Forest, by Chairperson Marge Laidlaw. Also Present Don Hansey Absent Emily Jackson 1. ORDINANCE IMPOSING A PERMANENT MORATORIUM ON SURFACE MINING (AB91 -147; RELATED TO AB90 -443) Dan Taylor, Whatcom County Planning Director, spoke at length about what the Department of Natural Resources regulates and what the County regulates when dealing with surface mining activities. Bob Carmichael, Deputy Prosecuting Attorney, stated that the real difference between this Ordinance and the one that the Planning Commission looked at previously is the splitting out of two dates. The subject matter is the same, and all the issues have been thoroughly considered by the Commission over the last year and a half. This Ordinance would place a moratorium on surface mining activity within Whatcom County. The only exceptions would be those parcels identified as likely sites to be designated as mineral resource lands and those parcels determined to have vested rights until December 31, 1991 or until regulations are in place in compliance with the Growth Management Act, whichever is first. HANSEY MOVED TO RECOMMEND APPROVAL TO COUNCIL. Motion carried unanimously. 2. OTHER BUSINESS No other business.
