10 6. REQUEST FOR CONFIRMATION OF GARY GOLDFOGEL, M.D., AS
11 MEDICAL EXAMINER, AND REQUEST FOR AUTHORIZATION FOR
12 THE EXECUTIVE TO ENTER INTO A CONTRACT FOR SERVICES

14 Laidlaw reported for Finance that this is a recommendation for approval with a split
15 vote from committee and there was one amendment on page 3 of the contract, under 2.2
16 Description of Services, a new J. would be added as follows, "No further consideration will
17 be paid except when authorized by the County Council."
18 Imhof and Watts discussed whether he had seen the finished contract. Watts said he
19 didn't really see more than the boiler plate language and one of the issues.
20 Harris asked why it is being considered as a contracted position. Van Zanten
21 explained this was really more appropriate.
22 Imhof withdrew his endorsement of this issue which changed the Finance committee
23 recommendation to denial of authorization the contract.
24 Warner spoke in favor.
25 Laidlaw said there is a built in cost for the county to build a morgue with supplies;
26 additional staff; and a cost of living increase without knowing those costs or contract
27 language. Laidlaw said that acting on a contract before the Code change ordinance is in
28 place is inappropriate; the county would probably be able to contract with another county
29 or hospital for an interim period.
30 Harris said he was concerned about the level of compensation. Van Zanten said the
31 County has been paying extremely low wages and the law does require this service be
32 provided.
33 The motion to authorize the contract with Dr. Goldfogel passed 4 -3 with Imhof,
34 Brenner and Laidlaw against.

11. EXECUTIVE'S REPORT
2 Grant applications: Van Zanten distributed the following:- an application for help
3 on the Chuckanut Mountain Park area (AB92 -275). IAC has recommended approval for
4 50 percent of the cost; and an application for the Sunset Farms Park grant (AB92 -274). The
5 property owner would donate the value of 50 percent for the Sunset Farms Park application.
6 Van Zanten presented Ed Henken, County Engineer, with a commendation for
7 receiving the County Engineer of the Year award at the recent Washington State
8 Association of Counties.
9 OPEN SESSION
10 Jean Westgate, 3908 Cabrant Road (AB92 -003): Mentioned the pre conference
11 hearing held in Olympia saying it had been stated by Dr. Easterbrook that there were
12 mistakes in the findings and issued a suspension of all logging east of Fall Creek but did
13 allow logging to be pursued in the northern areas. They were assessed a $72,000 bond to
14 pursue the appeal. The Friends of Sumas Mountain asked the Council to join in the pursuit
15 of this issue as a bond would not then be required.
16 Harry Skinner, 6600 Goodwin Road (AB92 -003): He said they have lost a third of
17 the site and Babcock stated there is already failure of the serpentinite system. He asked the
18 Council to join and help the Friends in this appeal.
19 Josselyn Winslow, 433 -17th Street (AB92 -133): Objects to the Northwest Regional
20 Council representation. She objects to the amount of money spent on a directory when that
21 amount would have funded the non -profit Health Resource Network for several years.
22 Cynthia Dahlstrom, 121 Poplar Drive, Everson (AB92 -267): Wants the moratorium
23 on surface mining extended.
24 Phyllis Kronenburg, Pole Road (AB92 -267): Urges adoption of the ordinance to
25 extend the moratorium for surface mining.
26 John Peterson, 3341 Cedarville Road (AB92 -267): Urged adoption of the ordinance
27 to extend the moratorium for surface mining. He mentioned someone violated the
28 moratorium and has not cleaned up the mess.
29 W.D. Purnell, P.O. Box 5346 (AB92 -003): He said he is a professional engineering
30 geologist as opposed to a professional engineer as stated.
31 Steve DeBolt, 5203 Drayton Harbor Road: He said June 24 is the deadline for
32 getting comments in for the SEPA review on the West Semiahmoo Golf Course
33 development. He said the County is using the same contractors for all these issues. He said

