The meeting was called to order AT 1:30 p.m. in the Council Chambers, 1000 No.
Forest St., 2nd floor, by Ken Henderson, Chairman.

1. ORDINANCEAMENDING THE LYNDEN- NOOKSACK VALLEY COMP
PLAN AND OFFICIAL ZONING MAP FROM GENERAL
COMMERCIAL TO RURAL RESIDENTIAL TWO PER ACRE FOR
APPROX. 10 ACRES AND FROM RR2 TO GC FOR APPROX. 2 1/2
ACRES ON BOTH SIDES OF GUIDE MERIDIAN, SOUTH OF WISER
LAKE AND NORTH OF BARTLETT ROAD (AB92 -288)
Topics discussed: Contracts; Department of Transportation's memo - -item 1B is no
longer valid; traffic generation as a result of the changed contract; Taylor's memo; potential
of gas station on west side; LID; outstanding contract issue (septic systems).
Persons spealdng: Dan Taylor, Planning; Henderson; Ed Henken, Engineer; Gordon
Scott, Planning.
Jack Swanson, 409 National Bank Building: Had questions concerning traffic
problems. Suggests possibly 5 lanes with center left turn lane or no left turns into or out of
the gas station. Suggests that development should be dealt with on a case by case basis
based on SEPA requirements. Pointed out that it is just a matter of time until eastern
Whatcom County has a major road running through it because of the development taking
place in Abbotsford, B.C. Objects to DOT slipping in new requirements on something that
isn't even law yet.
Phil Serka, representing Scholten Roofing: Requests that this be finalized and
adopted. Points out that DOT believes that this is a rezone to allow new industry; in fact,
this zoning has existed for 5 years now. Also points out that DOT wants to limit based on
pending legislation. Enough time has gone by, the moratorium was placed for a reason not
dealing with Scholten and for something no longer valid, his clients have spent many hours
and a lot of money on this.
Bob Anderson, 203 W. Holly: Reminds the Council that this is not a Cordata area,
this is a small commercial area. The standards that are now in effect will protect the area
surrounding this area. Closing this at this time is the right thing.
VANDER YACHT MOVED TO RECOMMEND PASS WITH THE

STIPULATION THAT TAYLOR REPORT SATISFACTORY NEGOTIATIONS WITH
SCHOLTEN ROOFING ON THE FINAL DETAILS OF THEIR CONTRACT.
Motion carried unanimously.
Craig Hayes, 119 No. Commercial: Since his client's contract is signed, he would
rather not have them be a part of any public hearing on the issue.
2. ORDINANCE AMENDING THE OFFICIAL WHATCOM COUNTY
ZONING MAP (AB92 -289)

3. ORDINANCE AMENDING THE OFFICIAL WHATCOM COUNTY

FOOTHILLS, AND LUMMI ISLAND SUBAREA TO MAKE
CONSISTENT WITH LANGUAGE ADOPTED FOR THE SOUTH FORK

VANDER YACHT MOVED TO RECOMMEND THAT COUNCIL HOLD A
HEARING ON THE FEE INCREASES AND THAT THE OTHER ASPECTS BE HELD
IN COMMITTEE SUBJECT TO CLARIFICATION ON THE SLOPAGE AND
DRAINAGE QUESTION AND REWORDING OF THE HOT TUBS SECTION AS PER
THE DISCUSSION.
Motion carried unanimously.
