Also Present: Absent: Kathy Sutter None Tom Brown COMMITTEE DISCUSSION 1. DISCUSSION OF CHICAGO TITLE INSURANCE COMPANY'S COMPLAINT REGARDING THE TIME LIMITATIONS SCHEDULED FOR SUBMISSION OF REAL ESTATE EXCISE TAX PAYMENTS THROUGH THE WHATCOM COUNTY TREASURERS OFFICE (AB96 -121) This item has been rescheduled for the next committee meeting (April 2). 2. DISCUSSION OF COMPLAINT REGARDING THE INTERSECTION OF SWEET AND STADSVOLD ROADS (AB95 -122) Nasser Mansour, Public Works, Engineering, showed a map of the intersection and explained the traffic problem. The map also showed the solution proposed by the Engineering Department. Citizens speaking about their concerns on the intersection included: Fred Siegerquist Mae Cederlund Mike Donahue, Public Works, Engineering, commented. DISCUSSION AND RECOMMENDATIONS TO COUNCIL 1. REQUEST AUTHORIZATION FOR EXECUTIVE TO APPROVE DESIGNATION OF OLIVINE CORPORATION AS' A SOLID WASTE DISPOSAL SITE CONSISTENT WITH THE FLOW CONTROL ORDINANCE (AB96 -110) Jeff Monsen, Public Works, briefly commented. Discussion followed regarding the potential legal issues with RECOMP. Public Works Minutes, 3/19/96, Page 1 Sutter moved to recommend approval. Motion carried unanimously. 2. RESOLUTION AMENDING RESOLUTION 96 -002 CLARIFYING THE INTENT OF WHATCOM COUNTY CODE 8.15, SOLID WASTE DISPOSAL SITES, OTHERWISE KNOWN AS THE FLOW CONTROL ORDINANCE, AND ESTABLISHING SOLID WASTE HANDLING PERFORMANCE STANDARDS FOR MDMD SOLID WASTES (AB96 -014A) Jeff Monsen, Public Works, gave background information regarding the steps the Council has taken so far and whether this resolution should be put in ordinance form. Bob Woods, Council Budget and Program Analyst, commented. Brenner moved to amend page 1 (of the resolution), line 26, to strike the language: "..-in order to convev the wishes of theeountv em ... ": "...Resolution 96 -002 is no Ionizer valid and must be amended in for the administration... ". Motion to amend carried unanimously. Brenner moved to amend page 3, lines 22 and 24, and page 4, lines 13 and 15, to read: " ..asi3' listed below." There was discussion on the motion. Ward Nelson, Council member, and Bob Woods, Council Budget and Program Analyst, commented. Motion to amend carried unanimously. Brenner moved to amend page 4, line 30, to strike the word "drafted' and replace with the .... ............................... word " r ph. .... ............................... .... ............................... " . to be excluded will be drafted C��tt�f3 by SWAC and approved by the County . ............................... Council... ". Motion to amend carried unanimously. Brenner moved to amend page 4, line 32 through page 5, line 2, to strike the language: "The Operator acknowledges the eounty,s ability to create thIs fist and vviff accept the County's amendment to Appendix B in tifis regard.". Motion to amend carried unanimously. Brenner moved to recommend approval of the main motion as amended. Motion carried unanimously. 3. DISCUSSION REGARDING THE PROPOSED DISPOSAL SITE AGREEMENT FOR RECYCLING AND DISPOSAL SERVICES, INC. (RDS) (AB96 -120) Brenner moved to recommend approval of the contract. Jeff Monsen, Public Works, commented. Sutter moved to amend to replace on page 4 (of the agreement) the word "Operator" with IRECOMP of Washington ": "...Agreement between Operator Recomp of Washington and The City of... ". Public Works Minutes, 3/19/96, Page 3 Motion to amend carried unanimously. Brenner moved to amend on page 14, section 10.1 and 10. 3, to reduce the initial ceiling rate from $100 to $80 per ton. Motion to amend carried unanimously. Sutter moved to amend on page 22, section 16.3.2, to delete: "Operator consents (does not consent) to attorneys' fees and expenses being... ". Motion to amend carried unanimously. Discussion followed on the definition of "Process" (page 4); "Weigh Scales and Records" (page 7); the section on "County Responsibilities "; and Section 8, "Ownership of County Solid Waste Delivered to Facility'. Brenner moved to amend on page 12, section 9.1.2 (last paragraph), to delete "may" and replace it with "shall": "...the Manager, by written notice, may ; declare the Operator ineligible to receive... ". Motion to amend carried unanimously. There was discussion on page 13, 9.1.4(c), Calculation of Recovery of Recyclables; page 15, 10.7, Arbitration of Ceiling Rate and Other Adjustments if Parties Cannot Agree; and tonnage. Those speaking included: Jim Austin, Attorney for RECOUP Frank Moscone, RECOUP Larry McCarter, RDS John Hoksbergen, RECOUP Brenner requested a motion from Monsen for tonight's meeting regarding tonnage .
