Annual Council reorganization (AB91 -001) - Election of officers - Committee assignments Laidlaw nominated the slate as follows: Council Chairperson Council Vice - Chairperson Executive Pro- Tempore Capital Projects Finance & Personnel Planning & Development Public Svcs. & Solid Waste - Warner - Laidlaw - Imhof - Warner, Laidlaw & Imhof - Henderson, Laidlaw and Imhof - Vander Yacht, Henderson and Harris - Vander Yacht, Imhof and Brenner LAIDLAW MOVED THE ABOVE NOMINATIONS BE CONFIRMED. The motion carried unanimously. LAIDLAW MOVED THAT IMHOF, HARRIS-.AND BRENN ER BE ON THE WATER RESOURCES COMM=E. The motion carried unanimously. IMHOF MOVED VANDER YACHT BE APPOINTED TO THE COUNCIL ON AGING AND THE NORTHWEST REGIONAL COUNCIL. The motion carried unanimously. 1 Warner asked Brenner to attend the Water Utility Coordinating Committee on 2 Thursday; if there is a time conflict, Warner said he would fill in. 3 READING AND APPROVAL OF MINUTES 4 The minutes of the October 15, 1991 meeting were accepted as presented. 5 EXECUTIVE ITEMS 6 1. REQUEST FOR AUTHORIZATION OF A DEVELOPMENTAL 13 DISABILITIES SERVICES CONTRACT BETWEEN WHATCOM 14 COUNTY AND CURRENT INDUSTRIES FOR THE 1991 -93 BIENNIUM 15 IN THE AMOUNT OF $305,144.28 FROM STATE DEVELOPMENTAL 16 DISABILITIES FUNDS (PASS THROUGH) (AB92 -026) 17 Executive Van Zanten explained the previous eight service contracts which are 18 related. 19 IMHOF MOVED TO APPROVE ITEMS 1 -8. 20 Carl Allen, Coordinator of the Developmental Disabilities Department, explained the 21 financial issues and what each contractor is contracted to provide. 22 The motion carried unanimously. 23 9. Executive's Report 24 Road Progress Report (AB91410): Van Zanten distributed the report. She and Ed 25 Henken, County Engineer explained the items on the list and how they were progressing. 26 There was some discussion as to what roads were on this list because of the flood. 27 Nooksack River International Task Force Report (AB92 -035): This was released 28 yesterday by the Canadians who were very concerned about the impacts Nooksack flooding 29 had in their country. Van Zanten said she hopes the report on the funding of the flood 30 program will be ready for the Council before the next meeting. 31 OTHER ITEMS 32 2. NOMINATION & POSSIBLE APPOINTMENT FOR PLANNING 33 COMMISSION VACANCY (DISTRICT 2) (AB92 -027) Minutes, 1/14/92, Page 3 This issue- was taken out of order after the Executive Items. 2 HARRIS MOVED TO OPEN THE NOMINATIONS. 3 Harris nominated Clare Fogelsong. 4 Vander Yacht nominated Leslie Richardson and Jim Heeringa. 5 Laidlaw nominated Cyndy Anderson. 6 The nominations closed. 7 LAIDLAW MOVED TO SUSPEND THE RULES IN ORDER TO MAKE THE 8 APPOINTMENT TONIGHT. 9 The motion carried 6 -1 with Imhof against. 10 Each member was asked to vote for one of the four nominees: Clare Fogelsong; Jim 11 Heeringa; Leslie Richardson; and Cyndy Anderson. 12 Henderson Fogelsong 13 Vander Yacht Heeringa 14 Laidlaw Fogelsong 15 Warner Fogelsong 16 Imhof Heeringa 17 Harris Fogelsong 18 Brenner Richardson 19 Clare Fogelson was appointed. 20 SPECIAL PRESENTATION 21 Friends of Sumas Mountain: Concerns about logging impacts (AB92 -003) 22 Jean Westgate, Foothills of Sumas Mountain. She asked that the other residents 23 from the foothills stand up and most of the room stood up. She discussed the fears of the 24 residents about proposed logging by Trillium in the area and provided a handout which will 25 be kept in AB91 -003. Westgate said the residents feel all logging on Sumas Mountain 26 should be under a Class IV Special Permit because their_ homes, health, and welfare are 27 being threatened. She asked that the Department of Natural Resources .