HomeMy WebLinkAboutCouncil October 31 1995WHATCOM COUNTY COUNCIL Regular Council Meeting October 31, 1995 The meeting was called to order at 7 p.m. by Council Chair Robert Imhof in the Council Chambers, 311 Grand Avenue. Also Present: Absent: Marlene Dawson None Larry Harris Alvin Starkenburg Ken Henderson Ward Nelson Barbara Brenner ANNOUNCEMENTS Imhof announced that during executive session the appeal of the Hearing Examiner's decision filed by Nelson was discussed (AB94 -459). Imhof moved to overturn the Hearing Examiner's decision and allow dock construction to the terms and conditions of County staff. Motion carried 5 -2 with Henderson and Harris opposed. Imhof also announced that during executive session the appeal of the Hearing Examiner's decision filed by Kline was discussed (AB95 -215). Imhof moved to overturn the Hearing Examiner's decision and allow the 252 sq ft addition to the residence at Cain Lake. Motion carried unanimously. Additionally, Imhof announced that during executive session the appeal of the Hearing Examiner's decision filed by Frere was discussed (AB95 -346). Imhof moved to overturn the Hearing Examiner's decision and allow dock construction to the terms and conditions of County staff. Motion carried 4 -3 with Henderson, Harris and Brenner opposed. Regular Council Minutes, 10/31/95, Page 1 1 Imhof announced that in executive session they also discussed pending litigation 2 (AB92 -371). 3 4 Imhof moved to accept the settlement on the Weinberg case which has been 5 made with the Department of Ecology as conditioned. 6 7 Motion carried unanimously. 8 9 SPECIAL PRESENTATION 10 11 WHATCOM SELF -HELP HOMES' APPLICATION FOR A 12 COMMUNITY DEVELOPMENT BLOCK GRANT (AB95 -427) 13 14 Linda Larshus, President of Self -Help Homes, gave a presentation on the Self - 15 Help Home Program. She explained how the process works and that a 1,200 hour 16 commitment is required by those who qualify for those homes. She introduced Mr. Paul 17 Schissler, who is helping with this project. He stated the application would be prepared 18 by Self -Help Homes for review and submitted by the County to the state. He requested 19 authorization to take that step. 20 21 Mike Roberts, President of Energy Homes in Point Roberts, spoke in support of 22 this issue. 23 24 FOR COUNCIL ACTION. - 25 26 RESOLUTION AUTHORIZING THE ADMINISTRATION TO APPLY 27 FOR A COMMUNITY DEVELOPMENT BLOCK GRANT IN THE 28 AMOUNT OF $500,000 (AB95 -427) 29 30 Brenner moved approval of the resolution. 31 32 Imhof moved to amend on page 1, line 7 and page 2, line 2 to change the word 33 "authorize" to "request ". 34 35 Friendly amendment was accepted by Brenner. 36 37 Motion carried unanimously. 38 39 The written record is to be left open until November 12 at 5 p.m. Written 40 comments will be forwarded to the state. 41 42 OPEN SESSION 43 44 The following people addressed the Council: Regular Council Minutes, 10/31/95, Page 2 1 Josselyn Winslow: North Sound Regional Support Network (AB94 -143) 2 Tom Richardson, 3005 Haxton Way: North Sound Regional Support Network 3 (AB94 -143) 4 5 CONSENT AGENDA 6 7 1. AN ORDINANCE REGARDING ESTABLISHING SPEED LIMITS ON 31 ALL ROADS WITHIN THE PLATS OF PARADISE PARK, PARADISE 32 PROPERTIES AND PLAT OF GREENBROOK (AB95 -420) 33 34 Ed Henken, Engineering, explained the location of the speed limit change. 35 36 Imhof opened the public hearing; however, there were no speakers. 37 38 Imhof closed the public hearing. 39 40 Starkenburg moved to adopt the ordinance. 41 42 Motion carried unanimously. 43 44 Regular Council Minutes, 10/31/95, Page 3 2. AN ORDINANCE REGARDING INSTALLING STOP SIGNS ON CERTAIN COUNTY ROADS IN THE NORTHERN PORTION OF THE BIRCH BAY COMMUNITY (AB95 -421) Ed Henken, Engineering, gave a brief staff report. Imhof opened the public hearing; however, there were no speakers. Imhof closed the public hearing. Henderson moved to adopt the ordinance. Motion carried unanimously. 3. ORDINANCE CLARIFYING PROCEDURES OF THE COUNCIL WHEN ACTING IN OTHER CAPACITIES (AB95 -414) Dan Gibson, Council's counsel, explained the reasoning behind this ordinance. Imhof opened the public hearing, and the following person spoke: Frank James, 3511 Chuckanut Avenue Hearing no one else, Imhof closed the public hearing. Brenner moved to adopt the ordinance. Harris moved to add the following language to the ordinance on page 2, line 11 after the word council... . There was discussion on the motion. Motion to amend carried 6 -1 with Starkenburg opposed. Henderson moved to strike the last sentence on page 2, lines 10 and 11. Motion failed 2 -5 with Henderson and Harris in favor. Motion to adopt as amended carried unanimously. 4. ORDINANCE ELIMINATING THE CONSERVATION FUTURES PROPERTY TAX (AB95 -412) Dan Gibson, Council's counsel, responded to a legal question.
