Also present: Absent: Larry Harris Dennis Vander Yacht 1. ORDINANCE AMENDING THE OFFICIAL WC ZONING MAP (AB92- 289) 2. ORDINANCE AMENDING THE OFFICIAL WCC, CHAPTERS 20.42, 20.43, 20.80.272, 20.80.273 AND CREATING A NEW CHAPTER 14.04 (AB92 -290) 3. ORDINANCE AMENDING THE OFFICIAL WC COMP LAND USE PLAN FOR THE LAKE WHATCOM, CHUCKANUT -LAKE SAMISH, LYNDEN - NOOKSACK VALLEY, FOOTHILLS, AND LUMMI ISLAND SUBAREA TO MAKE CONSISTENT WITH LANGUAGE ADOPTED FOR THE SOUTH FORK VALLEY SUBAREA... 36 -65 (AB92 -291) Items 1, 2 and 3 were discussed and voted on as a unit. Topics discussed: Questions raised at the hearing; response to questions from the hearing; land classification standards; tax basis; boundaries; adjacent land uses; Trillium's So.Bay/ Lake Whatcom parcels; Welcome parcels; Glacier Springs /Canyon Creek area; impact of slope and soil conditions; Squalicum Mountain; watchman's living quarters; tax status of these quarters; road maintenance; cluster concept; limitations to changes Planning Committee can make; maximum density /minimum lot size; reserve tract; changes to 20.42.320(3); 20.42.450 clearance restrictions; amendments to the cluster coming in two weeks; dates for applications for rezones; intentions of the ordinance; hold harmless agreement's removal. Persons speaking: Gordon Scott, Planning Dept.; Henderson; Harris; Dan Taylor, Planning Department. Roger Alsmkaar, Land Use Consultant representing Trillium: Believes Council should have a hearing on this. There's no reason to rush this zoning; no one is planning to do anything. A huge downzone is being proposed; the factual basis is not yet available. Criteria Planning Minutes, 1016192, Page 1 were taken from the South Fork Plan; a lot of subjects are not included that would be appropriate to forestry .lands. Ivy H. Cook, 4001 South Bay Drive: Objects to the zoning of her land as commercial forestry. This land has never been used for commercial purposes; the family has owned it for over 100 years. Art Hyatt, 2318 North Shore Rd.: Asks the Council to remember that the lines of the Fire, Districts are arbitrarily drawn, but were then used to set up some of the rezoning. Pointed out that the Flood Advisory Committee is considering a buyout of some of the Glacier Springs area because of the inadvisability of a build -out in the area. Would like to see the South Bay area in Commercial Forestry to protect the watershed. Watchmen's houses should be at the access, not a mile up the road. HARRIS MOVED TO RECOMMEND ADOPTION WITHOUT A FURTHER HEARING. The motion carried 2 to 1 with Henderson voting against. 4. ORDINANCE AMENDING THE BIRCH BAY- BLAINE SUBAREA COMPREHENSIVE PLAN MAP FROM RURAL TO LIGHT IMPACT INDUSTRIAL .(LII) AND THE OFFICIAL WC ZONING MAP FROM RURAL -ONE -UNIT /TEN ACRES TO LII WITH A CONTRACT REZONE TO ALLOW LIMITED INDUSTRIAL USES ASSOCIATED WITH RAIL ACCESS FOR APPROXIMATELY 209 ACRES (AB92 -053) Topics discussed: Memo from Taylor not in packet; information from Bob Tull's office; changes to concomitant agreement; disagreement between Planning Commission and Planning Department; uniqueness of the site for meeting proposed use; gas pumps, etc.; problems with Cherry Point; benefits of Cherry Point; Persons speaking: Henderson; Taylor; Barbara Brenner, Council Member; Harris. HARRIS MOVED TO RECOMMEND DENIAL OF THE APPLICATION. The motion carried unanimously. Lynn Onastack, 4320 E. Oregon: An error delayed working on his application; finally the Planning Commission voted 8 to 1 to approve his request. He is requesting that, because of financial and time elements, the property appeal be taken out of its time schedule and batch process and be allowed to proceed through the Planning Dept. and on to Council before the first of the year. Topics discussed: batching; time elements; possible solutions to the time problems Planning Minutes, 1016192, Page 2 and agendas; splitting the batches; Council's preferences in order taken. Persons speaking: Taylor; Henderson. Louis LeClezio, 10021 NE Place, Bellevue: Transportation is a very complex issue that few people understand. The requested area would be one of the three top locations for intermodal work. Also, the 8 miles becomes 16 miles with the return trip. Look at fuel usage, air quality, time. Explained his site requirements. Because there was no other business, the meeting was adjourned.
