SPECIAL COUNCIL MEETING
WORK SESSION
May 2, 1995
The meeting was called to order at 11 :20 a.m. by Council Chair Robert Imhof in
the Council Chambers, 311 Grand Avenue.

WORK SESSION ON THE RESOLUTION CLARIFYING FLOW
CONTROL (AB94 -223C)
Imhof gave a history of the work done so far on this issue. The intent of today's
work session is to work on the draft resolution as presented (on file).
Brenner stated she does not believe the Flow Control Ordinance is valid and
thinks it is unconstitutional. Prosecuting Attorney Dan Gibson replied.
Fred Miller spoke to a question about separated waste (7 %), page 2, line 3.
Henderson questioned lines 1 -2, page 2 - -why aren't plastics listed? Jack Weiss replied.
Nelson inquired of page 2, line 31: "...not a specific facility." Is this adequate if
there is more than one site? Dan Gibson responded. Brenner felt that line should be
deleted, as designating a site is a politically made decision.
Henderson wondered how the numbers were decided upon (page 3, lines 2 -5).
Ken Bell, Recomp, replied, as did Dan Gibson.
There was discussion on hierarchy. Larry McCarter, RDS, addressed tonnage.

Jack Weiss, Solid Waste Advisory Committee, spoke about source separation
(curbside separation vs none). Nelson asked about the marketability of plastics. Fred
Miller spoke on the grades of recyclable materials.
Discussion followed regarding rate and penalty structure. Henderson also
questioned lines 26 -30, page 3 regarding residual ash vs recycling. Jack Weiss responded.
Also speaking was Larry McCarter, RDS, Frank Monsconi and Ken Bell.
Discussion of justification of rates followed.. Brenner wanted to know about
cleanup sites.
On page 5, line 8, Nelson spoke to the definition of unseparated waste. Larry
McCarter and Dan Gibson explained.
Henderson spoke to curbside recycling. Jack Weiss also spoke.
Henderson, Brenner, Ken Bell, Jack Weiss and Ed Nikula discussed cost
calculations.
Henderson questioned the maximum rate (page 5, lines 15 -20) and asked how
construction debris is to be dealt with. Starkenburg responded regarding negotiation
sessions now taking place. Brenner wanted to be able to see details on costs of
enforcement. Imhof inquired of penalty fees.
Nelson wanted to know the criteria for "parameters" on page 6, lines 3 -4, and how
they would be established.
Dave Bader, County Construction Recyclers (CCR), spoke regarding the public
process of making language changes and clarification (page 6, lines 9 -10). Dan Gibson
responded.
Fred Miller spoke to cost - benefit analysis language.
Henderson stated the intent of Flow Control should be cost competitive and
inclusive vs exclusive (page 4, lines 2 and 3 and page 6, lines 10 -11). Brenner suggested
deleting on page 6, lines 10 -11: "...cost - benefit analysis and eensider-atien of any finafteial
..
Discussion followed.
Dave Bader noted there are certain issues that would affect CCR if "they had to
live by some of these definitions or how they might be interpreted ". Council members
discussed the importance of flow control companies of getting their concerns in writing
and send to Council members and Jeff Monsen, Public Works.

Larry McCarter spoke to cost - benefit analysis. Jack Weiss also spoke. Discussion
followed. Vin Kelly asked about the public hearing process regarding cost - benefit
analysis. Dave Bader asked about the comment deadline.
