The meeting was called to order at 3 p.m. by Committee Chair Ward Nelson in
the Council Chambers, 311 Grand Avenue.

COMMITTEE DISCUSSIONS AND RECOMMENDATIONS TO COUNCIL
1. ORDINANCE TO AMEND URBAN FRINGE SUBAREA
COMPREHENSIVE PLAN MAP AND THE OFFICIAL WHATCOM
COUNTY ZONING MAP (AB94 -313)
Speakers:

Harris moved to recommend tabling this until the Urban Fringe Subarea
Comprehensive Plan is complete.
Motion carried unanimously.
Nelson moved to hold this item in Committee for two weeks.
(Clerk's note. This motion was not voted on.)
Harris moved to modify his motion to read: ... "tabling this until the Urban Fringe
Subarea Comprehensive Plan is complete or October 25, whichever comes first and then
take up this item (est. time, three weeks)."
Motion to amend carried unanimously.

2. ORDINANCE AMENDING TITLE 20 REGARDING PLANT NURSERIES
AND FOOD PROCESSING (AB94 -319)
Speakers:

Dawson moved for recommendation for approval.
Harris moved to recommend amending pg. 145 of packet, line 32 to add #9 to
read: ... "are prohibited in sensitive geologic areas within the County which are protected
by Ordinance from chemical roadside vegetation spraying, including but not limited to
Lake Whatcom Watershed, Lummi Island, County Shoreline Management Jurisdiction."
Harris amended his motion to read: ... "are prohibited in sensitive geologic areas
within the County which are protected by Ordinance from chemical roadside vegetation
spraying, including Lake Whatcom Watershed and Lummi Island and exclusive of retail
nurseries which operate chemical- free."
Motion to amend carried unanimously.
Harris moved to amend #9 by inserting after Lummi Island: "...and other areas
deemed to be water quality sensitive..."
Motion to amend carried unanimously.
(Clerk's Note. Main motion for recommendation for approval was not voted on.)
3. RESOLUTION REGARDING LUMMI TRIBAL JURISDICTION
(AB94 -390) (DELAYED FROM 9/13)
Speakers:
Dan Gibson, Prosecuting Attorney
Chris Heintz, President, Fee Lands Association
Skip Johnson, Attorney for Lummi Tribe
Dawson moved for recommendation for approval.
Motion carried 2 -1 with Harris opposed.
Nelson moved to amend
IT FURTHER RESOLVED... ".

4. ORDINANCE REQUIRING JURISDICTION NOTICE ON ENTERING
RESERVATION LANDS (AB94 -423) (DELAYED FROM 9/13)
Dan Gibson, Prosecuting Attorney, spoke to this item. He suggested the following
language be considered: ... "You may be subject to the laws of the Lummi Nation. Tribal
officers may detain non - Indian violators for delivery to the appropriate authorities."
Harris moved for recommendation of wording by Dan Gibson for approval.
Dawson moved to table this item until ready for action /response.
Nelson moved to move forward without recommendation.
Motion carried unanimously. (Clerk's Note. Committee Chair Nelson informed the
Recording Secretary that, for the record, the first two motions were to be considered
withdrawn.)
