Regular Council Meeting
August 2, 1994
The meeting was called to order by Council Chair Robert Imhof at 7 p.m. in the
Council Chambers, 311 Grand Avenue.

Imhof presented a Resolution in appreciation to all those who helped in the
organization, planning and logistics of the Courthouse open house (AB94 -429).
Imhof moved approval of the resolution.
Motion carried unanimously.
Imhof reported that Item 4 ( Recomp) under "Other Items" will be withdrawn.
There was discussion of the Recomp agreement.
Harris requested all Council Members be notified of all work sessions so those
who wish to attend may do so.
Brenner moved that anyone from the Council be allowed to work on this
Committee (Flow Control), preferably the full Council, and make it be an open public
meeting. This would be a full Council work session.
Motion carried 4 -3 with Dawson, Imhof and Starkenburg opposed.
SPECIAL PRESENTATION
GROWTH MANAGEMENT SCHEDULE (AB94 -413) (30 MIN.)
Vickie Matheson, Planning and Development Services, discussed the Growth
Management Schedule. Topics discussed were: Compliance with the Growth
Management Act; final adoption of the Comprehensive Plan; changes in the Growth
Management Act; interlocal agreements; regulatory changes; incentive programs;

revisions to subarea plans and impact fees.
Henderson moved to approve the timeline as outlined in the packet.
Motion carried unanimously.
There was discussion of the Critical Areas Ordinance and Referendum 92 -003.
Nelson moved to adopt the referendum version with additional public process.
Speakers: Nate Brown, Planning and Development Services; Dan Gibson; all
Council Members.
Motion carried 5 -2 with Henderson and Harris opposed.
PUBLIC HEARINGS
1. ORDINANCE PROVIDING FOR AN ANNUAL INTEGRATED
ROADSIDE VEGETATION MANAGEMENT PROGRAM (AB94 -293A)
Jeff Monson, Transportation Services Director, gave an overview of the
Vegetation Management Program.
No one spoke at the public hearing.
Nelson moved adoption of the ordinance.
Motion carried unanimously.
OTHER ITEMS
1. DISCUSSION AND POSSIBLE DECISION ON WEST HARBOR
HEIGHTS PUD 93 -002 (AB94 -391)
Brenner moved to approval the PUD.
Henderson moved to amend the PUD., page 36 of the packet, adding after

2. RESOLUTION IMPLEMENTING A CRITICAL AREAS ORDINANCE
TO ACHIEVE COMPLIANCE WITH THE GROWTH MANAGEMENT
HEARINGS BOARD (AB94 -335A)
Harris withdrew the resolution under duress.
3. RESOLUTION ESTABLISHING REFERENDUM 92 -003 AS A
TEMPORARY EMERGENCY MEASURE (AB94 -426)
Withdrawn.
4. DISCUSSION AND POSSIBLE DECISION ON AGREEMENT WITH
RECOMP, INC. FOR A DISPOSAL SITE (AB94 -397)
Withdrawn.

1. ORDINANCE TO AMEND URBAN FRINGE SUBAREA
COMPREHENSIVE PLAN MAP AND THE OFFICIAL WHATCOM

Brenner moved to accept the Introduction Items.
Motion carried unanimously.
EXECUTIVE SESSION
1. UPDATE: WATER DISTRICT 10 (AB93 -354)
Harris moved to go into executive session.
Motion carried unanimously.
Imhof moved that the Council support Water District 10.
Motion carried 5 -2 with Henderson and Harris opposed.

REPORTS AND OTHER ITEMS FROM COUNCIL MEMBERS
Henderson moved that Bob Woods, Council and Budget and Program Analyst, be
assigned to act as facilitator, professional staff support and Council liaison to the Charter
Review Commission from now through the end of Commission business.
Motion carried unanimously.
Henderson moved that Bob Woods be directed to prepare a preliminary report
regarding the Courthouse construction cost estimates and actual expenditures by
October 4, 1994.
Motion carried unanimously.
Brenner asked that the Council schedule an executive session at its August 9
meeting to discuss a personnel matter.
