HomeMy WebLinkAboutCouncil February 7 1995WHATCOM COUNTY COUNCIL Regular Council Meeting February 7, 1995 The meeting was called to order at 7:15 p.m. by Chair Bob Imhof in the Council Chambers, 311 Grand Avenue. Also Present: Absent: Ken Henderson Ward Nelson Marlene Dawson Larry Harris Alvin Starkenburg Barbara Brenner (late) Henderson moved to go into executive session to discuss the following: — Paul Rushing litigation (update by Senior Deputy Prosecutor Karen Frakes) (AB94 -115H) -r Request for authorization for the Executive to sign Strand Hunt non- disclosure agreement (discussion with Chief Civil Deputy Prosecutor Randy Watts) (AB95 -076) Motion carried unanimously. The Council returned 15 minutes later after meeting in executive session and reported the following: — Starkenburg moved to sign the Strand Hunt non - disclosure agreement. Motion carried unanimously. -r Rushing contract: The Council has instructed their counsel to proceed. Imhof moved to confirm the Council's counsel is to proceed as directed by the Council in their executive session of February 7, 1995. Motion carried 5 -1 with Brenner opposed. PUBLIC HEARINGS 1. RESOLUTION AUTHORIZING THE SALE OF COUNTY -OWNED PROPERTY, REQUEST #95 -1 (AB95 -020A) Regular Council Minutes, 2/7/95, Page 1 County Treasurer Barbara Cory gave background information on this item. The hearing was opened, and no one spoke. Imhof closed the public hearing. Starkenburg moved approval of the resolution. Motion carried unanimously. 2. RESOLUTION IN THE MATTER OF THE SALE OF WHATCOM COUNTY SURPLUS PROPERTY PURSUANT TO WCC 1.10.260 (AB94- 606A) The hearing was opened, and no one spoke. Imhof closed the public hearing. Brenner moved approval of the resolution. Motion carried unanimously. 3. RESOLUTION APPROVING RECOMMENDATIONS FOR 1994 OPEN SPACE /TIMBER APPLICATIONS (AB95 -036) Dan Taylor gave background information on this item. The hearing was opened, and no one spoke. Imhof closed the public hearing. Brenner moved approval of the resolution. Motion carried unanimously. 4. ORDINANCE REGARDING THE REMOVAL OF THE TEMPORARY SPEED LIMIT ON HANNEGAN ROAD (AB95 -048) Whatcom County Engineer Ed Henken gave background information on this item. The hearing was opened, and no one spoke. Imhof closed the public hearing. Regular Council Minutes, 2/7/95, Page 2 Dawson moved adoption of the ordinance. Motion carried unanimously. OTHER ITEMS 1. RESPONSE OF COUNTY COUNCIL TO STATE DEPARTMENT OF HEALTH'S DOWNGRADE OF DRAYTON HARBOR SHELLFISH AREA AND REQUIREMENT UNDER RCW 90.72 TO FORM A SHELLFISH PROTECTION DISTRICT BY JULY 11, 1995 (AB94 -556) Harris moved that the County Council direct the County Executive to participate with the Council of Governments (as local lead agency), the State Department of Health, the State Department of Ecology, the City of Blaine and other concerned parties to form and fund, pursuant to 90.72 RCW, a Shellfish Protection District in response to the State reclassification of Drayton Harbor. There was discussion on the motion with County Executive Shirley Van Zanten, Planning and Development Services Director Nate Brown, and Council of Governments Executive Director Mark Challender. Harris asked Van Zanten if she would be willing to have staff attend a February 16 meeting on the formation of the District. Van Zanten said she would try to have staff in attendance. Harris withdrew his motion. 2. ORDINANCE ADOPTING THE WHATCOM COUNTY CRITICAL AREAS REGULATIONS TO COMPLY WITH THE WASHINGTON STATE GROWTH MANAGEMENT ACT (AB94 -548A) A work session was scheduled for February 13 from 11:30 a.m. to 1:30 p.m. in the Council Committee Room. Henderson moved to extend the duration of the Emergency Ordinance Extending the Terms of Ordinance 94 -078, Adopting Critical Areas Regulations, in its present form for an additional 60 days. Motion carried unanimously. 3. REFERRAL OF A PROPOSED ORDINANCE (REDUCING OPEN SPACE REQUIREMENTS IN LIGHT INDUSTRIAL PARKS) TO THE Regular Council Minutes, 2/7/95, Page 3 PLANNING COMMISSION AND PLANNING AND DEVELOPMENT SERVICES DEPARTMENT FOR REVIEW AND POSSIBLE ACTION (AB95- 070) Dawson moved referral of the proposed ordinance. There was discussion on the motion. Motion failed for lack of a majority. ADDENDUM ITEM 5. REQUEST FOR APPROVAL OF A CONTRACT FOR MAILING SERVICES WITH MOORE BUSINESS FORMS FOR TAX STATEMENT PREPARATION AND MAILING FOR THE COUNTY TREASURER (AB95 -073) Henderson moved approval of the request. Motion carried unanimously. INTRODUCTION ITEMS 1. RECEIPT OF APPEAL OF HEARING EXAMINER'S DECISION ON HEARING EXAMINER FILE NO. APL, 94 -0018, CUSTER REZONE, FILED BY FREESTONE, ET AT (AB95 -005). Henderson moved acceptance of the Introduction Items. Motion carried unanimously. REPORTS AND OTHER ITEMS FROM COUNCIL MEMBERS Runaway Alliance (AB94 -434): Brenner attended a Runaway Alliance meeting. Support is needed for SB5191 and HB1255. Brenner asked for Council to give their support as a whole. Imhof stated he will call tomorrow. She also stated there is a meeting in Olympia (on the steps) on February 24 at 1 p.m. Henderson moved to have the Council Chair call Olympia in support of these yo- coming bills. He suggested someone fax the Council's resolution on this matter (on file) to the bill sponsors. (Clerk's Note. No vote was taken on the motiory as all were in agreement of support.) There was a draft scope from Ward Nelson regarding a potential contract review on Growth Management passed around to all Council members. Please let Bob Woods know if there are any suggestions, etc. so Nelson can work on it when he returns next week. If Council wants texts from any legislative bills, please let Bob Woods know, as he has a link to Olympia on his computer. Woods asked if Council requests his attendance at the shellfish meeting on February 16. (Yes.)
