The meeting was called to order at 1 :30 p.m.by Committee Chair Barbara
Brenner in the Council Chambers, 311 Grand Avenue.

COMMITTEE DISCUSSIONS AND RECOMMENDATIONS TO COUNCIL
1. REQUEST FROM RAY VON PROCTOR TO EXAMINE INCONSISTENT
APPLICATION OF A POLICY REGARDING NAMES FOR PRIVATE
ROADS AND REQUEST FOR NAME CHANGE OF HIS PRIVATE ROAD
(AB94 -492)

The Engineering crew stated the short plat can be amended and corrected. Also
needed is an affidavit to amend mylar with road name. Mr. von Proctor can now (just
recently) appeal to the Planning Department.
2. ORDINANCE REGARDING THE CLOSURE OF A PORTION OF
LOWELL AVENUE (AB94 -212A)

Starkenburg moved to recommend striking Items 7 through 14, page 1.

Motion carried unanimously.
Starkenburg moved to recommend striking ... "permanent" in "...permanent
closure... ", page 2.
Motion carried 2 -1 with Brenner opposed.
Starkenburg moved to recommend adding to page 2, line 12, ... "local fire
jurisdiction'....
Motion carried unanimously.
Starkenburg moved to recommend for approval.
Main motion carried 2 -1 with Henderson opposed.
3. RESOLUTION PROCLAIMING OCTOBER 23 AS UNITED STATES DAY
(AB94 -495)
Henderson moved to hold in Committee for verification of intent of originating
organization.
(Clerk's Note: No vote was taken on the motion; however, all verbally agreed without
the vote being called.)
4. PETITION FOR THE VACATION OF A PORTION OF VALLETTE
STREET, FILED BY STEPHEN P. KEMPSTON AND JULIE A.
NICHOLSON (AB94 -200) (HELD OVER FROM 7/12)
Speaking was Dan Gibson, Prosecuting Attorney.
Starkenburg moved to recommend to Council that the portion of Vallette Street
adjoining the property of Stephen Kempston and Julie Nicholson, as more fully described
in their petition for vacation, be vacated on:
1. Payment of $3,689;
2. Execution of agreement binding upon the present and future owners
a. That they will not resist condemnation of the property in issue if the
County or a successor in intent deems it necessary to construct Vallette Street through
that location;

b. That they will accept as compensation the value of the property then
determined by the County;
c. That they will participate without objection to the formation of an
assessment of an LID, if that takes place for such road construction; and
d. That they will recognize and not interfere with reasonable access in
regard to that trail permit previously granted.
Dan Gibson, Prosecuting Attorney, said that in agreeing to the above conditions,
they would now have title to the property, but it would be subject to the understanding
that if, in fact, it is necessary to put a road through in the future, the County would
condemn it and pay them (the owners) for it the price the County determines to be the
fair market value of that land.
This item will be held in Committee for two weeks for Mr. Kempston and
Ms. Nicholson to review Starkenburg's motion with the intent of working things out in
Committee.
5. DISCUSSION OF AND REQUEST FOR CONFIRMATION OR
WAIVER OF FRANCHISE REQUIREMENTS CONTAINED IN
ORDINANCE 92 -076 (GUINESS COMMUNICATIONS) (AB94 -292)
(HELD OVER FROM 9/13/94)

Henderson moved to table this item indefinitely.
Motion carried unanimously.