(DNR) do a study 28 in this area. 29 Ken Ryan, Foothill resident: He said there had been meetings with Trillium's Mr. 30 Iverson and Mr. Menish who seemed angry that the residents were questioning them. He 31 said DNR has not monitored the occurrences on this mountain. He mentioned the meeting 32 at the Rome Grange stating that state law gives local agencies power to govern the health Minutes, 1/14/92, Page 4 1 of its residents. 2 Noah Westgate, 3908 Cabrant Road: He said he was 11 years old and has become 3 aware of the damage that may be happening to the land above his home. He said he loved 4 the trees and hopes they will be protected for when he is an adult. 5 Cyro Frances PaoliMo, 3912 Cabrant Road: He said he lives below the first cut and 6 has three streams that flow through his property. He said a hundred families would be 7 impacted by a clear cut. Logging company are in violation by crossing Swift Creek without 8 permits. Surface motion on the mountain could cause slides; roads equal surface disruption 9 of the worst kind. The people objecting to this are all middle class people who are suffering 10 stress and fear at what might happen to their homes. Paolillo begged the Council to use its 11 powers to protect the mountain. 12 Items discussed were: who had been involved; what the powers of the Council are. 13 Comments were made by: Harris; Jean Westgate; _Warner; Randall Watts, Chief 14 Civil Deputy Prosecutor. 15 LAIDLAW MOVED TO HAVE THIS ISSUE REFERRED TO THE PLANNING 16 AND DEVELOPMENT COMMITTEE. 17 The motion carried unanimously. 18 OPEN SESSION 19 No one spoke. 20 HEARINGS 21 1. RESOLUTION TO SELL SURPLUS PROPERTY (STRUCTURES LOCATED AT 22 21011) 2105 AND 2109 NEW STREET) (AB91 -469A) 23 The public hearing was opened. 24 Rodney Lund, 1322 Roland: He said the buildings were about three or four bedroom 25 houses. He urged the Council to donate or earmark these properties for the homeless; they 26 would be much better than a piece of plastic for those without homes- 27 Roger DeSpain, County Parks Director: He said his department did contact the 28 Housing Authority, the Opportunity Council and the City of Bellingham; these agencies said 29 the cost of moving them would be prohibitive. 30 The hearing was closed. Minutes, 1/14/92, Page 5 1 Items discussed were: could these be offered at a later time to housing agencies; 2 asbestos removal from these homes was too costly to pursue. 3 Comments were made by: Laidlaw; Watts; Henderson. 4 LAIDLAW MOVED THE RESOLUTION BE APPROVED. 5 LAIDLAW MOVED TO AMEND ON LINE 27 AFTER "RECEIVED,' BY 6 ADDING '"THEY SHALL BE MADE AVAILABLE FOR ONE DOLLAR EACH TO 7 APPROVED NOT - FOR - PROFIT AGENCIES." LINE 28 TO BE ELIMINATED 8 FOLLOWED BY "AND BE IT FURTHER RESOLVED THAT IF NO AGENCY 9 ACCEPTS THE STRUCTURES, THEY SHALL BE DEMOLISHED BY AWARD TO 10 THE LOWEST RESPONSIVE BIDDER, FOLLOWING AN ADVERTISED CALL FOR 11 SEALED BIDS." 12 The amendment was carried unanimously. 13 The resolution carried unanimously. 14 OTHER ITEMS 15 1. ORDINANCE CREATING LAKE MANAGEMENT DISTRICT NO. 1 FOR 33 LAKE SAMISH (AB92 -029) Minutes, 1/14/92, Page 6 1 6. ORDINANCE ESTABLISHING A FULL-TIME POSITION FOR THE 2 NOXIOUS WEED BOARD (AB92 -030) 3 7. RESOLUTION CANCELLING DELINQUENT PERSONAL PROPERTY 4 TAXES (AB92 -031) 5 Items 1 -7 were received by Council and will be by Council and will be forwarded to 6 the appropriate action. 7 REPORTS AND OTHER ITEMS FROM COUNCIL MEMBERS 8 Council of Governments Workshop: Laidlaw said a meeting will be held on 9 Wednesday, January 15, regarding the taking of private property rights and the constitutional 10 aspects of the Growth Management Act. 11 Whatcom Transportation Authority (WTA) Public Hearing: Thursday evening the 12 WTA will hold a public hearing on Disabilities Act as it relates to public transportation. 13 She said there will be a complete disabled accessible bus replacement in the near future. 14 Staff Report: Bob Woods asked if the reports by departments were helpful and 15 should more be planned. He suggested the Council members visit the departments.
