Regular Council Meeting
July 5, 1994
The meeting was called to order at 7:02 p.m. by Council Chair Robert Imhof in
the Council Chambers, 311 Grand Avenue.

1. HEARING ON CITIZEN PETITION TO FORM AN IRRIGATION DISTRICT,
TO BE KNOWN AS THE WHATCOM AGRICULTURAL WATER DISTRICT
(AB94 -273) (THIS HEARING MAY BE CONTINUED FOR UP TO THREE
WEEKS) (AB94 -273) (HELD OVER FROM 6128)
Imhof said the Department of Ecology asked the Council to change Article II (as
detailed in their fax transmission of July 5, 1994 to the Council). Henry Bierlink
addressed the Council and said the Committee would concede to making the change to
the petition as suggested by the Department of Ecology.
Brenner moved to approve the resolution ordering an election.
Imhof directed the Clerk to add an Exhibit C to the resolution, that exhibit to be
the petition as amended by Bierlink's agreement to the Department of Ecology's
condition.
Henderson noted that even though he was not present at the last meeting, he had
reviewed the record and would be voting on this matter this evening.
Motion carried unanimously.

RESOLUTION ESTABLISHING GUIDELINES FOR PREPARATION OF
THE 1995 BUDGET (AB94 -269A) (HELD OVER FROM 6128)
Brenner moved to approve the resolution.

Brenner moved to amend the second "whereas ", line 6, to read: "As a result of
discussion at the meeting, a majority opinion emerged... ".
Motion to amend carried unanimously.
Motion to approve the resolution as amended carried unanimously.
2. APPOINTMENT OF MEMBERS TO THE DEVELOPMENT
STANDARDS TECHNICAL ADVISORY COMMITTEE (AB94 -369)
Nelson moved to confirm the appointments recommended by the Executive.
Motion carried unanimously.
3. LEGALITY OF INTERIM DISPOSAL SITE AGREEMENT WITH
RECOMP OF WASHINGTON, INC. (AB94 -281A)
For lack of a motion to pursue this matter, Imhof declared the matter dead.

4. APPEAL OF THE HEARING EXAMINER'S DECISION ON
SHORELINES PERMITS FILED BY WILLIAMS (HEARING
EXAMINER FILE NO. SHV93 -0008, SHS93 -0031) (AB94 -303)
Dawson moved to uphold the Hearing Examiner's decision.
Motion, carried unanimously.

REPORTS AND OTHER ITEMS FROM COUNCIL MEMBERS
Growth Management Act Report (AB94 -363): Imhof moved to request the
Executive to have the Planning & Development Department supply to the Council a flow

chart outlining all parts of the Growth Management process, their relationship to each
other and a projected Council action date of each of the segments.
Motion caned unanimously.
Critical Areas Ordinance (AB94 -364): Harris announced he had planned to ask
Council to rescind its resolution on the Critical Areas Ordinance adopted last week but
that in light of a compromise deal worked out between Imhof and Planning &
Development Services staff, he would not do so at this time.
The Clerk and Imhof announced that there will be a procedural meeting before
the next Council meeting. The meeting will be open to the public.
Council Policy Handbook (AB94 -358): Brenner, Harris and Henderson spoke in
support of drafting a policy for introduction of resolutions.

There being no further business, the meeting was adjourned at 7:20 p.m.
