Forest. 6 Present Absent 7 Ken Henderson Marge Laidlaw 8 Bob Imhof Dennis Vander Yacht 9 Larry Harris 10 Barbara Brenner 11 RESOLUTION ADOPTING THE 1991 UPDATE OF THE WHATCOM 12 COUNTY SHORELINE MANAGEMENT PROGRAM AND REFERRING 13 IT TO THE DEPARTMENT OF ECOLOGY FOR FINAL APPROVAL 14 (AB91 -347) 15 HENDERSON MOVED TO APPROVE THE RESOLUTION ADOPTING THE 16 1991 UPDATE OF THE WHATCOM COUNTY SHORELINES MANAGEMENT 17 PROGRAM AND REFER IT TO THE DEPARTMENT OF ECOLOGY (DOE) FOR 18 FINAL APPROVAL. 19 Henderson discussed page 33 of the Program with regard to non - conforming uses; 20 he asked whether situations were being allowed that have not been allowed before and 21 whether existing uses could be expanded under the new rules. 22 HENDERSON MOVED THE SECTION ON PAGE 33 AND ANY OTHER 23 SECTIONS RELATING TO NON - CONFORMING USES BE WITHDRAWN. 24 Henderson withdrew his motion saying he would like to wait until Galvin arrives at 25 the meeting and can explain the reasons it was written this way. 26 HENDERSON MOVED THAT ON PAGE 39, SUBSECTION .2 "ADDITIONAL 27 NOTICE SHALL BE GIVEN BY AT LEAST ONE OF THE FOLLOWING METHODS" 28 SHOULD BE CHANGED TO "ADDITIONAL NOTICE SHALL BE GIVEN BY THE 29 FOLLOWING METHODS" AND AT THE END OF .2 (A) THE WORD "OR" BE 30 CHANGED TO "AND" IN ALL APPLICABLE SECTIONS OF THE DOCUMENT. 31 The motion carried unanimously. 32 Tull explained that the non - conforming language is only to allow fixing a roof or 33 adding a bedroom at the back of the house which would not infringe on the shorelines. 34 setback requirement. It was noted that there is a lengthy process for each request. �5 Laura Lee Braake, 585 Pleasant Bay Road, said DOE provided the wording on the 1 non - conforming uses section. 2 Galvin arrived and distributed copies of a memo showing proposed changes on this 3 issue. 4 HENDERSON MOVED TO ADOPT A AND B FROM THE PLANNING STAFF 5 RECOMMENDATIONS IN THE MEMO DATED APRIL 21ST MEMO. 6 The motion carried unanimously. 7 Items discussed were: Serka Memo; public access; Tull's memo regarding a perceived 8 shift of power from the County to DOE; conditional use; laws that require public hearings 9 and review; consistency with the statewide program; DOE approval may eliminate a lot of 10 further problems; DOE will make whatever changes it deems necessary and return it for 11 final approval. 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Comments were made by: Henderson, Galvin; Tull; Braake. HARRIS MOVED TO ADOPT A, B, C, AND D RECOMMENDED BY THE PLANNING DEPARTMENT. Galvin explained the setback revisions. HENDERSON ADDED A FRIENDLY AMENDMENT THAT THE MARCH 18 RECOMMENDATION BE INCLUDED IN THIS MOTION. Harris accepted this as a friendly amendment. The motion was carried unanimously. Henderson mentioned Item 25, page 274, of the Shorelines Management Program document regarding the definition of "community docks." The document does not encouraging the use community docks; the result is the development of private docks. Items discussed were: Tull's original memo "Point by point review" was discussed. Comments were made by: Henderson; Warner. The motion carried unanimously. WARNER MOVED TO APPROVE ALL STAFF RECOMMENDATIONS IN MEMO DATED 4/21 EXCEPT POINTS A,B,C, AND D (WHICH HAVE ALREADY BEEN DEALT WITH). Galvin said he agreed with Tull that we need to have creativity in this issue. Warner thanked Tull for his efforts on Shoreline issues. The motion to amend carried unanimously. The motion to approve the resolution to adopt the 1991 update of the Whatcom County Shoreline Management Program with amendments and refer it to the Department of Ecology for final approval was carried unanimously. WARNER MOVED THAT HE AS CHAIRMAN WRITE A LETTER STATING THE COUNCIL IS SUPPORTIVE OF PUBLIC ACQUISITION OF GOVERNOR'S POINT BY THE LAND TRUST. The motion carried unanimously.
