HomeMy WebLinkAboutCouncil April 5 1994WHATCOM COUNTY COUNCIL REGULAR MEETING April 5, 1994 The meeting was called to order by Council Chair Robert Imhof at 7 p.m. in the Hearing Examiner's Chambers (formerly the Council Chambers), 1000 N. Forest Street. Also present: Larry Harris Barbara Brenner Marlene Dawson Alvin Starkenburg Ward Nelson Absent: Ken Henderson READING AND APPROVAL OF MINUTES of the March 1 meeting The minutes were approved as presented. SPECIAL PRESENTATION PRESENTATION BY JEFF MONSEN, DIRECTOR, TRANSPORTATION SERVICES, ON SIX YEAR ROAD PROGRAM (AB94 -183) Jeff Monsen, Transportation Services Director, handed out a packet of information to the Council (on file, AB94 -183) before beginning his presentation. SPECIAL PRESENTATION (continued) PRESENTATION BY THE PLANNING STAFF ON STATUS OF GROWTH MANAGEMENT ACTS PLANNING (AB94 -094) Presentation by Planning Division Manager Dan Taylor and Senior Planner Vicki Matheson. An additional packet of information was handed out to Council Members (on file, AB94 -094). HEARINGS 1. ORDINANCE PROHIBITING THE USE OF NON - ELECTRIC MOTORS ON CAIN LAKE (AB94 -073A) Regular Meeting, 4/5/94, Page 1 closed: The hearing was opened and the following people spoke before the hearing was Steve Reimer, Cain Lake Road, Sedro Woolley Ann Novak, Alder Drive Gunner Jerns, Cain Lake Road, Sedro Woolley George Radel, Sedro Woolley Dewey Desler, Bellingham Lloyd Austin, Bellingham Harris moved adoption of the ordinance. The motion carried unanimously with Henderson absent. 2. ORDINANCE REGARDING ESTABLISHING SPEED LIMITS ON CERTAIN COUNTY ROADS (AB94 -171) The hearing was opened; no one spoke. The hearing was closed. Starkenburg moved adoption of the ordinance. The motion carried unanimously with Henderson absent. 3. ORDINANCE REGARDING ESTABLISHING STOP SIGNS (AB94 -172) The hearing was opened; no one spoke. The hearing was closed. Starkenburg moved adoption of the ordinance. The motion carried unanimously with Henderson absent. 4. ORDINANCE AMENDING TITLE 20,21 AND THE CRITICAL AREAS ORDINANCE TO INCLUDE REGULATORY LANGUAGE THAT ESTABLISHES THE BASIS FOR DEVELOPING AND ADMINISTERING THE STORMWATER PROVISIONS OF THE WHATCOM COUNTY DEVELOPMENT STANDARDS (AB94 -088) Planning and Development Services Director Nate Brown handed out a proposed list of changes to the recommended changes from the Planning Commission to ordinance amendments (on file, AB94 -088). Regular Meeting, 4/5/94, Page 2 The hearing was opened, and the following people spoke: Pat Jones, Soundview Road, Bellingham Richard Gilda, Bellingham James Fox, Young Street, Bellingham Bob Anderson, Holly Street, Bellingham The hearing was held open until the end of the meeting to give folks in the audience a chance to review the changes in the packet handed out by Brown. OTHER. ITEMS 1. DISCUSSION ON PROPOSED SERVICE FOR FEE CONTRACT BETWEEN WHATCOM COUNTY AND WHATCOM COUNTY CONSERVATION DISTRICT (AB93 -483) Imhof and Harris provided background information on this item. Harris moved to forward this proposal to the Executive for consideration and recommendation. The motion carried unanimously with Henderson absent. 2. CONFIRMATION OF THE APPOINTMENT OF PHILIP URSO TO THE PLANNING COMMISSION FOR A FOUR -YEAR TERM ENDING 12/31/97 (AB93 -491) Imhof moved to appoint Philip Urso to the Planning Commission. Motion carried unanimously with Henderson absent. INTRODUCTION 1. RECEIPT OF APPLICATION OF OPEN SPACE /OPEN SPACE, FILED BY GILMER F. AND MYRNA L. LOUVEAU (AB94 -180) (REFERRAL TO PLANNING COMMISSION) Imhof moved acceptance of the introduction item. The motion carried unanimously with Henderson absent. REPORTS AND OTHER ITEMS FROM COUNCIL MEMBERS Commission on Youth and Children (AB 94 -250): Brenner volunteered to be elected official as part of the Commission but wants support from the Council. Motion made and carried unanimously with Henderson absent. Regular Meeting, 4/5/94, Page 3 SWAC Contract (AB94 -022): Dan Gibson needs direction from the Council re: legal clarification of questions from SWAC. Also, the Council Members would like to review the contract. Imhof moved to have SWAC review two Flow Control areas (safeguards preventing the County from paying high rates and contract term length) and get back to the Council. Motion carried unanimously with Henderson absent. Brenner wanted legal opinions regarding modify /change Flow Control priorities and veto power by the County over legislation to a private company. Nelson suggested all embers draw up a list of questions they have and deal with them at a later meeting. Imhof noted there needs to be a consensus of questions. Dawson mentioned the delegation going to Washington D.C. re: the Clean Water Association. The delegation will be requesting Council support upon their return. Harris brought attention to the Joint Lake Whatcom Management Subcommittee team meetings. Imhof moved to approve the timeline as presented concerning SWAC. Motion carried unanimously with Henderson absent. HEARINGS CONTINUED 4. ORDINANCE AMENDING TITLE 20,21 AND THE CRITICAL AREAS ORDINANCE TO INCLUDE REGULATORY LANGUAGE THAT ESTABLISHES THE BASIS FOR DEVELOPING AND ADMINISTERING THE STORMWATER PROVISIONS OF THE WHATCOM COUNTY DEVELOPMENT STANDARDS (AB94 -088) The hearing was continued, and the following people spoke before the hearing was closed: Virginia Naef, Deming Bob Wieson, Ferndale Richard Gilda, Bellingham Pat Jones, Bellingham Bruce Harris, Summerland Road, Bellingham Bob Anderson, Holly Street, Bellingham Dave Ernst, Lynden Brenner moved to table the ordinance for two weeks to allow for further written public comment. The motion failed 2 -4 with Brenner and Dawson in favor and Henderson absent. Harris moved approval of the ordinance. Brenner moved to approve the amendments as part of the package with the ordinance, deleting any scrivener errors. The motion carried unanimously with Henderson absent. The main motion to adopt the ordinance carried 5 -1 with Brenner opposed and Henderson absent.
