Present Absent Dennis Vander Yacht None Mary Vanderpol DISCUSSION OF POLICY FOR ISSUANCE OF WATER SAMPLES TO CITIZENS, RELATING TO THE REQUESTS (12/90) BY JOHN LEIBRANT (AB91 -073) 135 -139 Imhof said he does not feel the integrity of the sample is maintained when it is given to a resident. Leibrant said he wants to take his own to prove the County is not getting proper sampling by the consultant. Vanderpol said he has problems dealing with a citizen over quality control. The County work with a state approved lab to check the quality control. Imhof said he does not want to set a precedent with this issue. Vander Yacht said he thinks it would provide a check and balance and a difference would have to be then dealt with. This would clear up a perceived issue of fairness that the County has something to hide. Vanderpol said Leibrant could hire a consultant. Leibrant said this is victimizing the victim. Vander Yacht said the onus should be on the County to make sure this is safe. The County owes it to Leibrant to take this one step farther. Vanderpol said this should be checked through the same quality control as the consultant is using. Imhof said he agrees there are procedures that must be followed. Leibrant showed maps showing leachate coming out of the leachate tank. Leibrant marched out saying he wanted to get out before he .... VANDERPOL MOVED TO ASK THE EXECUTIVE TO DRAFT A POLICY FOR DEALING WITH CITIZENS' REQUESTS FOR SAMPLING AND TESTING. Bader said the concern he has is that they will come back with another set of results and a lot of re- sampling. He said it would be hurting a citizen to give them results that could be used in court. Vander Yacht said at least this would give Leibrant the feeling he is being dealt with fairly. Bader said the lab John uses is probably very good but uses different methodology. He said Leibrant should hire a consultant and have him test one well with the same six parameters the County uses. Minutes, 2/26/91, Page 1 Vanderpol said the County has spent an unbelievable amount of time and money on Leibrant and the burden of proof would be on the County if he did get samples and the results were different. Motion carried unanimously. 2. PETITION TO VACATE AN ALLEY IN BLOCK 12, AMENDED PLAT OF GENEVA, FILED BY GAYLE LUEDKE (AB90 -400) Imhof explained this item. Imhof said he looked at the property and agrees with the vacation. VANDERPOL MOVED TO RECOMMEND VACATION TO THE COUNCIL. The motion carried unanimously. 3. RESOLUTION ORDERING THE INCORPORATION OF CERTAIN TERRITORY INTO FIRE DISTRICT NO. 14 (AB91 -72) 121 -129 Imhof explained that 60 percent had signed a petition to annex 120 acres The Auditor and Commissioners are in favor of this action. VANDERPOL MOVED TO RECOMMEND APPROVAL TO THE COUNCIL. The motion carried unanimously. 4. OTHER BUSINESS Litter on Slater Road: Imhof said he and his neighbors had requested Sanitary Service to put mesh on their trucks so garbage would not be flying out constantly on the Slater Road but it has not helped. Vanderpol asked if this is a Sheriffs problem.
