Also Present: Absent: Marlene Dawson None Barbara Brenner Torn Brown Kathy Sutter Robert Imhof Alvin Starkenburg ANNOUNCEMENTS Nelson announced that Growth Management (AB96 -051) and pending litigation (AB96- 077) were discussed in executive session at noon today. Also, another pending litigation (AB96- 077) was discussed at 6:30 p.m. regarding a traffic accident. Council gave direction to its attorney. Nelson thanked Starkenburg for filling in for him while he was away on military reserve training. OPEN SESSION The following person addressed Council in open session: Larry McCarter, RDS: Construction debris recycling (AB96 -154A) CONSENT AGENDA Dawson reported for Finance and Administrative Services Committee and moved to approve the consent agenda items. Dawson requested items 7 and 9 be pulled. Brenner requested that item 1 be pulled. Motion to approve carried unanimously. REQUEST AUTHORIZATION FOR THE EXECUTIVE TO AWARD THE PURCHASE OF TEN VEHICLES FOR THE SHERIFF'S DEPARTMENT TO THE LOW BIDDER, DIEHL FORD (AB96 -318) Dave Wareing, Executive's Office, explained this item. Dawson moved approval of item number one. Motion carried unanimously. 2. REQUEST AUTHORIZATION FOR THE EXECUTIVE TO AWARD THE CONSTRUCTION OF A STORAGE BUILDING AT THE CENTRAL SHOP FACILITY TO THE LOW BIDDER, R. L. BATES CONSTRUCTION (AB96- 319) 3. RESOLUTION ESTABLISHING CRP 996009, SHOULDER WIDENING OF BRUCE ROAD/MAINE STREET AND APPROVAL OF AWARD OF CONTRACT TO THE LOW BIDDER, WHATCOM BUILDERS IN THE AMOUNT OF $94,673.00 (AB96 -320) 4. RESOLUTION AUTHORIZING COUNTY PARTICIPATION IN THE IMPROVEMENT OF E. AXTON ROAD (AB96 -321) 5. REQUEST AUTHORIZATION FOR THE EXECUTIVE TO ENTER INTO CONTRACT AMENDMENT WITH THE DEPARTMENT OF CHILD AND FAMILY SERVICES FOR ADULT AND YOUTH OUTPATIENT SERVICES (AB96 -322) 6. REQUEST AUTHORIZATION FOR THE EXECUTIVE TO RENEW THE INSURANCE POLICY ON THE WHATCOM CHIEF FERRY (AB96 -323) 7. RESOLUTION ESTABLISHING CRP 996002, THE INTERSECTION SIGNALIZATION OF THE SLATER RD/HAXTON WAY INTERSECTION AND APPROVAL OF AWARD OF CONTRACT TO THE LOWEST BIDDER, TIGER CONSTRUCTION, IN THE AMOUNT OF $391,262.75 (AB96 -324) This item was explained by Dawson, who spoke to the issue of taxing. She moved approval with the amendment that no taro or employment tax be paid to the tribes by the County. Dave Wareing, Executive's Office, and Jeff Monsen, Public Works, explained that the County does not pay the tax, the contractor does. Nasser Mansour, Engineering, responded in answer to a question from Nelson regarding the purchase of the right -of -way. Main amended motion carried unanimously. 8. REQUEST AUTHORIZATION FOR THE EXECUTIVE TO GRANT PERMISSION TO THE WHATCOM COUNTY SEARCH AND RESCUE COUNCIL (SAR) FOR THE REMODEL OF THE EXISTING SAR BUILDING ON COUNTY -OWNED PROPERTY (AB96 -325) 9. REQUEST AUTHORIZATION FOR THE EXECUTIVE TO ENTER INTO AN INTERLOCAL AGREEMENT BETWEEN WHATCOM COUNTY AND THE CITY OF BELLINGHAM TO ADDRESS CRIMINAL JUSTICE COSTS FOR NON - FELONY CASES (AB96 -326) Dawson moved to approve the substitute agreement with flexibility for the administration to proceed. Motion to approve carried unanimously. PUBLIC HEARINGS 1. RESOLUTION AUTHORIZING THE SALE OF TAX TITLE PROPERTY, REQUEST #95 -9 (AB95 -502A) Nelson opened the public hearing. Hearing no one, Nelson closed the public hearing Imhof moved approval of the resolution. Imhof moved to amend by making the minimum bid $1.00. Motion to amend carried unanimously. Nelson moved to reconsider. Motion carried 6 -1 with Brenner opposed. Nelson explained that a motion to amend to a minimum bid of $1.00 was not voted on. RESOLUTION AUTHORIZING THE SALE OF COUNTY -OWNED PROPERTY, REQUEST #95 -10 (AB95 -503A) Nelson opened the public hearing, and the following people spoke: Maynard Parks, 2617 North Shore Road Wayne Beech, 8702 Silver Lake Road Carole Hammond, City of Bellingham Parks Department Hearing no one else, Nelson closed the public hearing. Brenner moved approval of the resolution. Brenner moved to amend to include a minimum bid of $1.00. Motion to amend carried 6 -1 with Sutter opposed. 