PLANNING COMMISSION
October 26, 1994
The meeting was called to order at 7 p.m. by Council Chair Robert Imhof in the
Council Chambers, 311 Grand Avenue.

PUBLIC HEARINGS
1. JOINT PUBLIC HEARING OF THE WHATCOM COUNTY COUNCIL
AND THE WHATCOM COUNTY PLANNING COMMISSION ON THE
REFERENDUM VERSION OF THE TEMPORARY CRITICAL
AREAS ORDINANCE (AB94 -548)
Imhof declared the public hearing open.
Speakers:
Dan Taylor, Planning & Development Services, spoke to the referendum process.
He pointed out that the document the Council decides on will be in effect until the end
of 1995. Then Mr. Taylor summarized the decision of the SEPA official.

1 Terry Galvin, Planning & Development Services, gave a brief outline of the
? Planning Department's recommendations. He urged the Council to move forward
3 quickly with whichever version is accepted. Their recommendation is to replace
4 "development permit" with "development" in the definition. Another recommendation is
5 to add the language referring to maintenance permits that was in the original ordinance,
6 thus allowing people doing annual maintenance to submit only one permit application
7 annually rather than one for each action taking place. He requested license to "clean up
8 sloppy language" on page 2 of their recommendation document.

10 Skip Richards, co- author of Referendum 92 -3, noted the background of the
11 referendum. He then spoke to those opposing this referendum.

13 The Chairs of the Council and the Planning Commission closed the public hearing
14 (oral testimony). Written testimony will be taken through Wednesday, November 2.
15 The issue will return to the Planning Commission, which will return it to the Council by
16 the end of November. Depending on the Council's budget schedule, action would be
17 taken in early December. Imhof requested the Planning Commission keep the Council
18 abreast of the schedule and activities of this item.
