24 Imhof moved to reconsider certain fines imposed by staff on Mark Weinberg and
25 to sustain a $750 fine for violation of a no entry buffer.

Will Rice and Rich Baird began their presentation. Topics discussed included:
Ten years of change in Whatcom County; Whatcom County Assessor timelines;
Whatcom County new construction history; recommendations for automation; and the
benefits and shortfalls of annual revaluation cycles.
PUBLIC HEARINGS
1. PETITION FOR VACATION OF A PORTION OF SECOND STREET
FILED BY DONNA MARIE CLARK (AB94 -616)
Ed Henken gave background information on this item and recommended approval
of the vacation.
Civil Deputy Prosecutor Dan Gibson answered questions from Council Members.
Dawson opened the public hearing, and the following people spoke:

Imhof moved approval of the vacation.
There was discussion on the motion.
Brenner moved to amend to read that the North half be vacated and the road be
maintained as it is currently.
Motion to amend failed 1 -6 with Brenner in favor.
Main motion carried 6 -1 with Brenner opposed.
2. ORDINANCE GRANTING A NON - EXCLUSIVE FRANCHISE TO THE
HEMMI ROAD WATER ASSOCIATION FOR A PERIOD OF 25 YEARS
PURSUANT TO STATE LAW AND SECTION 9.30 OF THE WHATCOM
COUNTY HOME RULE CHARTER TO OPERATE AND MAINTAIN
WATER MAINS AND WATER DISTRIBUTION LINES ALONG CERTAIN
ROADS WITHIN THE UNINCORPORATED AREAS OF WHATCOM

4. ORDINANCE REGARDING REVISING THE SPEED LIMIT ON SLATER

TOWNSHIP 39 NORTH, RANGE 2 EAST, W.M. (AB95 -095)

6. RESOLUTION AUTHORIZING THE SALE OF COUNTY -OWNED
PROPERTY, REQUEST 95 -2 (AB95 -089A)
Whatcom County Treasurer Barbara Cory and the City of Everson Mayor Pro -
Tem Ron Waldo gave background information on this item.
Dawson opened the public hearing.
Hearing no one, Dawson closed the public hearing.
Starkenburg moved approval of the resolution.
Motion carried unanimously.
7. RESOLUTION AUTHORIZING THE SALE OF COUNTY -OWNED
PROPERTY, WITHOUT BIDS, REQUEST 95 -3 (AB95 -090A)

8. DISCUSSION OF PROPOSED AMENDMENT TO BEACON GROUP
CONCOMITANT AGREEMENT (AB95 -110)

6 Imhof moved approval of the concomitant agreement extension.

8 Imhof moved to amend to extend the concomitant agreement for two (2) years
9 rather than only one (1).

11 There was discussion on the motion.

13 Imhof moved to amend the amendment and grant the extension for only six (6)
14 months, ending July 31, 1995.

16 Planning and Development Services Director Nate Brown stated that the
17 concomitant agreement actually addresses the conversion aspect specifically. This is not
18 an automatic process the Council has to go through to establish a rezone process to
19 UR 4. This is, however, not an automatic requirement should this concomitant
20 agreement fail.

22 Motion to amend carried 5 -2 with Henderson and Harris opposed.

28 1. DISCUSSION OF THE PROPOSED 1995 - 1996 WORK PROGRAM
29 FOR THE PLANNING DIVISION OF PLANNING AND
30 DEVELOPMENT SERVICES (AB95 -134)

32 Planning and Development Services Director Nate Brown gave a presentation,
33 following along with the information from his prepared packet (on file, AB95 -134)

35 REPORTS AND OTHER ITEMS FROM COUNCIL MEMBERS

37 Flow Control (AB95 -132): This morning's special Council meeting was briefly
38 discussed. Jeff Monsen, Public Works, was asked when he could respond to the items in
39 Nelson's document. Imhof stated the Council Members should read the document and
40 get questions and comments to Monsen. Nelson wanted everything to be implemented
41 into the Flow Control so everyone plays on the same song sheet. This item will be put
42 on the agenda for March 14, 1995.

1 lipping Fee (AB95 -150): Henderson inquired of Jeff Monsen, Public Works, if he
2 knew what is happening regarding the SWAC surcharge on the dumping fees. Is this
3 illegal? This matter needs to be pursued. Henderson requested a report from Monsen
4 and also the Prosecutor's Office on the legality of this issue and what our obligation is to
5 them in the event this continues. Can the Council complain to the United
6 Transportation Center (UTC)? This item will be placed on the March 14, 1995, agenda
7 for executive session in the Committee of the Whole.

9 Bob Woods commented he will be attending a conference at the end of this
10 month in Olympia on automation, technology and customer service for the government
11 sector. Some County department heads have also been invited.