22 Main motion as amended carried 6 -1 with Sutter opposed. ?3 24 OTHER ITEMS 25 26 1. ORDINANCE AMENDING WCC CHAPTER 1.10 ESTABLISHING 27 PROCEDURES FOR THE SALE OR CONVEYANCE OF COUNTY -OWNED 28 PROPERTY AND REPEAL OF WCC CHAPTER 2.27 (AB96 -302) Bob Woods, Council Budget and Program Analyst, gave background information. Imhof moved to adopt the ordinance. Sutter moved to amend on page 4, Section 1.10.270 to include "current use" line 10, after potential uses. Strike the word "and ". ............................... "...improvements affecting its economic value-and potential uses and r r s...." Motion to amend carried unanimously. Imhof moved to amend on page 4, Section 1. 10.270 to include "and the department shall include a listing of all costs incurred in the property". Insert in line 26 after the word "value ". ". Motion to amend carried unanimously. Motion to adopt as amended carried unanimously. 2. ORDINANCE AMENDING WCC 8.15, SOLID WASTE DISPOSAL SITES, EXEMPTING THE PROCESS AND DISPOSAL OF CONSTRUCTION AND DEMOLITION WASTE (AB96 -154A) Dawson moved to adopt the ordinance. There was discussion on the motion. Motion to adopt carried 6 -1 with Brenner opposed. INTRODUCTION ITEMS Imhof moved to accept the introduction items. Motion carried unanimously. 1. ORDINANCE AMENDING THE BUDGET, REQUEST #7 (AB96 -327) 2. ORDINANCE AMENDING ORDINANCE 95 -033 AND THE WHATCOM COUNTY CODE SECTION 20.92, REGARDING APPEALS OF HEARING EXAMINER DECISIONS TO THE COUNTY COUNCIL (AB96 -288) 3. RESOLUTION ESTABLISHING VARIOUS ROADS IN THE BAKERVIEW SPUR/IRONGATE ROAD AREA AS COUNTY ROADS (AB96 -328) REPORTS AND OTHER ITEMS FROM COUNCIL MEMBERS Criminal Justice (AB96 -008): Starkenburg referred to a letter (on file) from Representative Thompson. He requested Council input on whether a response (with a copy to Administration) would be appropriate. City of Nooksack Water Storage Needs (AB96 -410): Starkenburg referred to a letter from the City of Nooksack (on file) regarding its two proposed water tanks. He requested Council input regarding sending a letter to the state health department. Dan Gibson, Council's counsel, commented. There was consensus for approval. Skateboard Park (AB96 -286): Brenner corrected the agenda to note that the work session is on Wednesday, September 25, at 7 p.m. in the Chambers. Road Naming (AB96 -196): Public Works and Capital Projects Committee's work session on this item will be on Tuesday, September 24, at 10 a.m. Sutter noted that on October 5 the Coalition of Washington Counties will be holding a candidate rally at the Ellensburg Rodeo grounds. Northwest Regional Council (AB96 -010): Nelson requested Council input for its next meeting. North Sound Regional Network (AB96 -010): Nelson stated assistance from Council regarding a conflict in meeting time with the Mental Health Board and asked if anyone can help to please get back to him. Nooksack Steering Committee (AB96 -010): Nelson noted Sutter is involved with this committee and asked Council members having questions to see him. Hearing Examiner Request for Qualification (AB96 - 050): Imhof noted the responses are scheduled for the next Council meeting (October 10). Imhof noted he is unable to canvass on September 26. Brenner volunteered for 9:30 a.m. Brown reminded all Council members about the invitation to the Nooksack presentation of a check to the Sheriffs Office on September 18 at noon. Pete Kremen, County Executive, requested an optimum time for a tour of Lake Whatcom. Dawson stated this has been discussed by Council members, and it was decided a meeting and a discussion would be most appropriate. Kremen stated it would be a very informative and productive tour. Starkenburg noted Council is very busy with its work, especially the Comp Plan; there is no lack of interest in this item. He thought it would be more appropriate to schedule the tour at a later time for next year. Kremen thought it would work if two Council members could tour for an October tour and report to Council. Dawson suggested a video. Kremen noted the tentative date is October 25. He will get back to Council regarding all the arrangements.
