HomeMy WebLinkAboutPlanning and Development August 6 1991WHATCOM COUNTY PLANNING AND DEVELOPMENT COMMITTEE August 6, 1991 The meeting was called to order at 3:30 p.m. in the Council Chambers, 2nd Floor, 1000 N. Forest, by Chairperson Marge Laidlaw. Also present Donald Hansey Emily Jackson Absent None 1. ORDINANCE AMENDING THE ZONING MAP AND CHERRY POINT - FERNDALE SUBAREA PLAN FROM GENERAL COMMERCIAL TO URBAN RESIDENTIAIr3 /DU /ACRE FOR A PARCEL OF LAND (RIGHT -OF -WAY) THAT WAS OMITTED WHEN A PREVIOUS REZONE WAS APPROVED IN 1990 (AB91 -282) Dan Taylor, Planning Department, stated this is a technical correction. The Planning Department overlooked a right -of -way which should have been included in the initial rezone. HANSEY MOVED TO RECOMMEND DO PASS ON THE ORDINANCE. The motion carried unanimously. 2. ORDINANCE AMENDING THE OFFICIAL FOOTHILIS COMP PLAN MAP AND TEXT FROM RURAL TO CONIlVIERCIAL AND THE OFFICIAL ZONING MAP FROM RURAL 5 ACRE AND NEIGHBOR- HOOD COMMERCIAL TO TOURIST COMMERCIAL FOR LOT 2, KENDALL ACRES SHORT PLAT FOR APPROMMATELY 5.11 ACRES ON KENDALL ROAD AND MOUNT BAKER HIGHWAY (AB91 -284) Taylor explained the rezone is for a motel. Taylor, Laidlaw, Jackson discussed language clarification of the agreement. Laidlaw made a recommendation to staff that letter "E" in the concomitant agreement should state "Owners in lots 1 & 2 of Kendall Acres Short Plat will assure the lease of the Kendall store is not violated by the terms of this concomitant agreement." Mike Smith of Zervas Group Architects, which is representing Carloee Tracy, briefly explained the three phases of the proposed motel. Planning and Development Committee Minutes, 8 -6 -1991, page 1 Laidlaw also recommended to add a time limit to Phase I of the motel construction, too begin in two years of passage. Jackson inquired about the rechanalization of the Kendall and Mt. Baker intersection. HANSEY MOVED TO RECOMMEND ADOPTION OF ORDINANCE WITH THE RECOMMENDED CHANGES. The motion passed with Jackson sustaining. 3. ORDINANCE AMENDING THE POINT ROBERTS SUBAREA COMP PLAN MAP AND THE ZONING MAP FROM URBAN RESERVE AND URBAN RESIDENTIAL-3 PER ACRE TO RESORT COMMERCIAL FOR APPROXIMATELY 0.87 ACRES (AB91 -287) ON FILE Dan Taylor stated the Planning Commission unanimously recommends approval of the rezone. HANSEY MOVED TO RECOMMEND ADOPTION OF ORDINANCE TO COUNCIL. Martin Keely, Point Roberts, expressed concerns about setting a precedent. Laidlaw explained the Planning Commission felt there was error in the first place and amended the motion. The motion was carried unanimously. 4. ORDINANCE AMENDING THE BIRCH BAY- BLAINE SUBAREA COMP PLAN MAP FROM COMM ERCIAL - RESORT TO COMMERCIAL - GENERAL AND THE ZONING MAP FROM RESORT COMMERCIAL TO GEN. COMMERCIAL SUBJECT TO A CONCOMITANT AGREEMENT FOR AN APPROX. 15 -ACRE PARCEL IN THE NORTHEAST CORNER OF THE INTERSECTION OF BIRCH BAY - LYNDEN ROAD AND HARBOR VIEW ROAD (AB91 -289) Laidlaw stated the propellant requested this to be delayed. 4. ORDINANCE AMENDING THE TEXT OF THE OFFICIAL WHATCOM COUNTY ZONING ORDINANCE, POINT ROBERTS SPECIAL DISTRICT (WCC 20.72.650) TO EXTEND THE PROHIBITION ON TREE CUTTING IN THE GREAT BLUE HERON ROOKERY AND ASSOCIATED 200 METER BUFFER AREA UNTIL, JUNE 30, 1993. Planning and Development Committee Minutes, 8 -6 -1991, page 2 Dan Taylor explained that Bob Carmichael, Civil Deputy Prosecuting Attorney, recommended that the Findings and Facts contain more detail. Martin Keely stated concerns about the time limitations and also the situation with the Department of Wildlife. Laidlaw stated the Committee should consider approval, after reviewing the revised Findings and Facts on September 3, 1991. 5. OTHER BUSINESS- Dan Taylor provided an overview of the items forthcoming at the next Planning & Development meeting on August 13, 1991.
