Also Present: Bob Imhof (late) Absent: Dennis Vander Yacht 1. REQUEST FOR AUTHORIZATION FOR THE EXECUTIVE TO ENTER INTO AN AGREEMENT WITH AVALON COUNSELING AND TREATMENT FROM JULY 1, 1993 TO JUNE 30, 1995 FOR $53,736 (AB93 -436) Speakers: Marcia Gunning, Combined Treatment Services; Henderson; Tom Sutberry, Executive Office. Topics discussed: Grant monies; records of equipment and contracts; staff training. IMHOF MOVED TO RECOMMEND APPROVAL. The motion carried unanimously. 2. RESOLUTION AND BID AWARD RECOMMENDATION FOR THE INTERSECTION SIGNALIZATION- HANNEGAN ROAD AT EAST BAKERVIEW ROAD - CRP 992233 - TO WILDER CONSTRUCTION COMPANY FOR $251,952.10 INCLUDING TAXES AND RESOLUTION ESTABLISHING CRP NO. 992233 FOR THIS PROJECT (AB93 -437) Speakers: Nasser Mansour, Engineering; Henderson; Brad Bennett, Public Works; Bob Woods. Topics discussed: Four bids received; refunds /Capital Facilities Plan. IMHOF MOVED TO RECOMMEND APPROVAL OF RESOLUTION AND BID AWARD. The motion carried unanimously. DISCUSSION REGARDING FINANCIAL SYSTEM IMPLEMENTATION PROJECT (AB93 -435) Speakers: Tom Sutberry, Executive Office; Brad Bennett, Project Manager; Henderson; Roger DeSpain, County Parks; Shirley Forslof, Auditor. Topics discussed: Update of the meeting with Facilitator and Financial Management Committee to help them with implementing payroll system and organizing financial system; Administrative Services Dept. will eventually be managing the centralized accounting function; need more training in accounting theory and financial management systems; task takes teamwork to make it work; what has been accomplished in setting up this new system; explanation of special districts (total of 200 employees); County Auditor's Office is liason between financial system and special districts; there is now no processing fee for the special districts, but there are discussions for it in the future; most special districts have their own governing boards, which are the ones to approve the claims. 4. REQUEST FOR AUTHORIZATION FOR THE EXECUTIVE TO ENTER INTO LEASE AGREEMENT WITH WHATCOM SOCCER COMMISSION FOR PROPERTY AT SMITH ROAD AND NORTHWEST AVENUE. Speakers: Henderson; Barbara Cory, Treasurer; Roger DeSpain, County Parks. Topics discussed: The Parks Director is the contract's administrator; if reservations for time for the auction is necessary, a notice will be sent in January to the Soccer Commission and the Boys and Girls Club to let them know the time frame needed - -this is not part of the contract. IMHOF MOVED TO RECOMMEND APPROVAL. The motion carried unanimously. 5. REQUEST FOR AUTHORIZATION FOR THE EXECUTIVE TO ENTER INTO LEASE AGREEMENT WITH BOYS AND GIRLS CLUB FOR PROPERTY AT SMITH ROAD AND NORTHWEST AVENUE. IMHOF MOVED TO RECOMMEND APPROVAL. The motion carried unanimously. Finance Minutes, 11/9/93, Page 2 6. DISCUSSION ON THE REQUEST FROM DENNIS R. WILLIAMS, ATTORNEY, FOR BORDER GAS BAR TO REDUCE THE PENALTY ON THE LATE PAYMENT OF GAS TAX. Speakers: Barbara Cory, Treasurer; Henderson; Imhof; Bob Woods. Topics discussed: Form for gas tax is provided by the County Treasurer; 18 percent late fee, whether by one day or many; company's tax not in by deadline due to resignation of their bookkeeper; company feels penalty too severe for being late only one day. Bob Woods pointed out to the Committee that if they wanted to change the resolution, they would first have to confer with legal counsel. This change would likely not be retroactive, only from here forward. Discussion followed among Imhof, Woods and Henderson re: authority to change resolution, legal advice and possible graduated tax. HENDERSON MOVED TO RECOMMEND LEGAL COUNSEL EXAMINE WHETHER THE COUNCIL CAN, IN ITS CAPACITY AS THE TRANSPORTATION BENEFIT DISTRICT BOARD OF DIRECTORS, CHANGE THE RESOLUTION. The motion carried unanimously. Regarding the question of a graduated tax, Henderson asked the Treasurer to work with the Administration and bring back any recommendation regarding a change in the penalty structure.
