REGULAR MEETING
January 4, 1994
The meeting was called to order at 7 p.m. in the Council Chambers, 1000 N. Forest
Street, by Council Chair Marge Laidlaw.

READING AND APPROVAL OF MINUTES
The minutes of the December 7, 1993 regular meeting were approved as presented.
HEARINGS
The hearing was opened. As no one spoke, the hearing was closed.
1. ORDINANCE REGARDING THE MATTER OF ESTABLISHING THE
SPEED LIMIT ON SUCIA DRIVE (AB93 -501)
WARNER MOVED APPROVAL OF THE ORDINANCE.
The motion carried unanimously.
OTHER ITEMS
1. DECISION ON APPEAL OF HEARING EXAMINER'S HEARING DECISION
ON HEARING EXAMINER FILE NO. CP -73, FILED BY GEORGIA PACIFIC
CORPORATION (AB93 -294)
WARNER MOVED TO UPHOLD THE HEARING EXAMINER'S DECISION.
The motion carried 6 -1, with Imhof opposed.
2. DISCUSSION ON APPRAISAL AMOUNT OF THE VACATION OF A PORTION
OF GULF ROAD, FILED BY J.M. SHECKTER, CHERRY POINT INDUSTRIAL
PARK LTD. (AB93 -085)

WARNER MOVED APPROVAL OF THE APPRAISAL AMOUNT AT $77,200.
The motion carried unanimously.
3. PLANNING COMMISSION APPOINTMENTS FOR TWO VACANCIES THAT
EXPIRE 12/31/93 (AB93 -491)
This item was postponed to a later date.
4. APPOINTMENTS FOR VACANCIES OF VARIOUS BOARDS &
COMMISSIONS (AB93 -493)
WARNER MOVED THE FOLLOWING APPOINTMENTS:
Sewage Control Anneals Board:
Unincorporated Areas: Mark Anderson
Board of Equalization:
District II: Bernard Statema
Solid Waste Advisory Committee:
Waste Hauler: Edward Nikula
Waste Recycling: John Von Krusenstiern
Public Interest Group: Carl Weimer

Motion carried unanimously.
Solid Waste Advisory Committee:
Waste Disposal: Corky Smith, Jr.
BRENNER MOVED TO APPOINT CORKY SMITH TO FILL THE VACANCY
FOR WASTE DISPOSAL ON THE SOLID WASTE ADVISORY COMMITTEE.
Motion carried unanimously.
C0UN7Y-WIDE FLOOD CONTROL ZONE DISTRICT BOARD OF SUPERVISORS

The County Council also serves as the board of supervisors for this district. Because the district
is a separate governmental unit, the Council must recess its regular Council meeting and call
to order a meeting of the County-Wide Flood Control Zone District before taking action.
ACTION:
1. RESOLUTION ADOPTING A FUNDING MECHANISM FOR THE
WHATCOM COUNTY FLOOD CONTROL ZONE DISTRICT AND
AUTHORIZING THE COLLECTION OF CHARGES FOR STATE AND
PORT -OWNED PROPERTIES (AB93 -346)
John Matzinger, Public Works Department Flood Control Group, stated that his
position is that the State should take its dissatisfaction with the appraisal levels for DNR
properties to the Board of Equalization.
HARRIS MOVED APPROVAL OF THE RESOLUTION.
Motion carried 6 -1 with Brenner opposed.
WARNER MOVED TO HAVE STAFF CONTINUE NEGOTIATING WITH DNR
SO THAT THERE IS SOME CLARITY OF PURPOSE HERE.
Motion carried unanimously.
2. RESOLUTION REVISING RESOLUTION 92 -029 ESTABLISHING A
FLOOD CONTROL ZONE ADVISORY COMMITTEE (AB93 -496)
IMHOF MOVED APPROVAL OF THE RESOLUTION.
Motion carried unanimously.
ADJOURN
The meeting of the County Wide Flood Control Zone District Board of Supervisors was
closed.
The Regular Council meeting was reconvened.
REPORTS AND OTHER ITEMS FROM COUNCIL MEMBERS
Meeting Reminder: Brenner reports that on January 23 there will be a 5:30 p.m.
meeting at the Lummi Island Grange re: local control of local issues.
Request for Levy Support for Library: John Halliday from the Library District
requested the Council's support of the upcoming levy in February.

Extended Area Calling (AB93 -328): Brenner reported that The Utilities and
Transportation Commission is having a hearing on January 12 to make its final decision on
the exchanges that have been targeted for local telephone service.
BRENNER MOVED TO SEND A LETTER FROM THE COUNCIL
ENDORSING THE EXCHANGES INCLUDED NOW AND ENDORSING VIRTUALLY
COUNTY -WIDE LOCAL TELEPHONE SERVICE, INCLUDING POINT ROBERTS.
The motion carried unanimously.

The meeting was adjourned at 7:50 p.m.
The next Council meetings will be at 7p.m. Tuesdays, January 11 and 24, 1994 in the Council
Chambers, 1000 N. Forest Street.
