Also Present: Marlene Dawson Larry Hams Absent: None COMMITTEE DISCUSSIONS AND RECOMMENDATIONS TO COUNCIL: 1. REQUEST TO AMEND THE URBAN FRINGE SUBAREA COMPREHENSIVE PLAN MAP AND THE OFFICIAL ZONING MAP FROM TOURIST COMMERCIAL TO GENERAL COMMERCIAL FOR APPROXIMATELY 29 ACRES AND FROM URBAN RESIDENTIAL MEDIUM DENSITY /18 DWELLING UNITS PER ACRE TO GENERAL COMMERCIAL FOR APPROXIMATELY SIX ACRES (AB94 -313) (KEPT IN COMMITTEE ON 6128) Speakers: Dan Taylor, Planning & Development Robert Tull, Attorney for the applicant George Wisbey Margaret Wisbey Harris moved to recommend for accepting Planning & Development's recommendation to take no action on this item at this time. Motion failed 2 -1 with Harris in favor. Nelson moved to recommend for bringing. forward to the full Council for public hearing to be conducted at the earliest opportunity. Motion carried 2 -1 with Harris opposed. 2. EMERGENCY ORDINANCE EXTENDING THE INTERIM ZONING ORDINANCE, WHATCOM COUNTY CODE, CHAPTER 2.24A, FOR SIXTY (60) DAYS (AB94 -375) Dan Taylor, Planning & Development, spoke. Planning Minutes, 7/12/94, Page 1 Harris moved to recommend for approval. Motion carried unanimously. COUNCIL "CONSENT AGENDA" ITEMS None scheduled. OTHER BUSINESS Dan Taylor, Planning & Development, spoke to two re -zones that need to be brought up. He wanted approval of the Council to allow his department to break the batch in order to bring these two items forward. He requested the Committee take action when they are received. Nelson mentioned text wording change coming up for light industrial zone regarding a food processing plant. Harris requested a report the Ludtke violation situation. Dan Taylor stated he has visited the site to investigate and reviewed the administrative processes to find Mr. Ludtke has cleared from property line to property line, which is inappropriate. The staff has been instructed to re- examine the policies, and some revisions are being prepared. Mr. Ludtke was clearly in violation and clearly took advantage of the situation by relying on the direction of the County. This is an administration problem that is now being revised. "Going back" on Mr. Ludtke is very difficult at this point due to the instructions he was given; however, the chance of this happening in the future will be very limited. A full report will be given to the Committee. Harris mentioned the Critical Areas Ordinance that will be discussed this evening. Mr. Taylor said they are putting together a schedule, which will be available next week. Mr. Taylor also noted that Steve Brisbane has appealed for reconsideration to the Hearing Board. ADJOURN There being no further business, the meeting was adjourned.
