Forest Street, Suite 203. Also Present: Absent: Bob Imhof None. Dennis Vander Yacht . Marge Laidlaw Ken Henderson Barbara Brenner Larry Harris (arrived late) 1. REVIEW OF STATUS OF LITIGATION REGARDING WATER DISTRICT 10 APPEAL TO THE SHORELINES MANAGEMENT BOARD (AB92 -246) 2. DECISION ON APPEAL OF HEARING EXAMINER'S DECISION ON A PRELIMINARY PLAT, "BELT .AIRF ESTATES," PLS92 -6, FILED BY JOHN GILLIES, ET AL. (AB92 -372) 3. DECISION ON APPEAL OF HEARING EXAMINER'S DECISION ON HEARING EXAMINER FILE NO. SHS92 -13, NORTON, FILED BY NORTON (AB92 -384) (This item was withdrawn; appellant had been granted an extension and this should not have appeared on the agenda at this time). 4. DECISION ON APPEAL OF HEARING EXAMINER'S DECISION ON ADMINISTRATIVE APPEAL 12 -92, FILED BY PAT WHEAT (AB92- 412) 5. DISCUSSION OF RECONSIDERATION OF HEARING EXAMINER'S DECISION ON CU92 -17 (SCHNAUZER CROSSING BED & BREAKFAST), FILED BY McALLISTER (AB92 -366) Under State law the Council was allowed to discuss all items in executive session (item 1 pursuant to RCW 42.30.110 (1) (i), so the Council could discuss pending litigation or litigation in progress; and items 2 through 5 pursuant to RCW 42.30.140 (2) in order for the Council to be briefed by its attorney on a quasi-judicial matter). Warner noted that for the first item the following parties may be present for the discussion: Roger Ellingson, Blaine attorney; Jay Taber, Sherilyn Wells, and Ed McMillan, associated with the Whatcom Falls Neighborhood Association; Rob Felix, general manager of Sudden Valley; and Phil Sharpe, attorney. IMHOF MOVED TO DISCUSS ALL ITEMS, SAVE FOR ITEM 3 WHICH WAS WITHDRAWN, IN EXECUTIVE SESSION AS ALLOWED UNDER STATE LAW. Motion carried unanimously, with Harris absent until just after the vote. Warner said the meeting would be closed to the public until about 7 p.m. The meeting was closed to the public.
