January 10, 1995
The meeting was called to order at 3 p.m. by Committee Chair Ward Nelson in
the Committee Room of the Council Chambers, 311 Grand Avenue.

COMMITTEE DISCUSSIONS AND RECOMMENDATIONS TO COUNCIL
1. REQUEST FOR COUNCIL ACTION ON A PLANNING COMMISSION
RECOMMENDATION TO DENY A REZONE AMENDMENT
(COMMONLY REFERRED TO AS THE CUSTER REZONE) (AB95-
025)
Dan Gibson, Attorney for Council, stated his understanding of the procedural
situation on this issue. He suggested that the action on the rezone request be held in
abeyance pending the determination of the SEPA appeal. Inasmuch as the Council may
find itself in the position of adjudicating that, it would be appropriate to avoid
involvement of the substance of the request at this point.
(Clerk's Note: Nelson requested a Committee executive session with Dan Gibson to
discuss this matter further.)
After their return from the executive session, Dawson moved to table this item
until after the appeal.
Motion carried unanimously.
2. RESOLUTION ADOPTING RECOMMENDATIONS FOR OPEN
SPACE /TIMBER APPLICATIONS (AB95 -026)
Dan Taylor, Planning, spoke on this issue. He stated it needs a hearing. The law
has recently changed so that in the future the Planning Commission does not do these,
and there is no public benefit rating system for timber.
This item was withdrawn by staff.

OTHER BUSINESS
Nelson had earlier requested Dan Taylor to explain the role and relationship
between the DNR (Department of Natural Resources), our development permit process
and individuals cutting trees on their own property.
Nate Brown, Planning & Development Services, also spoke to this question.
