HomeMy WebLinkAboutSpecial Council July 16 1996WHATCOM COUNTY COUNCIL SPECIAL COUNCIL MEETING WORK SESSION July 16, 1996 The meeting was called to order at 1:10 p.m. by Council Chair Ward Nelson in the Council Committee Room, 311 Grand Avenues Also Present: Absent: Marlene Dawson None Barbara Brenner Tom Brown Alvin Starkenburg Kathy Sutter Robert Imhof 1. FINAL DRAFT URBAN GROWTH AREA Eq TERLOCAL COOPERATION AGREEMENT (AB96 -042A) The Council discussed the process they wanted to follow, as well as the timetable. 24 Dave Williams, Fire District #4 Commissioner, addressed the Council regarding his 25 district's concerns. Topics discussed included: various annexations; special purpose districts; 26 "who's in charge " ?; specific timelines; policies after urban fringe completed; financial impact; 27 cause and effect; loss of area through annexation; service needs diminished by annexation; 28 possible cutbacks; water supply; master planning area; consolidation of fire districts; supporting 29 legal reference; redrawing fire districts; areas of development and expansion; and fire district 30 assessed value. The Council then discussed the draft document, section by section. Motions were then made. Dawson moved to change the language in Section 7, page 2, to read: "The County agrees not to approve rezone requests for property within the UGA without eity concurrence. ........ ............................... Motion carried unanimously. Sutter moved to delete Section 8, page 2. Motion carried unanimously. ". 18 19 After discussion, Brenner withdrew her motion. 20 21 Brenner moved to delete language in Section 11, page 3, to read: "...within the City's 22 Growth Area::::: 23 policies" 24 25 Motion carried unanimously. 26 27 "The County agrees to initiate amendments to Title 20 (the Official Whatcom County 28 Zoning Code) to incorporate City comments in the review of administrative approval uses and 29 conditional uses within the City's Urban Growth Area:: and to require these uses to be consis 30 with any applicable City regulations and policim." 31 32 Sutter moved to delete the first paragraph of Section 12, page 3. 33 34 Motion carried unanimously. 35 36 "Impact 37 established tyy the eity. eoffection and allocation of fees shaH be done in an equitable nimmer 38 aHjurisdictions involved. In the case where oneinrisdiction receives the entire fee, it wHI be paid 40 ." 41 42 Starkenburg suggested Section 12 be returned to staff for further work so all language 43 would be consistent. Discussion followed on both parts of Section 12. Special Council Meeting Minutes, 7/16/96, Page 2 Nelson moved to delete "impact or" in Section 12, page 3. Motion carried unanimously. "Projects which affects areas outside City UGAs will be charged impactor mitigation fees based on County formulas or review." Bob Woods, Council Budget and Program Analyst, suggested changing the word "UGAs" to "boundaries" in Section 12, page 3. ........................... ........................... "Projects which affect areas outside City UGAs f t t acri will be charged impactor o.." Nelson moved to eliminate the impace fees and re- establish how mitigation fess would be done. Motion carried unanimously. Brenner moved to delete "and the environment" in Section 16. Motion carried unanimously. "...those limited circumstances shown to be necessary to protect basic public health and safety and when such services are financially... ". Brenner moved to change language in Section 16, page 4, to read: "Prior to each annexation, the County and the Cities shall negotiate rzp ztzfis, in good faith, interlocal agreements with... ". After discussion, Brenner withdrew her motion. Sutter requested language to Section 20, page 4, be added: "This agreement may .. ............................... .. ............................... be r �:« '0 modified after a public process.... She was concerned there needed to be a cancellation clause, ending date, sunset clause or review date. Nelson sated that he would meet with Civil Deputy Prosecuting Attorney, Dan Gibson regarding the ability to tie to the Comp Plan Review. Starkenburg suggested Council first work with the small cities and leave Bellingham until the last. Nelson moved to place this item in Planning and Development Committee to resolve the above issues with Planning staff. Motion carried unanimously. Starkenburg suggested Council request cities submit a list of their negotiating concerns to Council in preparation for these meetings, thereby assisting Council.
