Also Present: Marlene Dawson Kathy Sutter Absent: None COMMITTEE DISCUSSION AND RECOMMENDATIONS TO COUNCIL 1. CONSIDERATION OF HEARING EXAMINER'S RECOMMENDED APPROVAL OF A PLANNED UNIT DEVELOPMENT FILED BY BLAKE AND RUTH BARRETT FOR "TEAMOUSEY FOREST" (PUD96 -0001 AND PLS96 -0001) (AB96 -301) Starkenburg noted the Hearing Examiner sent Council a letter dated August 20 stating he felt he erred. He informed Council he was sending forward both the PUD and the long subdivision. Those speaking included: Blake Barrett, Applicant Matt Aamot, Land Use Services Tom Brown, County Council Member Bob Woods, Council Budget and Program Analyst Dan Gibson, Council's Counsel Barbara Brenner, County Council Member Starkenburg moved to strike the last sentence of item 5, packet page 95: "Ten feet of right -of -way shall be dedicated to Whatcom County adjacent to Mosquito Lake Road along the entire frontage of the plat for a total half-width of 30 feet along the plat. No vegetation shall be removed from the county iight-of- WClt14*11g U1 IV IV CIMICaL1011. There was discussion on the motion. Planning Minutes, 9/3/96, Page 1 I Dawson moved to add to the above motion to clarify items 5 (as above) and 25, packet 2 page 116: 3 4 "...This buffer shall be planted so that it does not interfere with sight distance 5 requirements of the Whatcom County Development Standards. This buffer shall 6 be maintained in perpetuity dlf3e!;::.:::::.:::: IP tY ..:::..:....::........:.......:...:......::.....:..: ....:::.....�..... :..:....::... 7 8 At this point, Barrett and Aamot notified the committee that the Hearing Examiner's 9 amendments to his requirements were not in the packet. Starkenburg stated a substitute 10 document will be provided at the end of this meeting for incorporation into the packet for 11 tonight's meeting. 12 13 Starkenburg noted the corrected item 5, packet page 95, should read: 14 15 "Ten feet of right -of -way shall be dedicated to Whatcom County adjacent to 16 Mosquito Lake Road along the entire frontage of the plat for a total half -width of 17 30 feet along the plat. No vegetation shall be removed from the county right-of- 18 way except as required in condition No. 2 as oth ved by both 19 Whatcorn County Public Works and Vffiatcom eounty Planning and Development 20 Services mid all required buffiers shail be planted outside the county right-of-way, 21 including the f 0 foot dedication." 22 23 Starkenburg further noted that this above language was dated August 16, which was then 24 incorporated into this document. 25 26 Gibson stated he assumed that what was in the packet was the Hearing Examiner's latest 27 documentation. The approval of the long plat must also be addressed. 28 29 Starkenburg stated this item would be tabled until the end of the meeting. Gibson and 30 Woods continued their examination of the sections in question. 31 32 (Clerk's Note: After completion of discussion of item 2, committee returned to this item) 33 34 Woods stated the committee should substitute the Recommendation and Decision 35 paragraph on packet page 82 as stated on the August 20, 1996 Hearing Examiner's Findings, 36 Conclusions and Recommendation. Also, on packet page 94, Conclusions of Law, IX would 37 become X; the new IX would read: 38 39 40 41 42 43 Planning Minutes, 9/3/96, Page 2 As previously discussed, Woods continued, Recommendation 5 is significantly different between the two documents (August 16 and August 20 Hearing Examiner's documents). Recommendation 5 on packet page 95 needs to be stricken as written and substituted with the Hearing Examiner's recommendation of August 20, 1996: Further discussion followed regarding accessory dwellings and energy - efficient homes. Starkenburg withdrew his motion to amend. Dawson withdrew her motion to amend. Starkenburg moved to use the substitute. Hearing Examiner's recommendation of August 20, 1996. Motion carried unanimously. 2. CONSIDERATION OF HEARING EXAMINER'S RECOMMENDED APPROVAL OF A PLANNED UNIT DEVELOPMENT, FILED BY DR. YING SEK CHAN FOR "WOODLAKE MEADOWS" (PUD95 -0001 AND PLS94- 0005) (AB96 -303) Planning Minutes, 9/3/96, Page 3 Those speaking included: Jack Swanson Pat Jones, Jones Engineering Bob Andersen Matt Aamot, Land Use Services Dan Gibson, Council's Counsel Kim McAdams Barbara Gimrith Topics discussed included: buffer size; changes by Council (Gibson); the Hearing Examiner's recommendations; the second public hearing's discussion on water quality; and delineation by the Army Corps of Engineers. Dawson moved to amend the Hearing Examiner's recommendation to reduce the buffer from 100' to 50' by deleting the first sentence on packet page 121, item 20: "The buffer around Wetlandedepicted on e;diibit H shall be inct eased to feet- There shall be no buffer averaging. No mechanized equipment or...." Motion carried unanimously. Aamot referred to a memo from Mary White, Engineering, regarding the Hearing Examiner's Recommendation 5 (packet page 119). Starkenburg stated this will be discussed at tonight's meeting. There was further discussion on this memo. Starkenburg stated again this matter will be discussed and action taken tonight before the full Council. (Clerk's Note: This item was forwarded to Council without a recommendation.) OTHER BUSINESS Comprehensive Plan (AB96- 051D): Starkenburg noted this document was received today (except for the Land Use and Capital Facilities chapters). He thanked staff for all their hard work. Starkenburg further stated the format would consist of two chapters at a time in the Planning and Development Committee. Other Council members would be asked to attend as their schedules allow. Only staff would be heard; committee would be giving direction to staff._ The reason for this is that the most recent information will be available for the hearings. The beginning date for the committee hearings would be September 10 through October 8. Only written comments from the public would be accepted. Michael Knapp, Planning and Development Services, stated his department would focus on what is not in compliance. Elizabeth Sjostrom, Planning, also commented. Planning Minutes, 9/3/96, Page 4 I The committee was in agreement with Starkenburg's suggestion. 2 3 Brenner agreed to hold Public Works and Capital Projects Committee from 1:00 to 4 2:30 p.m. so Planning and Development Committee could begin at 2:30 p.m. 5 6 Interlocal Agreement (AB96- 042A): This matter will continue with Planning star, 7 Council's counsel, and the Administration working on the Agreement. Woods pointed out there 8 is no longer any formal intent to adopt the previous Agreement. 9 10 Comprehensive Plan (AB96- 051D): Starkenburg suggested including Custer in the 11 Comp Plan. There was discussion. Planning and Development Committee recommended giving 12 staff direction to include Custer in the Comp Plan. 13 14 Lot Consolidation (AB94- 516A): Dawson called attention to the time schedule by 15 Planning on lot consolidation. Knapp responded; Gibson also commented. Woods recommended 16 Planning Commission members be requested to attend the Comprehensive Plan hearings. This 17 would assist Council members in understanding background information in order to get a 18 complete picture of the Comp Plan.
