Forest St., 2nd floor, by Chairman Ken Henderson. Also present: Absent: Larry Harris Dennis Vander Yacht 1. GROWTH MANAGEMENTACT: ORDINANCEAMENDING THE COUNTY COMPREHENSIVE PLAN TO CLASSIFY AND DESIGNATE MINERAL RESOURCE LAND ON AN INTERIM BASIS (PLANNING FILE REF. MRLCOMP2.OR) (AB92 -100) 2. GROWTH MANAGEMENT ACT: ORDINANCE AMENDING THE OFFICIAL ZONING ORDINANCE, TITLE 20, TO CREATE A NEW SECTION: WHATCOM COUNTY CODE 20.73, MINERAL RESOURCE LAND SPECIAL DISTRICT (MRL) TO COMPLY WITH THE GROWTH MANAGEMENT ACT MANDATE TO PROTECT MINERAL RESOURCE LANDS ON AN INTERIM BASIS (PLANNING FILE REF. MRL1202.OR) (AB92 -105) Topics discussed: deletion of MRA -2 areas; use of new map; change of MRA -1 to MRL; river gravel added as a mineral resource; further clarification of the two ordinances; cleaning up of the wording; using river gravel; maintaining gravel reserves; non - conforming uses in the agriculture zones (nonconforming uses); Hoy application for mining on Sorenson Rd.; extension of moratorium on new permits for gravel mining; SEPA requirement for Economic Impact Statements (EIS's); ways in which DNR would pull a permit; expenses involved in an EIS with inconclusive results; numbers given in the report; ordinance's conclusion; restoration of gravel pits in agriculture zones; potential as wetlands. HARRIS MOVED TO REMOVE FINDING #4 ON PAGE 117. Motion carried unanimously. HARRIS MOVED TO REWRITE THE CONCLUSION AS FOLLOWS: Aggregate will be needed for future generations in Whatcom County. Guidelines for mineral resource plans under the auspices of the Growth Management Act suggests Whatcom County set aside lands designated as Mineral Resource Land to meet needs for the next 50 years. Ui111lr<a Meanwhile, adoption of the interim designations will limit further residential in the areas that most likely contain valuable sand and gravel resources. HARRIS MOVED TO RECOMMEND TO COUNCIL, WITH THE ABOVE AMENDMENTS, WITH BOTH ORDINANCES CHANGED TO CONFORM WITH ONE ANOTHER AND THE CHANGES. The motion carried unanimously.
