HomeMy WebLinkAboutSpecial Council July 8 1993WHATCOM COUNTY COUNCIL SPECIAL MEETING July 8, 1993 The meeting was called to order at 4:30 p.m. in the Council Chambers, 1000 North Forest Street, 2nd floor, by Marge Laidlaw, Chair. Also present: Absent: Imhof None Brenner Harris Vander Yacht Henderson Warner The purpose of this meeting is to discuss the preferred option chosen on the major development for the Cherry Point project, which fell into a grave legal area. As there is a possibility of the Council being sued, it would best to be sued on the issues rather than on legal procedure. Many clocks are running on this project, and there are also many complex procedures. One of the Council's options is to decide on a public hearing and limit the discussions to five issues. There are two other options. HARRIS MOVED TO RECOMMEND SETTING THE MATTER FOR PUBLIC HEARING WITH AN EMPHASIS ON THE FIVE MATTERS TO BE DISCUSSED PREVIOUSLY REFERRED TO. The five matters are: - Dock configuration for safety; - Legality of the Cherry Point Management Unit or in compliance with other state and federal laws; - Planning staffs substantial reservations about the project related to Shoreline Law; - The interrelationship, if any, between this project and the neighboring project; and - Questions raised by the Lummi Tribe. Discussion on the motion: Imhof explained why he is voting against the hearing. July 19 at 7 p.m. is the likely time for the hearing. The motion carried 6 - 1 with Imhof opposed. Informal business items: - Memo from a land use technician asking for Council's opinion re: the Text Amendment dealing with a general commercial zone vs. a manufacturing zone in a particular use not listed in any of the existing codes. - Major Development Permit Ordinance needs to be examined re: more flexibility for the Council to consider a matter in another form than a public hearing.
