Forest St., Suite 203, by Marge Laidlaw, Chair. Also present: Absent: Barbara Brenner Larry Harris Ken Henderson Bob Imhof Dennis Vander Yacht Dan Warner Laidlaw reported that the Council should set a date to meet with various employees to discuss the second phase of the reorganization which is the Administrative Services Department. Council agreed to meet Monday, June 14, 5:30 to 7 p.m. DISCUSSION ABOUT THE POTENTIAL APPEAL OF THE SUMMARY JUDGMENT RULING REGARDING THE CRITICAL AREAS ORDINANCE REFERENDA (AB92 -058D, AB92 -058E, AND AB92 -058F) 2. POTENTIAL MEDIATION UPDATE ON THE WATER DISTRICT 10 ISSUE (AB93 -246) 3. DISCUSSION REGARDING PENDING LITIGATION (WHATCOM SAND & GRAVEL V. WHATCOM COUNTY, BY CIVIL DEPUTY PROSECUTOR KAREN FRAKES)(AB93 -200) WARNER MOVED TO ADJOURN INTO EXECUTIVE SESSION PURSUANT TO RCW 42/30.110(1)(i) SO THE COUNCIL MAY DISCUSS PENDING LITIGATION OR LITIGATION IN PROGRESS. The motion carried unanimously and Laidlaw adjourned into Executive Session. Laidlaw reconvened into public session. WARNER MOVED TO APPEAL THE CRITICAL AREAS ORDINANCE REFERENDUM DECISION. Warner explained that not only will the referendum be extremely difficult to administer, but the law does not allow for direct citizen legislation on planning policies. Therefore the matter needs to be decided not only for use in this issue (he said he feels the referendum is badly written), but for all the times in the future when Council deals with land use issues. Laidlaw added that the whole thing goes back to the State Planning Enabling Act vs. the Home Rule Charter. (Other information discussed in Executive Session regarded the actual effect of the referendum which, according to attorneys, is to essentially make land disturbance for building in critical areas impossible, the opposite of the authors' intent.) The motion carried with Vander Yacht and Brenner opposed. Because there was no further business, Laidlaw adjourned the meeting.
