SPECIAL COUNCIL MEETING
February 13, 1996
The meeting was called to order at 7 p.m. by Council Chair Ward Nelson in the
Council Chambers, 311 Grand Avenue.

ANNOUNCEMENTS
Nelson reported that there will be a 7 p.m. meeting of the Interlocal Negotiating
Committee tomorrow night, February 14 at the Lynden Senior Center (AB96 -042).
1. NOOKSACK STEERING COMMITTEE PRETENTION OF WATER
UPDATES AND POSITIONS ON KEY ISSUES (A QUESTION AND
ANSWER PERIOD WILL FOLLOW) (AB96 -052)
Tom Anderson, Manager, PUD and chair of the Nooksack Basin Water Users
Steering Committee, gave the presentation. He began with some introductory comments
and continued. his presentation with the following:
A brief history of Washington and Western Water Law
Analysis of Current Situations (the agricultural community, public systems,
public health systems, legislative overview, implications to economic
development, negotiations, litigation on senior in stream flows)

Steering Committee Activities (history, legal research, data collection,
position paper)
Whatcom County's Involvement (the Growth Management Act, future land
use decisions, receiver of last resort)
What's next?
A question and answer period followed the presentation. Public comment was
taken from the following people:
Bob Wiesen, 3314 Douglas Road, Ferndale: Ground water and river levels
Skip Richards: Total amount of existing water, its useability and storage
Robin Dexter: In stream flow advocates
Nelda Sigurdson, 5171 Ferndale Road, Ferndale: Why are the Indians interested in
the water issues?
Jeff McKay, 4693 Sucia Drive, Ferndale: The importance of adjudication
Bob Andersen, Box 3183, Bellingham: The importance of the County's involvement
in ongoing proceedings

2. POSSIBLE DISCUSSION AND ACTION ON PROPOSED LANGUAGE
AND CONTENT OF A "GENERIC" TYPE OF DISPOSAL SITE
AGREEMENT (AB95 -041)
It was noted by Public Works Director Jeff Monsen that it would be best for all
parties that if the County Council intends to adopt the generic form of disposal site
agreement, then formal action should be delayed until the February 20 meeting, or a later
date, to allow all interested parties opportunity to comment on the recommended generic
form prior to adoption. He briefly commented on certain sections including: Section 1
(Definitions); Section 2 (Operator Rights and Responsibilities); Section 3 (County
Responsibilities); Section 9 (Facility Operations); Section 10 (Rates Charged); Section 12
(Term of Agreement); Section 16 (Indemnification /Liability to Other Disposal Sites);
Section 21 (Dispute Resolution); and Appendix B (Standards). Sections 4 -8, 11, 13 -15,
17-20,,22-28, Appendix A, and Appendix C were noted as "No Comment" items.
This item was held over for discussion and possible action at the February 20
Council meeting.
