Forest Street, by Council Chair Robert A. Imhof. Also Present Absent: Alvin Starkenburg None Larry Harris Marlene Dawson Ken Henderson Barbara Brenner Ward Nelson SPECIAL PRESENTATION PRESENTATION ON THE BACKGROUND DOCUMENT, TRANSPORTATION PLAN, BY PLANNING AND ENGINEERING STAFFS, AND JHK & ASSOCIATES (AB94 -063) (20 MINUTES) Ed Henken, County Engineer, introduced Vickie Matheson, Project Manager, who gave a brief overview and introduced the JHK Consultants, Marty Nizlek, Shelby Tedesko and Bill Louden. PUBLIC HEARINGS 1. ORDINANCE IN THE MATTER OF THE ADOPTION OF THE FINAL BUDGET OF WHATCOM COUNTY FOR THE YEAR 1994 AND RESTRICTING THE EXPENDITURE OF CERTAIN FUNDS THEREIN (AB94 -032) (ACTION 2/8) The hearing was opened, and the following person spoke: Jim Cozad, 1606 Diamond Loop Road, Bellingham. The hearing was closed. OTHER ITEMS 1. REQUEST FOR AUTHORIZATION FOR THE EXECUTIVE TO SIGN A REVENUE - SHARING AGREEMENT WITH THE CITY OF LYNDEN IN THE PROPOSED ANNEXATION OF 240 ACRES WEST OF THE GUIDE MERIDIAN (AB94 -039A) Regular Council Minutes, 2/1/94, Page 1 Shirley Van Zanten, County Executive, reported on the issue and distributed a letter to the Council outlining the proposed agreement. Harris moved to approve authorization for the Executive to sign a revenue sharing agreement with the City of Lynden. Motion carried unanimously. Addended Item: 2. RESOLUTION CREATING A BLUE RIBBON PANEL TO REVIEW BUDGET PROCESSES AND FINANCIAL OPERATIONS (AB94 -070) Nelson moved to approve the resolution. Henderson moved to amend the motion to increase the number on the committee to nine members. Motion to amend carried unanimously. Motion to approve the amended resolution carried unanimously. Imhof said a reconsideration of the nomination to the Flood Control Zone District Advisory Committee will be put on the February 8, 1994 agenda (AB94 -038) He said the Council would ask for a spot on the Council of Governments agenda on February 10 to discuss this issue. INTRODUCTION ITEMS The Council may accept these items for introduction (no action) in a single motion. Changes, in terms of committee assignment for example, may be made at this time. 1. Motion carried unanimously. REPORTS AND OTHER ITEMS FROM COUNCIL MEMBERS Citizen Complaint on Water Testing (AB94 -071): Brenner reported on a letter from Daryl Eden, 458 W.Pole Road, that stated the Health Department told him their budget was cut, so he would be charged almost double the fee for water testing . Support of House Bill 2616 (AB94 -072): Brenner moved that the Council support approval by the Environmental Affairs Committee of House Bill 2616 for that portion of the bill that simplifies water system testing requirements and covers pesticides only Motion carried unanimously. Cain Lake Proposal (AB94 -073): Harris stated he had received a proposal from the residents of Cain Lake regarding the restriction of gas- powered engines on the lake and would like it to be put on the agenda and referred to the Planning and Development Committee . Referendum Information (AB92- 058E): Harris stated that the Supreme Court ruled that the Critical Areas Ordinance referendum filed in Snohomish County was invalid. Dan Gibson will brief the Council when he has all the information. Northwest Regional Council (AB94 -038): Henderson stated that the Northwest Regional Council met last week, and the Commissioners from the other Counties would like to meet with the Council. Northwest Regional Council (AB94 -038): Dawson said she spoke to Mr. Winslow and agrees with him in wanting to eliminate entitlements but feels there is not much support for his idea. (AB94 -038). REPORTS AND OTHER ITEMS FROM COUNCIL MEMBERS Brenner reported on a letter from Daryl Eden, 458 W.Pole Road, that stated the Health Department told him they had to shut down their lab because their budget was cut, so he would be charged almost double the fee (AB94 -071). Bob Woods, Budget and Program Analyst, said the Council adopted the Unified Fee Schedule that did include fee increases. The Health Department has eliminated testing. Brenner moved that the Council support approval by the Environmental Affairs Committee of House Bill 2616 for water testing dealing with pesticides only as it stood January 26 without amendments. (AB94 -072) Motion carried unanimously. Harris stated he had received a proposal from the residents of Cain Lake regarding the restriction of gas- powered engines on the lake and would like it to be put on the agenda and referred to the Planning and Development Committee (AB94 -073). Harris stated that the Supreme Court ruled that the referendum filed in Snohomish County was invalid. Dan Gibson will brief the Council when he has all the information (AB92- 058E). Henderson stated that the Northwest Regional Council met last week, and that the Commissioners from the other Counties would like to meet with the Council (AB94- 038).
