Regular Council Meeting
January 3, 1995
The meeting was called to order at 7 p.m. by Chair Bob Imhof in the Council
Chambers, 311 Grand Avenue.

OPEN SESSION
Jim Jordan, Smith Road: Asked the Council to lift a moratorium on cutting down trees
that blow down over fences and property lines and also allow selective logging for clean-
up purposes.
Dr. Don Ellwanger, 5547 Guide Meridian, Bellingham (AB95 -009): Had concerns
regarding a proposed unlawful eviction by the Whatcom County Sheriff's Department
under court order issued by Superior Court Judge Michael Moynihan.
Roger Allan Davis, ( ?): The proposed eviction of Dr. Don Ellwanger (AB95 -009).
Theresa Sansron, ( ?): The proposed eviction of Dr. Don Ellwanger (AB95 -009).
OTHER ITEMS
Brenner moved to go into executive session to discuss items 1 and 2.
(Discussion of this item may take place in executive session (closed to the
public) pursuant to RCW 42.30. 110 (1) (i), in order for the Council to discuss
pending litigation or litigation in progress.)
The motion carried 6 -0.
1. APPEAL OF HEARING EXAMINER'S DECISION TO DECLINE
JURISDICTION OVER AN APPEAL OF A LAND DISTURBANCE
ORDINANCE MATTER FILED BY MARK WEINBERG (AB94 -462)
Brenner moved to uphold the Hearing Examiner's decision.

Motion carried 6 -0.
2. APPEAL OF PLANNING AND DEVELOPMENT SERVICES
DEPARTMENT'S IMPOSITION OF PENALTIES UNDER THE LAND
DISTURBANCE ORDINANCE FILED BY MARK WEINBERG (AB94 -462A)
Dawson moved to uphold the Planning and Development Services Department's
imposition of penalties.
Motion carried 5 -1 with Henderson opposed.
3. RESOLUTION AMENDING RESOLUTION 94 -059 ESTABLISHING DATES
FOR 1995 COUNTY COUNCIL MEETINGS (AB94 -607A)
Imhof moved approval of the resolution.
Nelson moved to amend the resolution, changing the first meeting date in
November from November 7 to November 8.
Motion to amend failed for lack of a majority vote.
Motion to approve the resolution carried 6 -0.
4. BRIEF DISCUSSION OF PROCEDURE TO FOLLOW IN CONSIDERING
AMENDMENTS TO THE TEMPORARY CRITICAL AREAS ORDINANCE
(AB94 -548A)
Council adopted an interim version December 13 (Ordinance 94 -078, lasting only 60
days). Adoption of the final version of the Temporary Critical Areas Ordinance will
occur following a public hearing on January 24.
The Council briefly discussed procedure.
