Regular Council Meeting
October 4, 1994
The meeting was called to order at 7:12 p.m. by Chair Robert Imhof in the
Council Chambers, 311 Grand Avenue.

PUBLIC HEARINGS
1. PETTITON FOR THE VACATION OF A PORTION OF ALLEY SOUTH OF
REVEILLE ROAD, FILED BY RICK KOWSKY (AB94 -436)
The hearing was opened, and the following spoke:
Ed Henken, County Engineer
Rick Kowsky
The hearing was closed.
Henderson moved to vacate the road with the exception of the property on
Bennett Road which is used by the County.
Motion carried unanimously.
OTHER ITEMS
Brenner moved to discuss all below three appeals in executive session.
Motion carried unanimously.
The Council returned about 7:40 p.m., and the meeting resumed.
1. CONSIDERATION OF THE APPEAL OF THE HEARING EXAMINER'S
DECISION OF SHV94 -0002, FILED BY GREG EIFORD (AB94 -383)

1 Harris moved to uphold the Hearing Examiner's decision.

3 Motion failed 5 -2 with Henderson and Harris in favor.

5 Starkenburg moved to overturn the Hearing Examiner's decision based on it being
6 clearly erroneous on the record.

8 Motion carried 5 -2 with Harris and Henderson opposed.

11 DECISION ON JANSEN ADMINISTRATIVE APPEAL (APL94- 0008), FILED

14 Brenner moved to uphold the Hearing Examiner's decision.

19 DECISION ON STEELE SHORELINE AND ZONING VARIANCES (APL94-
20 0010), FILED BY DONALD R. STEELE (AB94 -322)

22 Brenner moved to uphold the Hearing Examiner's decision but eliminate the
23 condition on the setback.

25 Imhof stated that was an error of law establishing the side yard setback.

29 4. RESOLUTION APPROVING OF A MULTI- COUNTY RESOLUTION
30 REGARDING THE PROPOSED NATIONAL MARINE SANCTUARY FOR
31 NORTHERN PUGET SOUND (AB94 -476)

41 5. RESOLUTION APPOINTING AN ELECTION SUPERVISOR FOR THE

44 WATER DISTRICT (AB94 -273F)

Imhof moved approval of the resolution.
Motion carried unanimously.
6. ORDINANCE AMENDING ORDINANCE 84 -14 ESTABLISHING A
REVOLVING CHECKING ACCOUNT FOR THE INDUSTRIAL
INSURANCE FUND (AB94 -472) (HELD OVER FROM 9/27/94)
Imhof: "We didn't take a vote on it two weeks ago, er, a week ago, and I guess,
that, it got skipped over and it's back."
Brenner: "Was it just that it got skipped over or we forgot ?"
Imhof: "No, we got talking on something else. It disappeared into the black
hole."
Imhof. "Any comments on this ordinance establishing the revolving checking
account "?
The clerk called the roll, and the ordinance passed unanimously.
7. APPROVAL OF A BUILDING ADDITION FOR WHATCOM COUNSELING
AND PSYCHIATRIC CLINIC (AB94 -505)
Speakers:
Don Berg, Executive Director, Whatcom Counseling and Psychiatric Clinic
Gill Aiken, Architects Service Group
Harris moved to approve the building addition for Whatcom Counseling and
Psychiatric Clinic.
Motion carried unanimously.

REPORTS AND OTHER ITEMS FROM COUNCIL MEMBERS
United States Day (AB94 -495): There was discussion of this item.
Lummi Trust Water Rights Negotiations (AB94 -477): Hearing and information
on this item at 11 a.m. Tuesday, October 11, Water Resources Committee.

Flood Hazard Reduction Advisory Committee (AB93 -027): Community meetings
are taking place. Council members were requested to attend.
Whatcom Counseling and Psychiatric Clinic (AB94 -505): Henderson reminded
Council members that they needed to have paperwork included in the packet for items.
Regulatory Reform, WSAC/WACO (AB94 -515): Henderson would like Public
Services and Solid Waste Committee to have an ongoing discussion of regulatory reform.
■Voting lights: Council agreed to use voting lights but would like a practice
session.
Marine Sanctuary Resolution (AB94 -476): Council members who voted against it
do not have to sign it.
Paul Rushing/Van Zanten Resolution (AB94- 115G): Nelson would like it
scheduled for October 11.
Chamber of Commerce Economic Summit will be October 14 and 15. Nelson
said public officials are invited to observe.
Bob Woods will be attending the Franchise /Cable TV Conference in King County
for Jeff Monsen, Transportation Services Department.
The Internal Auditor and other staff would like to meet with individual Council
members or a committee to discuss some items. Imhof referred this to the Finance
Committee, and Starkenburg consented. (AB94 -503)
Boundary Review Board Meetings (AB94 -524): The Council was reminded of
hearings on Thursday, October 6.
