Also Present: Marlene Dawson Larry Harris Absent: None COMMITTEE DISCUSSIONS AND RECOMMENDATIONS TO COUNCIL 1. ORDINANCE CONVERTING ACCESSORY DWELLINGS FROM CONDITIONAL USES TO ADMINISTRATIVE APPROVAL USES, MODIFYING THE REQUIREMENTS FOR LAKE WHATCOM AND LUMMI ISLAND, CREATING AN ADMINISTRATIVE APPROVAL SECTION FOR THE RESORT - COMMERCIAL ZONE, AND MODIFYING THE REQUIREMENTS OF ADMINISTRATIVE APPROVALS (AB95 -098A) Those speaking included: Nate Brown, Planning & Development Services Dan Gibson, Council's Counsel Bob Woods, Council Program /Budget Analyst Alvin Starkenburg, Council Member Barbara Brenner, Council Member Discussion took place, mostly regarding the flexibility of the size of the accessory dwelling. Would the requested changes require the Planning Commission's review? This question requires a legal opinion. Brown recommended the Council adopt this ordinance with the requested changes being monitored by the Planning Commission for one year. He was then asked about a time frame for a re- evaluation, which he thought might be as much as one year if this issue were.made a priority. Nelson moved to recommend forwarding without recommendation. Motion failed 1 -2 with Nelson in favor. Harris moved to amend by adding a sunset clause on page 333, line 34: 'BE IT FINALLY ORDAINED THAT the provisions of this ordinance shall remain in effect until January 15, 1997 ". Harris moved to amend this sunset date until January 1, 1997. Motion failed 1 -2 with Harris in favor. Dawson moved to amend this date until June 15, 1996. Motion carried 2 -1 with Harris opposed. Main motion carried 2 -1 with Nelson opposed. 2. ORDINANCE AMENDING TITLE 16 TO CHANGE THE DEFINITION OF SEPA OFFICIAL (AB95 -268) Those speaking included: Nate Brown, Planning & Development Services Jeff Monsen, Public Works Bob Andersen Nelson moved to recommend for approval. Motion carried unanimously. 3. ORDINANCE AMENDING WHATCOM COUNTY CODE SECTION 20.92, REGARDING APPEALS OF HEARING EXAMINER DECISIONS TO THE COUNTY COUNCIL (AB95 -232) Harris moved to recommend for approval. Nelson moved to amend by striking on page 343, lines 35 -36: " " as being redundant. Motion carried unanimously. On page 343, lines 27 -29 regarding transcript fees were discussed. Discussion took place regarding forwarding the transcript to the Council within blank number of days on page 343, line 27. It was suggested adding "or longer if extension granted" or "upon demonstration of good cause ". Dawson moved to amend by adding on page 343, line 27: " (Clerk's Note. The motion was not voted on as it was agreed this is a housekeeping matter, and the language will be worked on at a later time.) Dawson moved to amend by adding language on page 344, lines 8 and 9: "Within two working days after receipt of the Heafing Exa-wA-flefls transcript Motion carried unanimously. Dawson moved to amend by deleting on page 344, lines 14 -15: "...must be filed in writing, along with reee i{s ten (10)... ". Motion carried unanimously. On page 344, line 27, 35 versus 21 days was discussed; it was decided to hold any language change until after the state legislature has made any changes to the Regulatory Reform Act, which will affect this issue. DISCUSSION REGARDING THE CLOSURE OF THE NOOKSACK RIVER ABOVE ACME BRIDGE TO INNERTUBERS AND KAYAKERS TO PROTECT FISH HABITAT (AB95 -279) Those speaking included: Larry Simkins, Parks Department Bill Sterling, Friends of South Fork Jeff Margolas, Van Zanten According to Margolas, the issue is competing species and competing industries. Sterling noted they are proposing that they and the Parks Department examine the problems and have Parks staff give them a report. A list of their concerns was faxed to the Council members. Funding was requested to establish safe parking, sanitation, garbage and recycling at the points where they hope to control some of the recreational use. The amount of funding is not known, but basically $4,000 is needed. Signage is also being requested. The fear is that the fish may be beyond saving. The water levels go to critically low levels in the summer months. The entire process is very convoluted and complicated. Simkins stated there are no funds in the Parks Department's budget. Bob Woods, Council Program /Budget Analyst, noted there are no funds in the budget for this project. OTHER BUSINESS WA -CERT (AB95- 201A): Bob Woods announced he has the forms the Council will need to re -rank the nine positions needed to be forwarded to the state.
