the January 10 meeting. Roehl, Muenscher and Hansey were unanimously appointed to serve on the Health Board for 1980. Roehl and Muenscher were reappointments and Hansey is filling the vacancy created by Thompson's resignation. FINAL CONSIDERATIONS Hansey moved Finance Committee recommendation to amend the ordinance authorizing a. supplemental budget for the Assigned Counsel Department budget I-or 1979 to be a total. request of $36,000 from the original request of $30,000: His motion passed, and the ordinance as amended passed by unan- imous vote. Hansey moved to adopt the ordinance authorizing a supplemental budget for the Commissioners' 1979 budget with finance Committee's recommendation of "do pass." His motion passed unanimously. Finance Committee recommended "do pass" on the ordinance authorizing a budget change within the Emergency Operation Center 1979 budget. Hansey's motion to enact this ordinance passed unanimously. Hansey moved to adopt the Ordinance authorizing a supplemental budget for the Public Works Equipment Rental and Revolving Fund for 1979 with Finance recommendation of "do pass without the emergency clause." The ordinance was so ordered by unanimous vote. Hansey moved to adopt. the ordinance authorizing a supplemental budget. for the Superior Courts budget for 1979 with a Finance Committee recommended amendment to the original ordinance by changing the amount from $21,000 to $32,000. The amendment passed, and the ordinance passed as amended by unanimous vote. The ordinance establishing Personnel Policies and Procedures pursuant to Home Rule Charter Article 7 was not reported out of the Ad Hoc Commit- tee. C minutes of Council meeting December 20, 1979 .,.page three Hansey moved to adopt the ordinance amending the ordinance for the levy of taxes for the year 1980, by amending attachment "A" which had been attached and incorporated by reference into Ordinance No. 79 -68. Finance Committee recommended "do pass" on the ordinance. Hansey's motion passed. It was pointed out that the reason for this amendment was that although the consolidation of the three road districts has been enacted, the consolidated levy could not be enacted for 1980 taxes without having been announced prior to March 31, 1979. By announcing it before March 31, 1980, it is known that it is the intention of the Council to consoli- date the three road district levies, and thus, the consolidated levy can be legally changed for 1981. Hansey moved to pass the ordinance amending ordinance No. 79 -66 authorizing the consolidation of the three Road Districts and establishing one county -wide road district. Public Works and Finance recommended "do pass," and the ordinance was so ordered by unanimous vote. Muenscher moved to approve the resolution approving Water District No. 12, January 19, 1978 amendment to the Comprehensive Plan with Planning Committee recommended "do pass as amended." Roehl moved to amend by adding on line 11 after "Water District No. 12" on page 1, "as it applies to Whatcom County." The resolution passed unanimously as amended. Hansey, with Finance recommendation of "do pass," moved to adopt the resolution in the matter of increasing the filing fees paid to the Law Library from $7.00 to $9.00. His motion carried by unanimous vote of the Council. McIntyre reported that the Public Works Committee recommended "do pass as amended" the resolution in the matter of the sale of Whatcom County surplus equipment and the setting of a date for public hearing thereof pursuant to RCW 36.34.020, the amendment being to authorize the Executive to remove property from this list up to the date of sale, if he deems it necessary for public use. Johnson introduced the resolution fixing time and place of hearing on assessment roll for Johnson Creek D.I.D. No. 31, and directing the Clerk to give notice thereof, and moved its immediate passage. His motion carried, and the resolution was passed. Johnson introduced and moved for final consideration the resolution in the matter of changing the name and the name of the budget of the Whatcom County Mental Retardation department to the Whatcom Department of Develop- mental Disabilities. The resolution was ordered by majority vote. liansey introduced the resolution in the matter of transfers affecting the 1979 budget. He moved for final consideration, and the resolution passed by unanimous vote. Hansey introduced the three ordinances affecting the CETA budget and referred them to Finance. They are for Title II, VI, and VI Project. McIntyre introduced the ordinance amending Whatcom County Ordinance No. 79 -72 adopted December 6, 1979, concerning a franchise agreement between Whatcom County and Puget Sound Power and Light Company. It will come up for final consideration on the January 10 meeting. COMMITTEE REPORTS Muenscher reported for the Planning-Committee on h ��ro�possed amend- ments ments for Water District 10 as it relates to the I r�••��-- watershed. He felt the County must come to some decision on what they want to do with the Lake Whatcom area. McIntyre feels a task force is needed to update the Comprehensive Utility Plan for the entire county. McIntyre reported for the Public Works Committee, making note of the C minutes of Council meeting December 209 1979 cage five meeting they will have on Thursday, December 27 at 7:00 p.m. in conjunction with the Planning Committee to discuss the Nor Bell sewer plan. The City of Bellingham Public Works and Planning Committees are to meet with these two committees at 7:30 to discuss the Marine Drive sewer problems. Johnson noted the rising costs in jail construction and cost of maintaining new facilities. lie cautioned Whatcom County on the need to look at these rising costs related to the proposed new jail facility. The meeting was adjourned at 9:40 p.m.