1 they had a three party meeting with Dakota Creek, California Creek and Birch Point Creek
2 saying they did not want to be annexed to Blaine.
3 Ken Ryan, 7098 Goodwin Road (AB92 -003): Wants the Council to look at the
4 Sumas Mountain appeal very seriously.
5 Alvin Starkenberg, 774 Meadowlark Road, Lynden (AB92 -267): Questioned why this
6 is an emergency. It would not be here if the Council hadn't made so many changes and
7 would be solved by now. He urged the Council to move quickly in the next sixty days to
8 resolve this issue. He said the small gravel companies are suffering over this.
9 Laura Sullivan, 4789 Drayton Harbor Road: Said she is in favor of maintaining the
10 zoning as is.
11 John Van Boven, 7017 Everson - Goshen Road (AB92 -267): He said he is concerned
12 about the moratorium on the surface mining permit. He said he has had an application in
13 Buildings & Codes for over a year and it has cost him over $14,000 so far. As an industry,
14 they have tried to work with the County to resolve this issue.
15 Jack Petrie, 2952 Sunset (AB92 -003): Asked that the County stay out of the Sumas
16 Mountain issue.
17 Susan Deemer, Bellingham (AB92 -003): Said Trillium is spraying 24D east of
i8 Glacier; are clear cutting many areas; violates water quality.
19 Fred Nowicke, 4133 Berg Road (AB92 -267): Asked if it was only new gravel permits
20 that were being restricted. Congratulated Ed Henken for being chosen Engineer of the
21 Year!!
22 Brenner asked Henken if speed bumps could be put on Drayton Harbor Road.
23 Henken said it would not be possible. '
24 SUMAS MOUNTAIN ISSUE (AB92 -003):
25 It was decided to discuss the issue at this time.
26 W.D. Purnell, Geological Engineer, asked that no decision be made because the TAT
27 Corp. was not well represented. He said all serpentinite bodies do no behave similarly. He
28 said the judge had said there would be further hearings.
29 Items discussed were: further hearings in Thurston County Court; damages and
30 liabilities that may be felt; relevance of sandstone and serpentinite; hydrology; serpentinite
31 near the fault; major fault at the base of Sumas Mountain; risk associated with the
32 components; mitigation that would cause sliding; significant cap; technical knowledge of the

1 threats to public safety; potential for landslides is high according to the Judge.
2 Comments were made by: Warner, Pernell; Brenner; Henderson; Harris.
3 Dr. Babcock arrived. Warner spoke against hearing him and Brenner said it was
4 unfair to not hear him when we've heard the other side.
5 Watts said the County could bear a liability greater than the $72,000.
6 Items discussed were: Nooksack Tribe has joined the appeal; if the County joins a
7 bond would not be required; TAT is suing the Forest Practices Board on Thursday in Court
8 in Thurston County; is there sufficient risk that the County should join in the appeal.
9 Comments were made by: Laidlaw; Warner; Brenner.
10 Harris read-the Judge's 'comments as follows: After reviewing the statements of
11 Babcock, Easterbrook and Purnell he finds that the potential for similar slope failure is
12 extremely high. The danger to the area north of Fall Creek is superficial where the logging
13 could proceed.
14 LAIDLAW MOVED TO HAVE THE COUNTY JOIN AS INTERVENER WITH
15 THE FRIENDS OF SUMAS MOUNTAIN IN THE APPEAL OF T.A.T.
16 Vander Yacht, Laidlaw and Harris spoke in favor of the appeal.

20 1. RESOLUTION ESTABLISHING THE SIX YEAR COMPREHENSIVE
21 ROAD PROGRAM FOR WHATCOM COUNTY (AB92 -226A)
22 The public hearing was opened.
23 Steve DeBolt, 5203 Drayton Harbor Road: Noted that the Drayton Harbor Road,
24 Shintaffer Road and Harbor View are ranked very low. He encourages the extension of
25 Lincoln Road to handle the extra. several thousands of homes that have been approved.
26 Laura Sullivan, 4789 Drayton Harbor Road: Said she agrees the only hope would
27 be to extend Lincoln Road.

13 2. RESOLUTION GRANTING A REVOCABLE ENCROACHMENT
14 PERMIT, FILED BY MICHAEL MORBERG (AB92 -210)
15 The public hearing was opened.
16 Peggy Morrell, Alder Street: She lives within 500 feet from the area that Mr.
17 Morberg would like to build on. She said over 150 people signed that they were against
18 this. She also mentioned there was a deed turning this area over to the County as a
19 roadway and allowing this would not be carrying out the intent of the will.
20 Philip Serka, Attorney for Morberg: He said his client is requesting a change from
21 20 feet to 6 -10 feet to construct a limerock bulkhead to keep the tideland from damaging
22 his property. It is located on Sucia Drive and Beach Way. He said it will also keep
23 trespassers away from his residence. He agrees this is a public right -of -way. -
24 Norman Durell, He said if people are allowed to take some of this road, the people
25 on the other side would than want to do the same.
26 Joan Segar: She said that there are often cars parked which would block public
27 access if width lessened.
28 Bill Prince, Beach Way: It is a public right -of -way and a beach access. He said Mr.
29 Morberg has four and a half feet on his own property to build a bulkhead.

1 Michael Morberg, 4997 Sucia Road: Said he had ownership of the road.

Brenner and Vander Yacht support the Henderson motion.
Laidlaw said Serka did a sensitive job in counseling his client toward additional
compromise but is very concerned with the loss of beach access.
The motion carried unanimously.

The public hearing was opened. Hearing no comment, the hearing was closed.

14 long -term plan. He recommended an interim ordinance be introduced and dealt with in the
15 regular manner.
